1998-10-05 CITY COUNCIL PUBLIC HEARING MEETING MINUTES 6:30PM12,, MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 5, 1998 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid Mayor Pro -Tem Larry Wilkins Councilmember William Berger Councilmember Helen Beckman Councilmember Klaus Seeger Interim City Manager Glen Erwin City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Tetens. Others in attendance: Project Coordinator Alan Mueller; Police Chief Mike Hogg; City Engineer John Hargrove; Planning and Development Director Dennis Smith; Director of Administrative Services Mary Hickling; Utility Accounts Supervisor Missy Miller. PROPOSED ANNEXATION (CULLEN ROAD ANNEXATION, 769 ACRES, & 1,801 ACRES) To consider the proposed annexation of approximately 1,801 acres out of Abstracts 678, 675, 565, 564, 305, and 212 in Brazoria County, Texas, generally located west of State Highway 288, the south line being along County Road 92, the west line being 100' east of and parallel to the Brazoria County and Fort Bend County Line (City of Pearland Ordinance Number 31) encompassing Municipal Utility District Number 9, the north line being approximately 580' south of the centerline of McHard Road (south line of City of Pearland Ordinance Number 813 and Ordinance Number 768), and the east line being along the west line of City of Pearland Ordinance Number 768 and City of Pearland Ordinance Number 762, approximately 3,000' west of State Highway 288. To consider the proposed annexation of approximately 769 acres out of Abstracts 198, 557, 212, 668 and 279 in Harris County and Brazoria County, Texas, generally located west of the Fort Bend County and Brazoria County Line, the north line being approximately 300', more or less, north of Clear Creek in Harris County, the west line being along the east right-of-way line of Farm Market Road 521, the south line being the south line of the Franklin Hooper Survey Abstract 198 and the north line of the A.B. Langerman Survey Page 1 of - 3 10/5 124 Abstract 555, and the east line being the Fort Bend County and Brazoria County common line and the Harris County and Brazoria County common line. To consider the proposed annexation of approximately 1,324 acres generally located north of FM 518 with the south line being along the north line of City of Pearland Ordinance Number 708 and 756; The west line being common along the east line of City of Pearland Ordinance Number 756, the east line of Crystal Lakes and the east line of Municipal Utility District Number 5 north of County Road 403 following said Municipal Utility District Number 5 east line from County Road 403 to 100' south of Clear Creek; The north line being 100' south of the centerline of Clear Creek common with City of Pearland Ordinance 31; The east line being common with the west and north line of Municipal Utility District Number 16, the west right-of-way line of County Road 108 (Max Road) to the intersection of City of Pearland Ordinance Number 31 and following said Ordinance 31 northerly to the intersection with said north line 100' south of Clear Creek. STAFF REVIEW OF PROPOSED SERVICE PLAN Project Coordinator, Alan Mueller, presented the location of the proposed annexation and explained the Service Plans in detail. CITIZEN COMMENTS Bruce Fundling, Mayor Pro -Tem Brookside Village, addressed Council and stated that the City of Brookside totally agrees that every city has an ETJ (Extraterritorial Jurisdiction). Mr. Fundling also stated that there is a pending lawsuit in Judge Hardin's Court, now awaiting a summary judgement to determine if Brookside has an ETJ because of the 100' strip running around Brookside Village. He further stated, that it is their contention, that it is an illegal 100' foot strip. He said that he feels it is a little premature to continue with annexations, until they have the judge's decision. Mr. Fundling said that they are opposed to the annexation along Max Road which is the 1,324 acre annexation. Cynthia Bruning , 625 Hill House, addressed Council and stated that she is speaking on the Cullen Area Annexation. She said that she does not want to be annexed, however, she probably does not have much choice. Ms. Bruning asked if they are annexed, who will her Councilmember be representing their interest in her area. She is also concerned about garbage pickup, and if asked if they could use garbage cans. Page 2 of - 3 10/5 COUNCIUSTAFF DISCUSSION Mayor Reid stated that we do not have districts in Pearland. All elected officials serve at large which means they serve the entire city. Project Coordinator, Allan Mueller, stated that under the City's contract with Waste Management one of the provisions is that the residential customers must use trash bags, instead of trash cans. It is more efficient for the crews, allowing the routes go quicker, which gives the city a better rate. Staff is currently reviewing the possibility of amending the contract to allow the option, to use trash cans, which may be sightly higher rate. Mayor Pro -Tem Wilkins asked when will the substation at Cullen be operational. Project Coordinator, Allan Mueller, stated that the City closed on the property last week. It is his understanding that we will start the first phase in the fiscal year budget 2000; which will be for equipment storage.
