MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE
-- PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS,
HELD ON DECEMBER 14, 1998, AT 6:30 P.M., IN THE COUNCIL CHAMBERS,
CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS.

APPLICATION NO. 483
I. CALL TO ORDER
The Joint Public Hearing for zone change request from classification Suburban
Development to Light Industrial District (M-1) was called to order at 6:35 p.m.
II. PURPOSE OF HEARING
Request of owner for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Suburban Development (SD) to Light
Industrial District (M-1) on the following described property, to wit:
Legal Description: Being lot 48, a 3.999 ac. tract, Allison Richey Gulf
Coast Home Co. subdivision, H.T. & B. R. R. Co.
survey, recorded in Vol. 2, pg 23, plat records of
Brazoria Co., TX (13502 Roy Road)
Owner: Virgil & Grace M. Elliott

The purpose of the public hearing was read into the record by Chairman Mary
Starr.
Director of Planning & Community Development Dennis Smith presented a
map locating the proposed zone change. Mr. Smith noted that the property
abuts an open field, business to the North, and some residential. He also
made note that this is an existing business.

IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS

V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Mayor Tom Reid asked what type business was existing.
Director of Planning and Community Development did not know what type of
business however, there is a residence and business on the property and to
protect the business a M-1 zoning was determined.
Councilmember Richard Tetens asked if there was anything on the property.
Dennis Smith noted that both home and business were occupied.
Councilmember William Berger asked if other M -1's were in the area.
Dennis Smith did note one other application for a M-1 zone in the area.
Councilmember Richard Tetens stated that Application No. 485 which appears
later on the Joint Public Hearing docket for an M-1 in the property adjoining
this property.
Dennis Smith noted that this is a common classification for most businesses to
have a consistent zoning.

Klauss Seeger asked if more specifics on the business could be requested.
It was noted that this is not a requirement for a zone change.

ZONE CHANGE APPLICATION NO. 484
I. CALL TO ORDER
The Joint Public Hearing for zone change application No. 484 from
classification Suburban Development (SD) to Light Industrial District (M-1) was
called to order at 6:44 p.m.
II. PURPOSE OF HEARING
Request of owner for an amendment to the Land Use and Urban Development
Ordinance of said City from Classification Suburban Development (SD) to Light
Industrial District (M-1) on the following described property, to wit:
Legal Description: The S 87.5 ft. of lot 7 & the N 12.5 ft of Lot 8, Blk. 6,
Hickory Creek Place subdivision, H.T. & B. R.R. Co.
survey, A-219, recorded in Vola 11, pgs 1-2, plat records of
Brazoria Co., TX -(14013 Suburban Garden)

The purpose of the Joint Public Hearing was read into the record by
Chairperson Mary Starr.
Director of Planning and Community Development Dennis Smith provided a
map showing the location of the property. Whiff's storage is located on Lot 9
and this is a common classification for the area.
III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS
Peter Lunn, 14221 Garden Road, Pearland, Texas, spoke in support of the
proposed change. Mr. Lunn stated that he is also a business owner on
T - Garden Road and feels Garden Road is an industrial corridor with 32 or more

businesses on it. He has a zone change application for a M-1 pending and he
feels this is a very strong industrial area.
Orlen Pat O'Day, 14405 Garden Road, Pearland, Texas, spoke in support of
the proposed zone change stating that there are 32 or 33 businesses on
Garden Road and he has been a business owner on Garden Road and is part
owner of one of the oldest businesses in Pearland. He agrees that Garden
Road is and Industrial Corridor with businesses from 518 all the way to the
school.
Tom Hodges, 14215 Suburban Gardens, Crane Tech, spoke in support of the
proposed zone change stating that he owns the property to the east side of the
road (shop facility) and on the west side of the road (storage yard) and
additional working space. He stated that this has been and industrial area
since 1950. He presented a picture of one of the first buildings built on his
property in 1970 when very few homes were in the area. Hickory Creek
Estates were aware that Garden Road is an industrial area when the homes
were built and businesses are not being put between houses. He strongly
request approval of these zone change request.
Jim Fuller, 13120 Garden Road, Pearland, Texas, supports the zone change
stating that he also has a business on Garden Road and has been in business
since 1976 and repairing trucks and heavy equipment. He notes that there are
very few homes around him. The area is predominately businesses.
Donna Lunn, 14221 Garden Road, Pearland, Texas, spoke for the zone
change noting that she has a pending zone change application in this area.
She feels that this is an area were the businesses have been here for a long
period of time and the homes that have been built in the area were aware of
the existence of the businesses when they were built. The business owners
have tried to follow the Land Use and Urban Development Ordinance in
selecting the appropriate classification for the area and business.
IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS
Michael Cotter, 2549 Lazy Bend, Pearland, Texas, spoke in opposition to the
proposed change. He noted concerns for traffic created by the heavy
equipment specifically on Gardenia and Laurie Lane. He suggest that a traffic
light at Garden might alleviate some of this traffic. He noted concerns for the
deterioration of the roads due to the heavy traffic and equipment. Additional
concerns were for chemical storage in the industrial areas. He noted fire
safety concerns in connection to the chemical storage. He stated that there
are house on the East side of Garden Road as well as Garden Road Baptist
Church. He suggested that this would become a Patch Work zoning. He

asked that the Council and Planning and Zoning Commission do a little more
planning in the zoning of these properties.
