PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS Michael Cotter, 2549 Lazybend, expressed concerns for the residents in the surrounding neighborhood with the proposed M-1 zone change. V. COUNCIL/.PLANNING COMMISSION/STAFF DISCUSSION Richard Tetens, Councilmember, asked Dennis Smith, Director of Planning and Community Development, the number of residents located around the proposed zone change and the size of the lots. Dennis Smith, Director of Planning and Community Development, identified a number of homes on the East side of the property. A mix exists along Garden Road. Dennis Smith stated that the lots are approximately 175 feet deep with 100 foot frontage. VI. ADJOURNMENT The public hearing adjourned at 6:43 p.m. APPLICATIONS NO. 362 AND 451 I. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS Application No. 451 Charlie Eason, Hardcastle Real Estate, agent, 2510 Anthony Lane, spoke in support of the proposed zone change no. 451. Mr. Eason noted that Mr. Winston bought the above described property approximately one year ago and due to another land purchase, desires to sell the property. The proposed zone change would aid in the sale of the property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS Application No. 362 Michael Cotter, 2549 Lazybend, expressed concern for the residents on O'Day road and the proposed zone change not being compatible with existing zoning. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Richard Tetens, Councilmember, inquired as to the number of residents near the property, specifically on O'Day Road. Dennis Smith, Director of Planning and Community Development, noted that there are existing residents and vacant property surrounding the property. West Development 2405 Woody Pearland, Texas 77581 The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. Mr. Smith noted that this is the same property brought before council as a 76.79 acre PUD. The project has been revised reflecting a reduction of approximately 10 acres. Some 250 feet on the NE and E side will remain R-2 to allow for larger homes with R-2 on the left. The Pearland Parkway Overly will apply with appropriate fencing. 175 Mr. Smith stated that the PUD is a development or site plat that shows the layout of the property and gives assurance of what will be built on the property. If approved, no changes can be made without the approval of council. III. PERSON$ WISHING_TO SPEAK FOR THE PROPOSED REQUESTS Renee West, West Development, 2401 Country Club, spoke in support of the proposed zone change. Ms. West presented several letters from persons supporting the zone change. Ms. West noted that she made several attempts to contact residents of Shady Crest but was unsuccessful. She noted that the only access to the above described property would be off Oiler and HI 35. She noted that 200 feet of tree line would be the only thing visible to the residents of Shady Crest. The proposed change would allow city employees, teachers, young couples with families the opportunity to buy a conveniently located and affordable home. Charlie Eason, Hardcastle Real Estate, noted that the agency receives a number of requests for small, no lot line lots and feels the community would benefit from the project. A. G. Crouch, 805 Tall Pine, Friendswood, noted the plan has been revised to meet prior stated concerns. A buffer zone has been added, Pearland Parkway would be between the project and Shady Crest, with no streets from the project. Mr Crouch further noted that West Development is a conscientious developer and provides only high quality developments. Jud Alexander spoke in support of the proposed zone change. He noted that the Private Property Act allows the owner the right to the property. He spoke to concerns of transportation through the area and property owner's rights. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS Ronald Richards, 4015 Longherridge, spoke against the proposed zone change. He noted that the low density zoning is why he -purchased property in the area. He has been a resident for over 20 years and asked that the rights of Shadycrest residents be considered. Ron and Leanne Stricking, 2106 Sprite, expressed concerns for drainage and available services becoming overcrowded notably public schools. Concerns were also noted for access to Pearland Parkway and an increase in crime due , in part, to increased number of students in the area and the ease for skipping school. Samuel Sahagian, 2104 Sprite Lane, expressed the desire to raise his children in the secluded area he had purchased and feels the project would jeopardize the privacy and seclusion of Shadycrest. 176 Pattie Boyles, 4016 Shadycrest, thanked the council for voting down the first PUD request on this property. She noted that the community does not want duplex town homes, She feels the project will attract buyers who can not afford a larger lot. She requested that current citizens be looked after and noting that change is inevitable but request the property remain zoned R-2. Walter Foucheaux, 2102 West Mary's Creek, noted that all traffic into the subdivision goes by his home. He noted that the road surfaces in Shadycrest are not the gest and will deteriorate even more with additional traffic. He feels the property should remain R-2 and not down grade to R-4. Joyce and Jim Walker, 4010 Shadycrest, questioned proposed projects on the West side of Pearland and questioned the real-estate market for $100,000. Adolpho Hruzek, 3905 Long Heritage, spoke against he change noting concerns regarding the light at Yost. Carol Basco, 3416 Shadycrest, stated concerns for Parkview becoming a cut - through and increased traffic. She stated that this side of Pearland has enough MF. Laura Hoffard, 4002 Shadycrest, opposed the proposed zone change. Al Raska, 2107 Sprite Lane, opposed the proposed zone change noting he moved to Pearland because of the low density zoning. Joe Sudela, 2108 Sprite Lane, opposed the proposed zone change and felt it unfair. Dan Keller, 2103 W. Mary's Creek noted concerns for drainage with increased concrete and roof tops. She expressed concerns for detention projects currently under development, specifically the SWEC site. Jan Sheridan, 2104 Lake Edge, noted that they have lived in the area since 1992 and they purchased for the peacefulness and serenity and would not have made the investment had the development been there. Richard Sheridan, 2104 Lake Edge, noted that the property is better as is. Trudy Keller, 2103 West Mary's Creek requested the council members to view drainage of John Lizer. Jim Carsted, 2109 Shadybend, a resident of 36 years, noted his opposition to the zone change. Jim Bost, 2102 Shadybend, noted the same opposition expressed at the previous JPH for the PUD. 177 Ken Nicoll, 3908 Shadycrest, noted that people want larger lots. Anthony Lafaso, 4013 Longherridge, asked how much of the 200 foot buffer would PL Parkway take out. He also questioned how much money needs to be made form 66 acres of land. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Pearland Parkway rqurierments are 130 feet. A pond would be placed in the middle of the property for detention. State Law states that a property can not create more run off. The extension of Pearland parkway does not include Shadycrest. Traffic would be on Oiler Drive and 35 with no access into Shadycrest. Mayor Tom Reid stated that a PUD document addressed all issues of drainage, water and sewer. The PUD, if approved, must be duplicated exactly as presented. VI. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUESTS Charlie Eason, Hardcastle Real Estate, representative of the developer, noted that the elevation of the property is not in the flood way. Victor Botrie, 13014 Thatcher, Houston, noted that this would be a quality development. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUESTS Tudy Keller, 2103 West Mary's Creek, expressed concerns for drainage into Mary's Creek. Dan Keller, 2103 West Mary's Creek, noted the same concerns as previously expressed. He stated that the city is growing extremely fast and has concerns for real planning. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION John Hargrove, City Engineer, noted that drainage for this project would be Coward's Creek. VI.
