1998-08-24 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES30 .-^ MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON AUGUST 24, 1998, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY > HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. APPLICATION NO. 349 and 322 I. CALL TO ORDER The meeting was called to order at 6:37 PM. II. PURPOSE OF HEARING - APPLICATION NO. 349 and 322 Request of owners, Melvin Dilling (Application No. 349) and Bobby Thompson (Application No. 322), for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to General Business (GB) on the following described property, to wit: Zoning Application No. 349 Being 3.9507 acres out of a 4.846 acre tract recorded under BCCF 93-035649 out of the HT & B RR Co. Survey, A-234, according to the plat records of Brazoria Co., TX (5327 W. Broadway) 2. Zoning Application No. 322 Being lot 7, Westchester Subdivision, according to the HT & B RR Co. Survey, A-242, recorded in the plat record of Brazoria County, Texas. 'i 22 The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the locations of the proposed zone changes. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST None for application 349. None for application 322. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None for application 349. Application 322. Jack McGuff, 2850 Westchester Circle, Pearland, Texas explained that he was not against the proposed zone change but would, however, request access to this project (Application 322) be limited to Manvel Road only and not from the residential area. Mr McGuff also requested that fencing requirements be such as required by the fencing ordinance to separate zones. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Director of Planning and Community Development, Dennis Smith confirmed that entrance to said property would be from CR1128 only and that fencing would comply with ordinance to provide appropriate separation and buffer between zones. VI. ADJOURNMENT The meeting adjourned at 6:41 PM. APPLICATIONS NO. 64 I. CALL TO ORDER The meeting to consider zone change application No. 64 from SD to R-1 S was called to 6rder at 6:42 PM. II. PURPOSE OF HEARING - APPLICATIONS NO. 64 Request of West Development Co., Inc., agent for Ravenwood section 2, J.V., owner, for an amendment to the Land Use and Urban Development Ordinance of 2 32 said City from Classification Suburban Development District (SD) to Single Family Dwelling District - Specific Use (R -1S) on the following described property, to wit: Being 38.699 acres out of the South '/z of the Southeast 14, HT & B RR Co. Survey, A-546, recorded in Vol. 84, pg. 313, Deed Records of Brazoria County, Texas. The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change noting that the specific use request would allow for an equestrian center to be placed on a small portion of the property. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Renee' West, 2510 Westminster, Pearland, Texas, spoke for the proposed zone change. Ms. West noted that the majority of homes in this project would start at $200,000 with 3 homes at $400,000 to $450,000. A small portion of the project would be used for a small equestrian center to house horses belonging to the residents of said property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Tom Sullivan, 5418 West Lea, expressed concerns regarding inadequate drainage to support this area. He also expressed concern for the number of residents unable to attend this hearing due to illness or death in family. Bill Baldy, 3302 Wingtail Way, inquired as to why the equestrian center would not be considered a General Business Zone. He expressed concern as to the disposition of manure. Sue Maxwell, 3211 Wingtail Way, reiterated concerns for the number of residents unable to attend the hearing due to illness. Ms. Maxwell questioned the request that the entire 38 acres be zoned R-1 S when only a small portion would be used for specific use. Mary Jo Huey, 3627 Bluebird Way, explained that the plat map received in her zone change request notification appears to include her back yard. She also expressed concerns for the disposition of the manure from a health standpoint. John Reimer, 3643 Bluebird Way, expressed concerns as to the line shown on the map included with the zone change request notification. He stated that he would be opposed to the described property including road easements. He also noted concerns for health problems. 3 r Bill Webster, 3505 Bluebird Way, also expressed concerns in regard to zoning of road easements. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Director of Planning and Community Development, Dennis Smith explained that .6010 acres of reserve would be used for the equestrian center and zoning of GB would not apply as use would be limited to the residents of Ravenwood. He also noted that all waste disposal would comply with all applicable health requirements consistent with Bay Area Equestrian Center. Drainage considerations must meet standards of engineers and should have no negative impact. He explained that plats received with the Zone Change Notifications are computerized and clarified concerns of property lines actually being the 200 foot notification circle indicated on the map. VI. Wayne Whitt, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Commercial District (C) on the following described properties, to wit: Being a 2 ac. Parcel out of Lot 8, the SE '/4 of the NE '/a HT & B RR Co. Survey A-509, plat records of Brazoria Co., TX (16023 Aubrell) The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the locations of the proposed zone changes. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Henry Wayne, 16011 Aubrell, explained that request for such zone change would permit repair/rebuild of existing mini warehouse should a need arise. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None 4 V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION 34 Councilmember, William Berger inquired as to location of the existing storage buildings. It was noted that all three lots contain buildings. VI.
