APPROVAL OF MINUTES Councilmember Tetens made the motion, seconded by Mayor Pro -Tem Wilkins, to approve the Minutes of the June 3, 1998, Special Meeting held at 7:00 p.m., and the Minutes of the June 8, 1998, Regular Council Meeting held at 7:30 p.m. Voting "Aye" Councilmembers Beckman, Tetens, Wilkins, Berger, and Seeger. Page 1 of 17 - 6/22 177 178 MAYOR'S ACTIVITY REPORT: Mayor Reid reported that on June 10 he attended the Adult Reading Board of Directors Meeting and the PEDC Reception; June 12 he attended Chamber Breakfast and the Police Promotion Ceremony; June 15 he attended PEDC Board of Directors Meeting; June 16 he attended HGAC Board of Directors Meeting, Trees for Pearland Meeting and the Library Board Meeting; June 17 he attended the Chamber Luncheon and the Pearland Update to Country Place Homeowners Association; June 19 he attended the Chamber Board Meeting; June 20 he attended the City Picnic; June 22 he attended the Effective Leadership "EPL" Graduation and the Special PEDC Meeting. COUNCIL'S ACTIVITY REPORTS: Councilmember Beckman reported that she attended the outdoor concert on Tuesday, and it was really neat. It's very casual and pleasant. She thanked the Parks and Recreation Department for hosting these events. Councilmember Beckman further reported on "Trees for Pearland" and said it is a great opportunity to donate a tree. She further reported that she attended the Brazoria County Cities Association Meeting which was held at the newly renovated Brazoria County Airport. Councilmember Tetens reported that the restaurant in the Brazoria County Airport is very good. Mayor Pro -tem Wilkins commended the Parks Department for the outdoor concerts and stated that they are very nice. He further reported that the Pearland Lions Club is celebrating their 501h anniversary. Councilmember Berger announced that the Pearland VFW Post passed out their Outstanding Community Service Awards as follows: Emergency Medical Services -Keith Bonner, Fire Department -Sam Granberry, Police Department -Kevin Nichols, and the Volunteer of the Year Award was awarded to Parks and Recreation Director -Ed Hersh. Councilmember Seeger passed on his report. CITY MANAGER'S REPORT: City Manager Paul Grohman reported that contractors are working on Pearland's first overpass north of WalMart. Mr. Grohman asked everyone to watch their consumption of water during this dry period. He also announced that Kemlon is all most ready to open. Page 2 of 17 - 6/22 CITIZEN'S: IT9 li Tom Ingebredben, 2802 Green Tee, addressed Council regarding the conflict of interest in regards to the City Manager. Mr. Ingebredben stated that Mr. Grohman's wife is a realtor for a commercial property company. He further stated that the company used to be primarily residential, but now he is seeing their signs on more commercial property and has concerns regarding the City Manager's wife selling commercial property where the City may be involved. Larry Marcott, 3606 Inverness Ct., addressed Council regarding the water pressure in Rustic Oaks. He stated that he tried to water his lawn with a wand and did not have enough water pressure. He further expressed concerns regarding the water pressure for fire fighting. However, he said he had talked to someone with the fire department and that it is not a problem. Mr. Marcott stated that he would like to see the water pressure checked. Thomas Kidd, Sterling Drive, addressed Council regarding the annexation that occurred in February of this year. Mr. Kidd stated that the City of Pearland does not have a legitimate reason for in the J.W. Maxey Survey, Abstract 721 inside the city limits. He asked the Council to start deannexation procedures immediately of the J.W. Maxey Survey, Abstract 721. Mayor Reid formally recessed the Regular Council Meeting. Mayor Reid formally opened the Docketed Public Hearing. DOCKETED PUBLIC HEARING: ABANDONMENT OF UNUSED UTILITY EASEMENT CALL TO ORDER PURPOSE OF THE HEARING - ABANDONMENT OF UNUSED UTILITY EASEMENT. LEGAL DESCRIPTION Abandonment of a certain ten foot (10) wide utility easement running along the west line of Lot 6, Block 14, and running along the east line of Lot 7, Block 14, of Mimosa Acres, a subdivision of 52.552 acres out of Section 4, H.T. & B.R.R. Survey, Abstract 543, Brazoria County, Texas, according to plat recorded in Volume 7, page 15 & 16, Plat Records, Brazoria County, Texas (2506 Francis) Page 3 of 17 - 6/22 STAFFS REVIEW OF ABANDONMENT OF UNUSED UTILITY EASEMENT. Interim City Attorney Darrin Coker addressed Council and stated that Kent Sullivan requested the abandonment of the utility easement approximately ten years ago. However, the proper documentation was not done. Mr. Sullivan wants to enlarge his present building and the utility easement runs across the property and is not being used. Mr. Coker further stated that the procedures in the ordinance have been complied with. The City has received all but one of the utility easements, and TCI Cable has stated that it is forth coming. Once all of the utility easements have been received, the City will release the easement. City Manager Paul Grohman stated that the utilities are located elsewhere on the property. CITIZEN COMMENTS None. COUNCIL/STAFF DISCUSSION There was no further discussion. ADJOURNMENT OF DOCKETED PUBLIC HEARING Docketed Public Hearing was adjourned at 8:25 p.m. Council returned to its Regular Meeting at 8:25 p.m. UNFINISHED BUSINESS: NONE NEW BUSINESS: COUNCIL ACTION - RESOLUTION NO. R98-46 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING THE ANNEXATION BY BRAZORIA COUNTY MUNICIPAL UTILITY DISTRICT NO.6 OF A 6.4223 ACRE TRACT LOCATED AT FM 518 APPROXIMATELY 1,000 FEET EAST OF COUNTY ROAD 94. Councilmember Beckman made the motion, seconded by Councilmember Tetens to approve Resolution No. R98-46. Page 4 of 17 - 6/22 City Manager Paul Grohman stated that this is one of Silverlake's three Municipal Utility Districts. They will have a quality project on this property and he recommended its approval. Voting "Aye" Councilmembers Beckman, Tetens, Wilkins, Berger, and Seeger. Voting "No" None. Motion Passed 5 to 0. COUNCIL ACTION - RESOLUTION NO. R98-43 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO NEGOTIATE WITH WASTE MANAGEMENT OF SOUTHEAST TEXAS, INC., FOR THE SEPARATE COLLECTION OF YARD TRIMMINGS FOR COMPOSTING AS PART OF ITS RESIDENTIAL CURBSIDE SERVICE WITHIN THE CORPORATE LIMITS OF THE CITY. Councilmember Tetens made the motion, seconded by Councilmember Beckman to approve Resolution No. R98-43. Keep Pearland Beautiful Executive Director Delores Fenwick addressed Council and stated that the City has applied for a grant for a pilot program. She stated that Waste Management needs a commitment from the three cities to see if it is feasible to participate and if it will be economically possible. If we get the grant, it will pay for the pilot program. In that case we will put this action off for a while. Mayor Reid stated that if other cities do not participate we will not be bound by this resolution. City Manager Paul Grohman said that formal action is needed to move forward. Mayor Pro -Tem Wilkins made the motion, seconded by Councilmember Berger, to approve Ordinance No. 814-2 on its first and only reading. City Manager Paul Grohman stated that traditionally we have only amended the budget annually. However, we are now trying to amend the budget quarterly. He further stated that this budget amendment is revenue neutral. Voting "Aye" Councilmembers Beckman, Tetens, Wilkins, Berger, and Seeger. Voting "No" None. Motion Passed 5 to 0. FIRST READING OF ORDINANCE NO. 450-23 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 450 AS THE SAME MAY HAVE BEEN, FROM TIME TO TIME, AMENDED, FOR THE PURPOSE OF ESTABLISHING AND REESTABLISHING CLASSIFICATIONS AND NUMBER OF AUTHORIZED POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF PEARLAND, PURSUANT TO SECTION 143.021 OF THE LOCAL GOVERNMENT CODE OF THE STATE OF TEXAS; PROVIDING A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A REPEALER CLAUSE, AN EFFECTIVE DATE AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. Councilmember Berger made the motion, seconded by Mayor Pro -Tem Wilkins, to approve Ordinance No. 450-23 on its first reading. Police Chief Mike Hogg addressed Council and stated that this is updating two specific positions from 46 to 48 under Chapter 143. One of the new positions is for an officer to serve on the Brazoria Narcotics task Force which will be funded by a grant, and the second position is for a second School Resource Officer to staff the 9th and 101h grade at the High School. The high school campus has recently been enlarged and renovated. The school district pays one hundred percent of the officers salary for nine months. COUNCIL ACTION - RESOLUTION NO. 98-45 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT AN APPLICATION TO THE U. S. DEPARTMENT OF COMMERCE ECONOMIC DEVELOPMENT ADMINISTRATION FORA PUBLIC WORKS AND ECONOMIC DEVELOPMENT FACILITIES GRANT; AND AUTHORIZING HIM TO EXECUTE ANY AGREEMENTS NECESSARY TO RECEIVE SAID GRANT OF $1,500,000.00; AND ALLOCATING MATCHING FUNDS OF $1,538,400.00 FROM THE CITY OF PEARLAND AS REQUIRED. Councilmember Seeger made the motion, seconded by Councilmember Berger to approve Resolution No. R98-45. City Manager Paul Grohman stated that he is really proud and staff deserves a lot of credit for their work on this grant. The grant does require matching funds. This would be for a water line for raw water from west of highway 288 back to town. This would relieve the usage of ground water and help the subsidence. This would be a totally looped system. There was discussion regarding the increasing of water and sewer fees. Mr. Grohman stated that we have to get off of ground water and use more surface water. He further stated that there is approximately a five percent increase budgeted over the next few years to prevent from having "rate shock." Impact fees will pay for the majority of funding, and every three years we review the impact fees. City Manager Grohman said that we may be asked to pledge certificates of obligation against some of the debt. He further stated that we should let the growth pay for itself. COUNCIL ACTION - RESOLUTION NO. 98-44 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT AN APPLICATION TO THE TEXAS FOREST SERVICE FOR AN URBAN FORESTRY PUBLIC OUTREACH GRANT AND EXECUTE ANY AGREEMENTS NECESSARY TO RECEIVE SAID GRANT; AND ALLOCATING Page 7 of 17 - 6/22 } MATCHING FUNDS FROM THE CITY OF PEARLAND AS REQUIRED Councilmember Beckman made the motion, seconded by Councilmember Tetens, to approve Resolution No. R98-44. Grants Coordinator Chris Kidwell addressed Council regarding trees and urban forestry and gave an overview of what the City has done regarding tree preservation. He stated that since April the City has employed an Urban Forester to implement a Challenge Grant from the Texas Forest Service. He further stated that this grant is for $15,000 and the city would need matching funds of approximately $25,000. Mr. Kidwell said that he has met with Planning and Development Director Dennis Smith to fund that out of the planning and development budget. He further stated it is a great program, and he would like to continue the success and recommend its approval. City Manager Paul Grohman stated that this is a continuing project. FIRST AND ONLY READING OF ORDINANCE NO. 849 -AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING A SPEED LIMIT OF 45 MILES PER HOUR DURING CONSTRUCTION ALONG STATE HIGHWAY 35 (MAIN STREET) FROM FM 518 (BROADWAY) TO THE SOUTH CITY LIMIT; PROVIDING A - PENALTY FOR VIOLATION; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND A REPEALER CLAUSE; PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY BECAUSE THE NEED TO ESTABLISH TEMPORARY SPEED LIMITS DURING CONSTRUCTION IN THIS AREA INURES TO THE BENEFIT OF THE TRAVELLING PUBLIC AND, THEREFORE, BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE CITIZENRY. Councilmember Tetens made the motion, seconded by Mayor Pro -Tem Wilkins, to approve Ordinance No. 849 on its first and only reading. Police Chief Mike Hogg addressed Council and stated that this is a request from Texas Department of Transportation in a construction zone. Chief Hogg further stated that due to a new state law, speeding in a construction zone will automatically double the fine. Voting "Aye" Councilmembers Beckman, Tetens, Wilkins, Berger, and Seeger.
