1998-07-13 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES207 MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 13, 1998, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The Joint Public Hearing was called to order with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Chairman Vice -Chairman Commissioner Commissioner Tom Reid Larry Wilkins Klaus Seeger William Berger Helen Beckman Mary Starr Tommy Scott Jack Mathis Emil Beltz Others in attendance: Director of Planning & Community Development Dennis Smith; Planning & Zoning Secretary Mona Ann Phipps, Interim City Attorney Darrin Coker; City Manager Paul Grohman; Projects Coordinator Alan Mueller; City Engineer John Hargrove; Councilmember Richard Tetens and Commissioners Don Baker, Pat Lopez, and Nghiem Doan were absent. APPLICATION NO. 302 I. CALL TO ORDER The meeting was called to order at 6:37 PM. H. PURPOSE OF HEARING - APPLICATION NO. 302 Request of Russell & Nora Dellinger, owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Mobile Home Park District (MH) on the following described property, to wit: Being Lot 37, Somersetshire Estates, a subdivision in Brazoria Co., according to the map or plat thereof in Vol. 16, pg. 283 of the plat records of Brazoria Co., Texas (3307 Excaliburs Ct.) The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Russell Dellinger, owner, explained that he was not aware that he needed to rezone his property until he applied for a storage building permit. He added that he had purchased this property just prior to annexation. Pam Lilly, 3211 King Arthur's Ct. , explained that the zoning should be MH because many people can not afford to build homes on these lots. She stated that she would like to add on to her trailer, however, she can't get a permit until the zoning is changed. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the number of mobile homes in the area. Director of Planning & Community Development Dennis Smith stated that most of the lots have mobile homes on them. He also stated that he and Interim City Attorney Darrin Coker are working on a mobile home subdivision ordinance. VI. ADJOURNMENT The meeting adjourned at 6:44 PM. APPLICATION NO. 298 I. CALL TO ORDER The meeting was called to order at 6:44 PM. II. PURPOSE OF HEARING - APPLICATION NO. 298 Request of John R. Massey, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-4) to General Business District (GB) on the following described property, to wit: Being 5.10 acre tract out of 37.948 acre tract known as A-240 of the H.T. & B. R.R. Co. Survey according to the deed or records of Brazoria Co., Texas The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. F� 209 III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Charlie Eason of Hardcastle Real Estate, 2405 S. Grand, Pearland, Texas, spoke in favor of this application. He stated that he is representing Mr. Massey in the purchase of this property. Renee West of R. West Development, 2510 Westminster, Pearland, Texas, spoke for this variance. She stated that she thinks this development would be good for the area. Donna Spriggins, 3915 Beechwood, Pearland, Texas, 77584, stated that this project will create a beautiful site for a not -so -pretty area. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the size and location of this proposed project. Mr. Eason presented a proposed plot plan. VI. ADJOURNMENT The meeting adjourned at 6:52 PM. APPLICATION NO. 317 I. CALL TO ORDER The meeting was called to order at 6:52 PM. II. PURPOSE OF HEARING - APPLICATION NO. 317 Request of James W. Gustafson, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to General Business District (GB) on the following described property, to wit: Part of Lot 2, Block 10, Allison richey Gulf Coast Home Co. Subdivision, according to the plat records of Brazoria Co., Texas The purpose of the public hearing was read into the record by Chairman Mary Stan. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. 3 12-10 III PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Ruby Wright, represented Mr. Gustafson, stating that they are proposing to build a hydrophonic plant. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding any special utility requirements for this type of facility. Projects Coordinator Alan Mueller stated that this project will probably use a well and septic. VI. ADJOURNMENT The meeting adjourned at 6:57 PM. APPLICATIONS NO. 301, 305, 306 AND 308 I. CALL TO ORDER The meeting to consider a series of zone changes to R-1 was called to order at 6:57 PM. II. PURPOSE OF HEARING - APPLICATIONS NO. 301, 305, 306 and 308 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development District (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: 1. Application No. 301 Being 1.451 acre tract out of the S. 'h of Lot 8 of the Allison Richey Gulf Coast Home survey, Suburban Gardens subdivision, according to the deed records of Brazoria Co., Texas (1207 Sterling Drive) Owners, Stephen B. & Elaine Welcome, 1207 Sterling Drive, Pearland, TX 77581 2. Application No. 305 Being both halves of Lot 37 & 3.30 acre out of the Allison Richey Gulf Coast Home survey, Vol. 885, pg. 288, of the Deed Records of Brazoria Co, TX (2726 Morris Rd.) 4 - Z 11 r!x, Owners, George D. & Mary Fishman, 9917 Sumerlin, Houston, TX 77075 3. Application No. 306 Being 1.00 acres out of the H. C. Johnston 99 acre tract, Section 7, H. T. & B. R.R. Co. Survey, A-219, according to the deed records of Brazoria Co., TX, Vol. 864, pg. 8 (6316 Gardenia) Owners, Ron Cleaver, 6316 Gardenia, Pearland, TX 77584 4. Application No. 308 Lot 6 & the E. 6.00 feet of Lot 5, Block 3, Cas -Con Acres, an addition according to the map recorded in Vol. 5, pg. 137, of the plat records of Brazoria County, TX (6130 Cottonwood) Owner, Virginia A. McKenzie, 6316 Cottonwood, Pearland, TX 77584 The purpose of the public hearing was read into the record by Commissioner Jack Mathis. Director of Planning & Community Development Dennis Smith presented the locations of the proposed zone changes. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST George Fishman spoke in favor of Application No. 305. He stated that he eventually wants to build a home on this property. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST E. J. Lanie, P.O. Box 27578, Houston, Texas, spoke against application No. 305. He stated that he doesn't mind Mr. Fishman building a home on his property, however, he is concerned with how that will affect his property. He explained that he owns Lots 46 & 47 which front Highway 288. He questioned whether this proposed zone change would prevent the surrounding properties from being used for commercial or general business purposes. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Director of Planning & Community Development Dennis Smith addressed Mr. Lanie's question. He stated that one lot being zoned R-1 would not mean that the surrounding properties would have to be zoned R-1. A discussion ensued regarding the property in this area that fronts Highway 288. 5 212, VI. ,, "ADJOURNMENT The meeting adjourned at 7:12 PM. The Joint Public Hearing adjourned at 7:14 PM.
