1994-09-26 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF JOINT PUBLIC HEARINGS OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 26, 1994, AT 7:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The hearings were called to order with the following present: Mayor C. V. Miller Councilmember Richard Tetens Councilmember Randy Weber Councilmember Jerry Richardson Planning & Zoning Chairman Emil Beltz Vice Chairman Pat Lopez Commissioner Charles Philipp Commissioner Kevin Cole Commissioner Rob Larsen Commissioner Marshall Eggers City Manager Paul Grohman City Attorney Amy Motes McCullough City Secretary Pat Jones Others in attendance: Division Directors Richard Burdine and Glen Erwin, City Engineer John Hargrove, and Police Chief Mike Hogg. Absent from the hearing: Commissioner Peggy Mayfield -Royer. PURPOSE OF THE HEARINGS: APPLICATION NO. 47 NUMBER OF SIGNATURES ON ATTENDANCE ROSTER: 92 REQUEST OF MIKE ROBINSON, AGENT FOR 313 ACRE PEARLAND JOINT VENTURE C/O MATT PASTERNAK, OWNERS, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE FROM CLASSIFICATION SINGLE FAMILY DWELLING DISTRICT (R-4) TO MULTI -FAMILY DWELLING DISTRICT (MF) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: A 10 acre tract of land out of 297.58 acres, more or less, out of the W.D.C. Hall Survey, Abstract 70 and 35.8 acres in the T. J. Green and T. D. Yocum Surveys, Abstract 198 and 399, Brazoria County, Texas (3500 Block of Liberty Drive). Mayor Coppinger explained to the audience that the Planning and Zoning Commission would meet after these public hearings in the second floor conference room. At this open meeting, the Commission will make its decisions regarding these zoning requests, Mr. Coppinger stated. Emil Beltz, Chairman of the Planning and Zoning Commission, introduced his fellow commissioners. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST 1. Roland Smith, Houston, Texas. Mr. Smith stated he is a developer and expressed interest in constructing low-income, affordable apartments on this site. Rent cost will range from $435 to $635 a month, Mr. Smith informed, and the apartments will be luxurious, decorated, and fully landscaped. Mr. Smith introduced site and floor plans. The term "low-income" is a misnomer, Mr. Smith continued, this being a term used by the 134 State. A marketing survey has determined this type of housing is needed, Mr. Smith related, and, closing his remarks, stated this project could work, being an asset to the community and helping the tax base. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST The following people spoke against the proposed request: 1. Chris Schultz, 2428 Shadybend. Mr. Schultz voiced his objection to the apartments, stating the terms luxurious and low-income were not synonymous. Mr. Schultz cited his objections as increased crime and overburdening of city services and the school system. 2. David Wagner, 2605 Shadybend. Mr. Wagner stated his objection to the apartments, stating his residence will be behind them. Mr. Wagner cited the transient nature of apartment dwellers and increased crime as his objections. 3. Hobert Hoggard, 2406 Colleen. Mr. Hoggard voiced his objection, stating he has been a fireman for seventeen years and has seen the crime in and around apartment units. 4. J. David Tamayo, 3709 Dorothy. Mr. Tamayo stated all his neighbors were united in their opposition to the apartment units. 5. Cindy Crawford, 2417 Laura Lane. Ms. Crawford stated her opposition, citing decreased property values, increased traffic, negative effect on school capacity, and increased crime. 6. Darwyn Crawford, 2417 Laura Lane. Mr. Crawford echoed his wife's objections and stated that the new high school was already at capacity. 7. Joe Lesser, 2507 Shadybend. Mr. Lesser stated he had moved to this area three months ago from apartments and crime would increase if these apartments are allowed. 8. Gene Sanders, Jr., 2405 Parkview. Mr. Sanders stated the proposed apartments would not benefit the Parkview neighborhood. 9. Keri Scully, 3611 Helen. Ms. Scully stated her objection, citing that high density dwellings are directly related to gang activity. City Manager Grohman announced there will be a gang awareness workshop on October 5 at 7:00 P. M. in the Community Center. 10. David Hewitt, 3602 Dorothy. Mr. Hewitt stated his objection to this zoning request because of increased crime and illegal drug use. 11. Leon Paschal, 2419 Laura Lane. Mr. Paschal voiced his objection, stating crime would increase. 12. Henry Coates, 2313 Mary's Creek Court. Mr. Coates stated his objection, citing lower property values. 13. Grady Due, 2610 Stacy. Mr. Due voiced his objection, stating he is often out of town and wants to know that his family is safe. 14. Dan Gaskill, 2503 Shadybend. Mr. Gaskill stated his objection, voicing concerns about the impact on schools and streets and the setting of a precedent for other rezoning of this type. 15. Charles Beckman, 3701 Dorothy. Mr. Beckman objected to the proposed rezoning, stating apartments destroy neighborhoods. 16. Bebe Cates, 2511 Parkview. Ms. Cates stated she had 135 previously managed a high income apartment complex and crime was rampant there. A petition was received by the City Secretary containing seventy- one signatures in opposition to Application No. 47. A letter of opposition from David and Linda Wright, 2328 Colleen, was received by facsimile in the office of the City Secretary on September 26 before the hearing. QUESTION AND ANSWER PERIOD: None ADJOURNMENT The hearing adjourned at 7:37 P. M. SPECIFIC USE NO. 34 NUMBER OF SIGNATURES ON ATTENDANCE ROSTER: 15 REQUEST OF IRA WILLIAM AND REBECCA HUBBARD, OWNERS, FOR A SPECIFIC USE PERMIT TO ALLOW RATITES (EMUS) TO BE RAISED IN A SINGLE FAMILY DWELLING DISTRICT (R-2) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Lot 6, Block 1, Malone Subdivision, in the H.T. & B.R.R. Co. Survey, Section 5, A-237, Brazoria County, Texas (2255 N. Hatfield) PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST The following, among others, spoke in favor of the proposed request: 1. Lee Thomas, 14336 N. Hatfield. Mr. Thomas stated his residence is across the street from the Hubbard's and he had no objections. 2. Robert Nobinger, 2275 N. Hatfield. Mr. Nobinger stated he resides next door to the Hubbard's and had no objections. 3. Jake Richard, 2255 N. Hatfield. Mr. Richard stated he would like to raise emus for an FFA project. 4. Bill Hubbard, 2255 N. Hatfield. Mr. Hubbard stated the birds will be in double enclosed six foot fences. This will be a first rate facility and will be maintained as such, Mr. Hubbard remarked. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST 1. Eric Broussard, 5415 Cunningham. Mr. Broussard stated he was neither for or against the request but had concerns about security, odor, noise, diseases, the number of birds to be kept, and Mr. Hubbard's financial ability to keep this a first rate facility. 2. Mike Lefevre, 5417 Cunningham. Mr. Lefevre stated he had the same concerns as Mr. Broussard. QUESTION AND ANSWER PERIOD: None ADJOURNMENT The hearings adjourned at 7:51 P. M.
