1998-07-27 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES235 MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 27,1998,6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The hearing was called to order with the following present: Mayor Tom Reid Councilmember Helen Beckman Councilmember Larry Wilkins Councilmember Richard Tetens Councilmember Klaus Seeger Councilmember William Berger P & Z Chairperson Mary Starr P & Z Vice Chairperson Tommy Scott Commissioner Emil Beltz Commissioner Pat Lopez Commissioner Jack Mathis Commissioner Tommy Scott Others in attendance: Project Coordinator Alan Mueller; Police Chief Mike Hogg; City Engineer John Hargrove; Planning and Community Development Director Dennis Smith; Public Works Director Jerry Burns; Project Specialist Ruby Perez. CALL TO ORDER Planning and Zoning Commission Chairperson Mary Starr read the purpose of the public hearing into the record. PURPOSE OF HEARING - APPLICATION NO. 299 Request of Thomas A. Amundsen, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Light Industrial District (M-1) on the following described property, to -wit: Being 4.9902 acres, being the N. % of Lot 47, H.T. & B.R.R. Company Survey, Section 85, A-304, according to the plat records, Volume 2, Page 107, Brazoria County Texas. (1939 CR93) Pagel of 6 - 7/27 2 J . Planning and Development Director, Dennis Smith, presented the location of the proposed zone change and stated that he would like for Mr. Amundsen to give a short presentation. Tom Amundsen, owner, stated that he is the owner of the business. The business is a machine shop business but more specifically it is a tool and die related work, building plastic injection molds for plastic parts. He has been in business for 15 years with 11 employees. He presented a brochure to Council and explained the brochure in detail. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Tom Amundsen, 9447 Gates Loop, stated that he is speaking in favor of the zone change. Mr. Amundsen asked what he would be able to do if this zone change is not approved? He further stated that he has an investment in this property over a $250,000. He also asked how he could sell his property without a zoning change? PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Sue Simler, 2018 C.R. 93, read a note from Aaron Brooks who resides at 2007 C.R. 93, has a very ill wife stating that they are not in favor of an Industrial Park next to their residence. She further stated that she is 217 feet from the property, and addressed her concerns for the extra traffic on the roads. Ms. Simler stated that she feels that this is a traffic hazard. George Ritchey, stated that he bought his property a little over a year ago. He further stated that it was in the County when he bought his property, but it is in the City now and that is why we are going through this process. He further stated that he does not have a problem with the business he has now. If it is made industrial it will decrease the property value. Mr. Ritchey stated that he is opposed to the zoning change. Jackson Tetley, stated that he is opposed to Mr. Amundsen proposal to go to an Industrial Park because he does not want to the property to go down. John Taylor, 702 Omar, stated that he is a partner in a residential land development company. They have done numerous projects in Houston and also in the Silverlake area. He stated that are going to develop about 300 homes in the area close to this property. He stated that this area is obviously becoming residential. Mr. Taylor further stated that the sign on Hwy 288 says that Pearland is a Master Planned Community and we would love for you to follow that. Steve Muth, stated that he has a contract pending on of plat a land, Three or four lots are from Mr. Amundsen's property. Mr. Muth stated that he is opposed to the zoning change. Page 2 of 6 - 7/27 i Karen Ritchey, 1855 C.R. 93, stated that she out filled an application last week changing their zoning to residential. She asked if the zoning is changed to light industrial does that mean that they cannot put houses on their property later? COUNCIUPLANNING COMMISSION/STAFF DISCUSSION Planning and Development Director Dennis Smith stated that if the property is zoned industrial and someone wants their property zoned residential, they could put an application in for residential and it would be considered on its own merits. Mr. Smith stated without the proper zoning, Mr. Amundsen would not be able to get the permits to expand his business. ADJOURNMENT APPLICATION NO. 295 AND APPLICATION 294 CALL TO ORDER Planning and Zoning Commission Chairperson Mary Starr read the purpose of the public hearing into the record. PURPOSE OF HEARING - APPLICATION NO. 295 AND APPLICATION NO. 294 Request of R. West Development Co., agent for Houston Pine Hollow Associates, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from classification Single Family Dwelling District (R-3) & Commercial District (C) to Single Family Dwelling District (R-4) on the following described property, to -wit: Application No. 295 being 51.412 acres and all of lots 27 & 44, and a portion of lots 42, 45, 46, 47, & 48 out of George W. Jenkins Subdivision it) Volume 2, page 20, A-111, deed records of Brazoria Co., TX. Application No. 294 being 45.6928 acres being all of lots 39 & 40, a portion of lots 41, 42, 45, 46, 47, & 48 out of George W. Jenkins Subdivision in Volume 2, page 20, deed records of Brazoria Co., TX. Planning and Development Director, Dennis Smith, presented the location of the proposed zone changes. Page 3 of 6 - 7/27 1 't PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Renee West, 2510 West Minister, stated that the zone changes for Application Numbers 295 and 294 is like her Pine Hollow Project and it is going to be more of the same, they are going to be nice houses. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilmember Berger stated that everything surrounding the property is R-3 and he asked Planning and Development Director Dennis Smith if that was right. Mr. Smith stated that there are some R -4's in the existing Pine Hollow Estates. He further stated that Pine Hollow has both R -3's and R -4's. ADJOURNMENT APPLICATION NO. 311 CALL TO ORDER Planning and Zoning Commission Chairperson Mary Starr read the purpose of the public hearing into the record. PURPOSE OF HEARING - APPLICATION NO. 311 Request of Jack McGuff, Jr. agent, for Fran Coppinger, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-3) & Commercial District (C) to Single Family. Dwelling District (R-4) on the following described property, to -wit: Being a 11.309 acre Tract in Lot 12 of the H. Masterson Subdivision, section 6, H.T. & B.R.R. Co. survey, A-237 and of Lot 2, Block 1 of the Malone Subdivision, Volume 18, page 103, Brazoria Co. Deed Records, Brazoria County., TX. Planning and Development Director, Dennis Smith, presented the location of the proposed zone changes and stated that he would like Mr. McGuff and Ms. Coppinger to give an overview of the plan for this area. Page 4 of 6 - 7/27 Jack McGuff, 5208 West Broadway, gave an overview of the project. Houses will range in the price of $156,000 to $195,000 or in square footage size about 1650 to 2250 square feet. Reg Applying, 224 Sleepy Hollow Drive, stated that he will be the home builder. He presented a Patio Home Project that he is building in Lake Jackson and stated that this project will be similar. He said these will be up scale homes built on small lots. Fran Coppinger, stated that this is designed for someone to enjoy some common spaces but have someone else mow their front yard for them. Ms. Coppinger gave some of her history and philosophy for Pearland. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Jack McGuff, 2850 Westchester Circle, read a letter from Mr.Lenamon stating that he and his wife Susan are in support of Ms. Coppinger's proposed project. Fran Coppinger Pizzitola, 2111 North Galveston, spoke in support of this request as the property owner. She further stated that she appreciated the Lenamon's letter. There is a need for this type housing and she hopes it is approved. Becky Cornelius, 2415 Golfcrest, broker owner of Pat Griffin Realty, stated that there is a need for a gated community. She stated she is asked all the time for properties like this. Reg Applin, 224 Sleepy Hollow, stated that he wanted to reinforce the idea of the market for this project. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Chris Baker, 2401 Colony Lane, stated that he brought a petition from the homeowners opposing the project. He also had concerns about additional traffic and retail business. Peggy Heartnet, 5609 Tyler, stated that she has concerns for this project. She further stated that she is concerned about flooding, the additional traffic and that the property will not sell out and become rental property. Charles Crook, 2509 Colony Lane, stated that he has lived in the community for the last 15 years. He further stated that he was concerned that the area would deteriorate and is opposed to the zone change. Page 5 of 6 - 7/27 . Ili 240 deal Lynn Guggenheim, 2255 Hatfield, stated that she has lived in Pearland for the last six months and voiced her concerns about traffic and had concerns how it would effect her area. Robert Knowbinger, 2275 Hatfield, stated that there was other property owners boarding this property. He stated he is concerned about the land use change if Patio Homes are not built there. Kerry Joseph, 607 Megan Street, stated that he is opposed to this because it is now a small community and would like for it to stay that way. Mike Orlando, 5611 Tyler, stated that he would like to see the development meet the current requirement for R-2. He further stated that they were extremely successful in getting the petition signed. COUNCIL/PLANNING COMMISSIONISTAFF DISCUSSION Planning and Development Dennis Smith stated that the only insurance that we have that the project will be built as presented is their word. For a land use change it is not necessary for the applicant to submit the use of the land. Councilmember Beckman stated that the land use changes requires the Council to adopt an Ordinance approving the land use change.
