1995-01-23 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF JOINT PUBLIC HEARINGS OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND HELD ON JANUARY 23, 1995, AT 6:30 P. M. Absent from the hearings: City Manager Paul Grohman and Commissioner Marshall Eggers. Mayor Coppinger announced the Planning and Zoning Commission would meet in the lobby on the second floor after the hearings were over. Stating that Application No. 50 might be lengthy, Mayor Coppinger asked permission to start with Application No. 51. Council and Commission gave their concurrence. Emil Beltz, Chairman of Planning and Zoning, introduced his fellow commissioners. PURPOSE OF THE HEARINGS: APPLICATION NO. 51 REQUEST OF DANIEL GUILLEN, AGENT FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE FROM CLASSIFICATION LIGHT INDUSTRIAL (M-1) TO GENERAL BUSINESS (GB) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Lots 11-14 & 17-18, block 2, lots 1-8 & 11-18, block 3, lots ^ 1-5, block 4, and lots 1 & 4, block 1 of Airport Sites Subdivision (Area of First, Second & Third Streets bounded by State Highway 35 & Santa Fe Railroad) NUMBER OF PERSONS SIGNING ATTENDANCE ROSTER: 15 PERSONS SPEAKING FOR THE PROPOSED REQUEST: 1. Daniel Guillen, P. O. Box 971, Pearland. Mr. Guillen stated twenty signatures were gathered in support of rezoning twenty- nine lots in the Airport Sites Subdivision. Mr. Guillen explained that many people in this area were property owners of longstanding. Mr. Guillen informed he owns a lot in this 196 area and would like to build a house. At present, Mr. Guillen explained, the homeowners are zoned M- 1 which means if 51% of their dwellings were damaged they would have to vacate their homes. Rezoning to General Business with a Specific Use to allow single family dwellings would give homeowners the needed incentive to maintain their neighborhood, Mr. Guillen closed. 2. Jose Guillen, Jr., 8211 Holiday, Houston. Mr. Guillen stated the area would like to be maintained as residential, citing the history of the area. Mr. Guillen stated he would like to build a home on the property he owns there. PERSONS SPEAKING AGAINST THE PROPOSED REQUEST: 1. Joe Alvarez, 2203 Fairway Circle, Pearland. Mr. Alvarez stated he owns property on First and Second Streets and stated this area is no longer suitable for residential as it was earlier because the mixture of zoning districts, light industrial, commercial, and general business, does not blend well together. The area is confined, he stated, with no place for children to play. 2. Van Rodriguez, Third Street, Pearland. Mr. Rodriguez stated his family owns commercial property on State Highway 35 and Third Street and are making improvements to it. Mr. Rodriguez requested the property remain commercial, stating this area was similar to a downtown area for Pearland. QUESTION AND ANSWER PERIOD: None ADJOURNMENT The hearing adjourned at 6:47 P. M. SPECIFIC USE NO. 36 REQUEST OF DANIEL GUILLEN, AGENT FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE TO ALLOW SINGLE FAMILY DWELLINGS IN A GENERAL BUSINESS DISTRICT ( GB ) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Lots 11-14 & 17-18, block 2, lots 1-8 & 11-18, block 3, lots 1-5, block 4, and lots 1 & 4, block 1 of Airport Sites Subdivision (Area of First, Second & Third Streets bounded by State Highway 35 & Santa Fe Railroad) NUMBER OF PERSONS SIGNING ATTENDANCE ROSTER: 17 PERSONS SPEAKING FOR THE PROPOSED REQUEST: 1. Daniel Guillen, P. 0. Box 971, Pearland. Mr. Guillen asked that those who came in support of this issue be recognized by a show of hands. Their homes and their money are in Pearland, Mr. Guillen stated. Closing his remarks, Mr. Guillen contended this area was a safe place for children. 2. Jose Guillen, Jr., 8211 Holiday, Houston. Mr. Guillen stated property owners aren't asking the business people in this area to leave but would like help in reclaiming their homes. PERSONS SPEAKING AGAINST THE PROPOSED REQUEST: 1. Joe Koza, First Street, Pearland. Mr. Koza stated his family owns a business in the area and is planning an expansion. What effect will rezoning have on their plans, Mr. Koza asked. 2. Joe Alvarez, 2203 Fairway Circle, Pearland. Mr. Alvarez stated again that the area was unsafe for children and should not be residential. QUESTION AND ANSWER PERIOD: In discussion, it was noted that only owners of lots listed are 197 applying for this change and it will not affect other property in the area. ADJOURNMENT The hearing adjourned at 6:55 P. M. APPLICATION NO. 50 REQUEST OF GREENWOODS DEVELOPMENTS, INC., OWNER, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE FROM CLASSIFICATION GENERAL BUSINESS (GB) TO GENERAL BUSINESS - PLANNED UNIT DEVELOPMENT (GB -PUD) AND SINGLE FAMILY DWELLING DISTRICT - PLANNED UNIT DEVELOPMENT (R3 -PUD) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: A 7.2220 acre tract, W.D.C. Hall League, A-70, Brazoria County, Texas (Proposed GB -PUD) (2300 Dixie Farm Road) A 12.6350 acre tract, W.D.C. Hall League, A-70, Brazoria County, Texas (Proposed R3 -PUD) (2300 Dixie Farm Road) NUMBER OF PERSONS SIGNING ATTENDANCE ROSTER: 49 PERSONS SPEAKING FOR THE PROPOSED REQUEST: 1. Al Lentz, Lentz Engineering, 5703 Rockland, Pearland. Mr. Lentz, representing Greenwoods Development, Inc., discussed the proposed plans for these two sites. Approximately one- half of one tract will be appropriated to a detention pond with approximately one-half of the other designated as green space. Planned unit development districts demand more stringent requirements of the developer, Mr. Lentz informed, and will allow for the orderly growth of this area. Thirty-one garden homes are proposed with high architectural standards, Mr. Lentz stated, noting that this area with its current zoning of general business could be used for many other enterprises. 2. William F. Mitchell, 900 Middlecreek, Friendswood. Mr. Mitchell stated he would be a good neighbor while developing this property for its highest and best use. Stringent architectural controls will be used on the homes and office structure, Mr. Mitchell related, with nature trails provided and protection for the designated wetlands ensured. PERSONS SPEAKING AGAINST THE PROPOSED REQUEST: 1. Dan Moore, 2405 Creekridge, Pearland. Mr. Moore informed he is an insurance agent and this area is in the floodplain. Allowing construction on this site will make the City ineligible to participate in the National Federal Insurance Program, Mr. Moore stated. Referring to October, 1994, rains, Mr. Moore informed the area flooded because of dirt movement done in the area. 2. Barbara Cleghorn, 2409 Creekridge, Pearland. Ms. Cleghorn voiced her opposition, citing flooding and traffic problems. A better alternative for this site would be a park, Ms. Cleghorn suggested. 3. Patricia Casey, 605 Rustic Lane, Friendswood. Ms. Casey stated she and her husband own property across the street from this site and plan to build a home there. Ms. Casey expressed concerns about flooding and asked that the drainage problem be solved. 4. Ray Corder, 1606 Willits, Pearland. Mr. Corder expressed concerns about flooding and increased traffic. Noise is also a problem as all -terrain vehicles now frequent the detention sites. Growth without the support of the residents is foolish, Mr. Corder stated, and suggested this area become a park. 5. Susan Partridge, 1601 Willits, Pearland. Ms. Partridge discussed past heavy rains which caused no problem. The October, 1994, rains caused the detention ponds to be out of their banks and over Dixie Farm Road, Ms. Partridge related. The backflow calculation from Clear Creek needs to be reevaluated, Ms. Partridge urged. 6. Shirley Long, 2404 Creekridge, Pearland. Ms. Long related water drained off better in prior years under heavier rain. The residents have seen changes in the water accumulation and general drainage in this area should be solved before any more development is allowed, Ms. Long stated. 7. Donna Lunn, 2609 Mary, Pearland. Ms. Lunn stated there is a drainage problem due to development and asked that the area be kept as now zoned so that it would not affect Longwood Park further. 8. David Byers, 2407 Creekridge, Pearland. Mr. Byers stated hydraulic engineering is a guess, at best, and urged this request be put on hold or disallowed until new calculations are done. 9. Scott Shatto, 1804 McGinnis, Pearland. Mr. Shatto expressed his objection, stating flooding, traffic, and noise as concerns. QUESTION AND ANSWER PERIOD: In discussion, it was determined the proposed one story homes will be 2000-3500 square feet in size, aimed at the retiree market.
