1998-06-22 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE 17 0 PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JUNE 22, 1998, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. APPLICATION NO. 300 I. CALL TO ORDER The meeting was called to order at 6:30 p.m. II. PURPOSE OF HEARING - APPLICATION NO. 300 Request of Roy L. & Beatriz V. Smith, agents for owner Claude M. Norman, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Mobile Home Dwelling District (MH) on the following described property, to wit: Lot 71 of the Somersetshire Estates subdivision, being approximately 14,985 square feet. (3407 Camelot Court) The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Beatrice Smith, 3407 Camelot Court, Pearland, Texas 77584, spoke in favor of the application. She stated that there are mobile homes all in the area. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding zoning of an individual lot MH allows that property owner to place more than one mobile home on the lot. Also discussed was the size of the lots and the number of existing mobile homes in the area. VI. ADJOURNMENT APPLICATION NO. 276 I. CALL TO ORDER II. PURPOSE OF HEARING - APPLICATION NO. 276 Request of Willie Hodge, Jr., owner, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Single Family Dwelling District (R-2) to Multi -Family District (MF) on the following described property, to wit: A 0.424 acre tract known as Lot 19 of an unrecorded subdivision of Tract 18, Allison -Richey Gulf Coast Home Co. Subdivision, A-544, Brazoria Co., TX (6103 Dee Street) Councilmember Richard Tetens entered the meeting at 6:52 PM. The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST None. IV. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued regarding the zoning of the surrounding properties and the proposed use of this property. VI. ADJOURNMENT 2 APPLICATION NO. 247 I. CALL TO ORDER 9712 II. PURPOSE OF HEARING - APPLICATION NO. 247 Request of R. West Development, agent for Frank D. Barringer, Trustee, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Commercial District (C) on the following described property, to wit: A 1.6142 acre tract located in the H.T.& B.R.R. Co. survey A- 241, same being out of 39.2484 acres conveyed in 96-015983 of the Official Records, Brazoria Co. , TX (6516 Broadway) The purpose of the public hearing was read into the record by Chairman Mary Starr. ADJOURNMENT APPLICATION NO. 259 I. CALL TO ORDER II. PURPOSE OF HEARING - APPLICATION NO. 259 Request of James A. Hubbell, Jr., agent for James A. Hubbell et al, for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single Family Dwelling District (R- 3) on the following described property, to wit: M 1173 Tract one being a parcel continuing 72.809 ac. and being the N. '/z of the N.E. 1/4, section 16, H.T.&B.R.R. Co. Survey, A-546, deed records of Brazoria Co., TX, and Tract two being 40 ac., more or less, and being lot 6 and being the S.W. 1/4, section 16, H.T.&B.R.R. Co. Survey, A-546, Brazoria Co., TX and Tract three being 20 ac., more or less, and the south '/a of the S.E. 1/4 of the N. E. 1/4, section 16, H. T. & B.R.R. Co. Survey, A-546, Brazoria Co., TX, and Tract four being 6.00 ac., more or less, and being the S.E. 1/4 of the S.E. 1/4 of the H.T.&B.R.R. Co. Survey 15, A-241, of the deed of records, Brazoria Co., TX (15702 Harkey Road) The purpose of the public hearing was read into the record by Commissioner Jack Mathis. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST James Hubbell, 818 Twinbrook, Houston stated that the surrounding tracts are residential. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Michael Robb, 6401 Terrell Drive, questioned whether this site had City approval. He stated that bulldozers are clearing the land. He added that he would like the property to remain SD because he moved to the country to get away. He also stated that his wife is concerned with the animals that may approach their home as the land is cleared. Terry Jacobs, 5903 Terrell Drive, had the same concerns as Mr. Robb. He stated that he is also concerned that new development might cause flooding. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mayor Tom Reid stated that the property in Pearland can not be developed without meeting very strict flood plain requirements. A discussion ensued regarding the zoning of the surrounding properties and the fact that R-3 would introduce small lots into a large lot area. VI. ADJOURNMENT 4 APPLICATION NO. 307 I. CALL TO ORDER II. PURPOSE OF HEARING - APPLICATION NO. 307 Request of Dwain Evans, agent for owners Fylma W. Thompson, Elliott Cage, and Catherine Cage Burns, for an amendment to the Land Use and Urban Development Ordinance of said City from Commercial District (C) to Single Family Dwelling District (R-3) on the following described property, to wit: Approximately 60 ac. out of section 12, H.T.& B.R.R. Co. Survey, A- 508, according to deed records, Brazoria Co., TX The purpose of the public hearing was read into the record by Chairman Mary Starr. Director of Planning & Community Development Dennis Smith presented the location of the proposed zone change. III. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Dwain Evans explained to the Board that he will also be the developer on this project if the zone change is approved. He stated that they are proposing a minor subdivision of Cobblestone. IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Catherine Cox, 3607 Teal Glen, stated that she would rather see this property zoned residential than commercial. Jack McGuff of McGuff & Associates Architects stated that he represents the property owners due East of this tract. He added that their property is zoned Industrial. He explained that they object to this property being zoned residential because of the potential complaints about noise and truck traffic. Mr. McGuff added that this commercial property was designed to act as a buffer between residential and industrial. Tom Inglebretson, 2802 Green Tee Drive, stated that he feels it is very important for this property to remain commercial for future businesses near the railroad tracks. He added that there is plenty of property for home development. He also stated that he is against changing any commercial property to residential because of the tax base created by commercial property. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION A discussion ensued about a subdivision being developed near an industrial district. VI. ADJOURNMENT E APPLIC :TION NO. 268 4 I. CALL TO ORDER II. PURPOSE OF HEARING - APPLICATIONS NO. 268, 278 & 285 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from Classification Suburban Development (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: 1. Application 268: John Hernandez, agent Guero Family Ltd. Partnership Lot 4, Block 1, Cas -Con Acres subdivision, out of tract B, Vol. 5, pg. 137, deed records of Brazoria Co., TX (6123 Willow) 2. Application 278: Randy L. & Mylinda Faircloth 4.8517 ac., a part of Lot 26, Allison Richey Gulf Coast Home Co. Subdivision, Vol. 2, pg. 23 & Vol. 971, pg. 21 deed records of Brazoria Co., TX (13530 O'Day Road) 3. Application 285: Pierre and Anna Nys The west '/2 of the west 1/2 of the N.E. 1/4, sec 14 H.T.&B.R.R. Co. Survey, A-509 (Parkplace Subdivision) The purpose of the public hearing was read into the record by Commissioner Jack Mathis. Director of Planning & Community Development Dennis Smith presented the locations of the proposed zone changes. II. PERSONS WISHING TO SPEAK FOR THE PROPOSED REQUEST Application 268: None Application 278: Randy Faircloth, 13530 O'Day Road, stated that he purchased five acres so that he could have horses and cattle on the same property as his home. Mylinda Faircloth, 13530 O'Day Road, explained that she and her husband were raised in the country and want to raise their daughter the same way. Betty Jordan, 3302 Churchill, spoke for her daughter who lives at 13256 O'Day Road. She stated that she supports the people being able to continue the use of the property as they purchased it. 6 Application 285: None 116 I IV. PERSONS WISHING TO SPEAK AGAINST THE PROPOSED REQUEST Application 268: Wanda Cruz, 6129 Willow, stated that there are already two existing homes on this property. She is not sure how it is possible to add another home on the same lot. She added that she is afraid that the two existing homes will become rent houses. Application 278: None Application 285: Vincent Campo, 6615 Confederate, explained that he owns a five acre tract of land at the corner of this property. He stated that he would like to remain in the country. He added that his main concern is that this will be a mobile home park. V. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION None. VI.
