A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
ENTER INTO A CONTRACT WITH CLAUNCH & MILLER, INC.
ENGINEERING CONSULTANTS FOR SERVICES TO PRODUCE
STANDARD CONSTRUCTION SPECIFICATIONS FOR THE CITY OF
PEARLAND.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and
Claunch & Miller, Inc. Engineering Consultants, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a contract with Claunch & Miller, Inc. Engineering
Consultants, for and on behalf of the City of Pearland, for services to produce
Standard Construction Specifications for the City of Pearland.

Re: Fee Proposal for Producing Standard Construction Specifications for the City of Pearland
Dear Mr. Hargrove:
Claunch & Miller, Inc. (CMI) is pleased to submit this proposal for providing engineering services to
produce Standard Construction Specifications for the City of Pearland.
PROJECT DESCRIPTION
Develop Technical Specifications including General and Special Conditions with input from City Staff and
others as obtained through public meetings. Specifications will be based on the Construction Specification
Institute sixteen part format. Where possible, standard 'specifications familiar to the construction industry
will be utilized and modified to conform to the City's criteria.
SCOPE
· Meet with City staff to determine specific concerns and objectives.
· Obtain copies of specifications, standards and construction details currently in use by the City, where
available.
· Obtain available standard general conditions, special conditions and technical specifications from
governmental entities and commercial sources. Review these with the City Staff for suitability.
· Prepare Draft General Conditions, Special Conditions and Technical Specifications as listed on
Attachment "A" hereto. Use Construction Specification Institute sixteen part format.
· Present Draft Specifications to the City staff. Four copies will be provided.
· Revise Draft Specifications as necessary to incorporate comments of City Staff.
· Present Final Draft Specifications to City staff for use during public comment period. Four copies will
be provided.
· Conduct Public Meeting to invite public comment. City will advertise and notify local developers,
engineers and contractors.

Present Final Draft Specifications to City Council at a Council Workshop. Also, present revisions
proposed due to public comment.
Finalize specifications to incorporate appropriate revisions based on input from Council and Public
Meeting..
· Present Final Specifications to City Staff for adoption by City Council.
· Attend Council Meeting for final adoption of Specifications.
Provide one final unbound hard copy and a computer disc of complete specifications for the City' s use
in publishing copies for distribution. Distributed copies shall include the statement as included in
Attachment "B" hereto.
Provision of Contract Forms, Bond Forms and other "front end" (Division 0) documents is specifically
excluded from this scope of services.
Due to the high potential for extended editing, unanticipated work sessions and input from
unanticipated interest groups, CMI's participation in meetings, review sessions, public meetings and
council presentations are as presented in this scope.
It is the intent of this scope to utilize and edit such existing standard documents for the preparation of
standard specifications for the City of Pearland. It is not the intent of this scope to generate the
documents from "scratch" or without existing specification data.
ADDITIONAL SERVICES
"Additional Services" shall only be performed when directed by the City to CMI. These services are
not considered normal or customary engineering services.
Preparing to serve or serving as a consultant or witness for the City in any litigation, public hearing
(other than mentioned in scope) or other legal or administrative proceeding involving the Project.
· Additional services not otherwise provided for in the Scope of Services.
Additional meetings, review sessions, public meetings or presentations beyond those listed in above
scope.

FEE
Basic Services
Claunch & Miller, Inc. 's fee for complete preparation of Standard Specifications
including General and Special Conditions and presentations is the lump sum amount of:
$29,000.00
Additional Services
Additional Services beyond those described in the Basic Services will be invoiced on the basis of direct
labor cost times a factor of 2.99 and direct cost plus 10%.
FEE SCHEDULE
Claunch & Miller, Inc. will submit monthly progress invoices for all engineering work completed to invoice
date. This invoice would be based on the percentage of completion applied to the lump sum fee.
Claunch & Miller, Inc. appreciates the opportunity to submit this proposal and to be considered to provide
these services to the City of Pearland.

Issue the following instructions and directions to all users (Consulting Engineers or City Staff Engineers,
hereinafter referred to as "Designer") of the specifications prepared by Engineer.
The Master Specifications have been prepared to include the requirements, features, materials of
construction, and related items desired by the City based on its experience and needs. The Designer shall
carefully review each Master Specifications and edit as necessary to suit project-specific requirements and
to meet the design intent of the project.
The Master Specifications are current as of the date of issue (shown in the lower left hand comer of each
page). The Designer is directed to review engineering practices and legal developments as of the date of use
and make any necessary revisions to the appropriate sections.
Revisions to the Master Specifications shall not be made simply to comply with Designer standards or
preferences. The Designer must base any revisions on the requirements of the project, subject to review and
acceptance by the City.
The Designer shall be responsible for the preparation of additional specification sections necessary for the
bidding and construction of the project. The final Contract Documents shall be complete with all
specifications, standard details, and drawings fully coordinated. The text of new specification sections
prepared by the Designer shall comply with the format of the Master Specifications.
After incorporation of any changes to the Contract Documents resulting from the final review comments of
the City, the Designer shall seal the Contract Documents as Engineer of Record in accordance with the
Texas Engineering Practice Act.
