1998-06-29 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAN% TEXAS, HELD ON JUNE 29, 1998, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. APPLICATION NO. 304 I. CALL TO ORDER The meeting was called to order at 6:30 p.m. II. PURPOSE OF HEARING - APPLICATION NO. 304 Request of Merea Sandoval, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Multi -Family Dwelling District (MF) on the following described property, to wit: A 0.2138 acre tract out of the W. 1/2 of the N.W. 1/4 of the N.E. 1/4 of section 15, H.T. & B. R.R. Co. survey, A-241, Brazoria Co., Texas The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. M. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Joseph Murphy, 308 Brandywine, Friendswood, Texas 77546, spoke in favor of the application. He is the proposed buyer of the property. He explained that there is an existing home and two apartments. He stated that they intend to rent out the house in front and possibly the apartments. 1195 IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Ruben Martinez, 2823 Morenci Drive, Pearland, Texas 77584, spoke against the application. He was concerned with three dwelling units on one property and how much traffic these dwellings would cause. Mr. Martinez was also concerned with the property not being maintained. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the size of property and the three existing dwellings. The existing utilities and the amount of parking were also discussed. VI. ADJOURNMENT The meeting adjourned at 6:48 PM. APPLICATION NO. 276 I. CALL TO ORDER The meeting was called to order at 6:48 PM. II. PURPOSE OF HEARING - APPLICATION NO. 303 Request of Elizabeth Nisbet, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-2) to Single Family -Planned Unit Development (R-4 PUD) on the following described property, to wit: Being 76.79 acres, part of lots 16, 17, 18 & 25 of the Murdock subdivision of the A.C.H. & B. survey, section 2, A-507, according to the plat, Vol. 29, pg. 174 & part of the Stevens survey, A-594, in Vol. 1597, pg. 135, Brazoria Co., Texas The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. Renee West, of R. West Development, 2510 Westminster, Pearland, Texas 77581, spoke about this proposed project as a part of staff support. She explained that this is a difficult site to develop. She is proposing a five acre lake, single family dwellings and duplexes. Ms. West also explained that the surrounding property zones were a concern in this development. N III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST A. G. Crouch represented the property owner, Elizabeth Nisbet. He explained that this project would upgrade the area. He also stated that the developer would install a forced main that might alleviate existing problems in Shadycrest. He added that this project would hopefully alleviate the need for more apartments in Pearland. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST A letter of protest was submitted with fourteen signatures of Shadycrest residents. Pattie Boyles, 4016 Shadycrest, Pearland, Texas 77581, spoke against this application. She stated that her home is located approximately 230' from this proposed zone change. She was concerned with the proposed duplexes being used as rental units. Mrs. Boyles submitted a letter opposing this application. Alfonse Braska, 2107 Sprite Lane, Pearland, Texas 77581, was concerned with the two car garages not being sufficient off-street parking. He presented a letter opposing this application. Adolph Hruzek, 3905 Longherridge, Pearland, Texas 77581, stated that he has lived in Shadycrest for thirty-five years. He added that Shadycrest is a nice neighborhood. Richard Szapski, 2107 Mary's Creek West, Pearland, Texas 77581, expressed concern that this proposed project might effect the value of their property. He presented a letter of opposition to this zone change. Leanne Strickling, 2106 Sprite Lane, Pearland, Texas 77581, was concerned about this dense dwelling project reducing the value of their homes. She also expressed concern regarding drainage and the need for additional volunteer fire and EMS. Ron Strickling, 2106 Sprite Lane, Pearland, Texas 77581, expressed his opposition to this application. Samuel Sahagian, 2104 Sprite Lane, Pearland, Texas 77581, explained that he has just purchased this home, but hasn't move in yet. He added that he probably would not have purchased this home had he known about this proposed project. Jimmy Walker, 4010 Shadycrest, Pearland, Texas 77581, stated that he purchased his home in 1992 because the property behind the house was wooded. Ronnie Richards, 4015 Longherridge, Pearland, Texas 77581, explained that he and his neighbors feel that this project will have no positive impact. Jim Bost, 2102 Shadybend, Pearland, Texas 77581, stated that he sees no good reason to change the zoning of this property. � ii16 Anthony Lafaso, 4013 Longherridge, Pearland, Texas 77581, stated that taxes that Shadycrest residents have paid over the years have helped the development of Shadycrest and other areas. He also stated that duplexes are starter homes. Lawrence Goodman, 2004 Deepbrook, Pearland, Texas 77581, explained that he has only lived here for two years and would like to retire here. Ruby Keller, 2103 W. Mary's Creek, Pearland, Texas, 77581, explained that Shadycrest has been a very nice place to live due to the privacy of the area. Ken Nicoll, 3908 Shadycrest, Pearland, Texas 77581, stated that he moved from Houston to live on a large lot in a quiet place. He added that he is not against development, but does not feel that this zone change is appropriate. Julie Sudela, 2108 Sprite Lane, Pearland, Texas 77581, stated that he purchased his home approximately fifteen years ago because the area was so peaceful. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the location of the future extension of Pearland Parkway and the affect of R-4 zoning next to R-2 zoning. VI. ADJOURNMENT The meeting adjourned at 7:24 PM. APPLICATION NO. 287 I. CALL TO ORDER The meeting was called to order at 7:24 PM. 11. PURPOSE OF HEARING - APPLICATION NO. 287 Request of Mrs. John E. Wooten, owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Mobile Home District (MH) on the following described property, to wit: Being the W. 1h of the S. '/i of Tract 27, Allison -Richey Gulf Coast home subdivision, H.T. & B.R.R. Co. survey, A-304, Vol. 2, pg. 107, Plat records of Brazoria Co., TX (2007 Wooten Rd.) The purpose of the public hearing was read into the record by Chairman Mary Starr. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Shirley Jernagen, 2007 Wooten Rd., Pearland, Texas 77584, spoke for her mother, Winefred Wooten. She stated that her mother has had this trailer park approximately twenty-eight years. She does not want to see her mothers livelihood taken away. Winifred Wooten, 2007 Wooten Rd., Pearland, Texas 77584??, questioned whether the City will be providing utilities to this area. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Director of Planning & Community Development Dennis Smith stated that he received a letter of opposition from Moritz V. Craven, 3212 Ewing Street, Houston. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the lot sizes and how many mobile homes are existing. Director of Planning & Community Development Dennis Smith explained that the zone change would not impact the existing business that Mrs. Wooten lAs. However, she would have to have the appropriate zoning to add to the mobile home park. VI. ADJOURNMENT The meeting adjourned at 7:31 PM. APPLICATION NO. 309 I. CALL TO ORDER The meeting was called to order at 7:32 PM. II. PURPOSE OF HEARING - APPLICATION NO. 309 Request of Leroy & Betty Jeffries, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification General Business (GB) to Commercial District (C) on the following described property, to wit: 1.90516 acres out of Lots 20 & 21, Geo. W. Jenkins subdivision in the W.D.C. Hall League, A-70, according to the plat in Vol. 16, pg. 145, Brazoria Co., TX (1700 Broadway) The purpose of the public hearing was read into the record by Chairman Mary Starr. 5 19.9 1.4i Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Cecil Lott, 11626 Orchard Drive, Houston, stated that he and his wife are the proposed buyers of this property. He explained that they are proposing a 55,000 sq ft climate controlled storage facility to serve the East side of Pearland. He presented photographs of the property and surrounding properties. Mary Kole of Remax, 11717 Highland Meadow, Houston, Texas 77089, stated that most surrounding property is zoned Commercial. She feels that these storage units will be an asset to the area. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST J.R. May, 1705 E. Broadway, Pearland, Texas 77581, stated that he has lived on the property next to this for over fifty years. He added that he is not sure if he is for or against this proposed development but he would like to know more about it. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION The location of this proposed project was discussed. VI. ADJOURNMENT The meeting adjourned at 7:44 PM. APPLICATION NO. SPU 62 I. CALL TO ORDER The meeting was called to order at 7:44 PM. H. PURPOSE OF HEARING - APPLICATION NO. SPU 62 Request of George W. & Deborah Harrell, owners, for an amendment to the Land Use and Urban Development Ordinance of said City from Suburban Development District (SD) to Single Family Dwelling District -Specific Use Permit (R-1 S) on the following described property, to wit: The W 1/2 of Lot 12, Johnston subdivision of the NW 1/4 of the NW 1/4 of the H.T.& B.R.R. Co. survey, A-240, containing 4.21 acres, more or less according to the plat, Vol. 5, pg. 303 & Deed Records, Vol. 1090, pg. 865, Brazoria Co., Texas (14833 Harkey Rd.) III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Debbie Harrell, 3304 Bishopton, Pearland, Texas 77581, explained that they had purchased this property before annexation. She stated that she has owned and operated Ms. Debbie's Homegrown Kids for six years. She added that she will continue the existing daycare at this new location. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Director of Planning & Community Development Dennis Smith stated that he had received a letter of opposition from R.H. Spear, 6118 Josephine, Pearland, Texas 77584. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the house existing on the property. Director of Planning & Community Development Dennis Smith stated that the Specific Use allows a daycare only. He added that if the daycare were to go out of business only another daycare would be allowed or it would remain single family dwelling. VI. ADJOURNMENT The meeting adjourned at 7:51 PM. APPLICATION NO. 283 Willie Gonzales, 6521 Springer St., Houston, Texas, explained that the house and the business will be built on this lot. The business will face O'Day Road. 3. APPLICATION NO. 277 Robert Bratz, 5518 Mockingbird Lane, Pearland, Texas 77584, stated that he is applying for rezone to the he would be able to rebuild his home if he needed to. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST None. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Director of Planning & Community Development Dennis Smith explained that if Mr. Gonzales would attend the Planning & Zoning meeting immediately after this Joint Public Hearing, the will try to clear things up.
