A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS
DESIGNEE TO EXECUTE A CHANGE ORDER WITH BEYER
CONSTRUCTION, INC. FOR PAVING AND DRAINAGE
IMPROVEMENTS ALONG PEARLAND PARKWAY FROM OILER
DRIVE THROUGH MARY'S CREEK.
WHEREAS, the City of Pearland constructed paving and drainage improvements
along Pearland Parkway from Oiler Drive through Mary's Creek to improve traffic and
drainage flows within the City; and
WHEREAS, construction of the paving and drainage improvements along
Pearland Parkway resulted in a change order estimated to be $81,977.30; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Manager or his designee is authorized to execute a change
order with Beyer Construction, Inc. for paving and drainage improvements along
Pearland Parkway from Oiler Drive through Mary's Creek.
Section 2. That the costs associated with said change order will be paid from
the City's 1997 Certificates of Obligation.

SUBJECT: Approval of Change Order No. 4 to Paving and Drainage
Improvements, Pearland Parkway, from Oiler Drive through
Mary's Creek; Byer Construction, Inc.
Darrin, I need the following on Council agenda ASAP:
CONSIDERATION AND POSSIBLE ACTION - Increase construction
contract with Byer Construction, Inc. by $81,977.30 to compensate
for under-measured materials in contract bid schedule of
quantities (transition areas into existing pavements built under
an earlier contract were left out, and the width of subgrade was
mis-calculated 2 feet short of actual width for entire length of
project.) This Change Order No. 4 uses contract unit prices.
This project was completed in December, 1998.
Darrin:
Including this change order, all change orders add up to 26.71%
of the original contract amount. The need for this change order
was not discovered until the final closeout pay quantities were
being worked up. Until this change order, change orders were at
15.26% of the original contract, which even included the addition
of a needed crossover at the 9-10 High School east driveway.
The wording of the requested minute action is written as it is in
an attempt to get into the record the fact that this change order
was not at all anticipated, and in fact the work was already
constructed long before the materials quantity shortages errors
in the contract bid schedule were discovered.
This project is 058-9727-565, out of #97 C.O.'s.
