A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING A CONTRACT FOR ENGINEERING SERVICES
ASSOCIATED SEGMENT 1 of the JOHN L1ZERI MAGNOLIA ROAD
PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain amended contract for engineering services associated
with Segment 1 of the John Lizer/ Magnolia Road Project, a copy of which is attached
hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and
approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest an amended contract for engineering services associated
with Segment 1 of the John Lizer/ Magnolia Road Project.

This Amendment (hereinafter "Amendment") is made between the City of
Pearland, Texas (hereinafter "City"), and Kirst Kosmoski, Inc. (hereinafter "Consultant")
to amend that consultant services contract (the "Contract") between the City and the
Consultant executed on February 28, 2005 (Resolution 2005-44) for additional design
engineering services to complete additional scope of work required by the John Lizerl
Old Alvin intersection and drainage modifications, John Lizer Rd. drainage, outfall and
geometries modifications, and additional street light and sidewalk design. Project
Number T70041; PO Number 051552.
1. Amended Terms. The City and the Consultant hereby agree that the Contract is
amended as follows:
A. Increase Maximum Contract Amount From $193,254.00 to $223,254.00; an
increase of $30,000.00.
B. See Attachment for additional services.
2. Contract to Remain in Force. Other than the provisions of the Contract expressly
amended herein, the Contract shall remain in full force and its enforceability shall be
unaffected by this Amendment.

STANDARD AMENDMENT TO
ENGINEERING SERVICES AGREEMENT

Request for Contract Supplement to Address Changes in Scope
Gentlemen,
Kirst Kosmoski,Inc. (KKI)is pleased to present this supplemental proposal for providing Professional
Engineering Services to the City of Pearland(City)for the referenced project. KKI proposes to provide
engineering design services for the preparation of additional construction drawings and/or modification of
existing designs and drawings due to substantive changes in project requirements as follows:
1. Old Alvin Rd.:
a. Evaluation of drainage requirements along Old Alvin through the Alexander tract,
b. Coordination with Pearland Independent School District's traffic engineer and incorporation of
forthcoming Traffic Impact Analysis(TIA)results,
c. Preparation of Plan&Profile drawing(s)for approximately 600-ft of Old Alvin north of Lizer,
and
d. Revisions to project and drainage area layouts,
2. John Lizer Rd.:
a. Re-evaluation/re-design of Lizer drainage and geometries(horizontal&vertical)from SH 35 to
the outfall at the Independence pond in light of items 1.a. &b. above,
b. Associated revisions to project and drainage area layouts,plan&profiles,and outfall detail
drawings,and
c. Update existing topographic and Right-of-Way(ROW)information based on forthcoming
survey from C.L.Davis&Company,
3. Street Lighting:
a. Preparation of modified overall project layout highlighting the proposed ROW for use by
CenterPoint Energy,
b. Coordination as required with CenterPoint Energy,
c. Addition of street lights to John Lizer plan&profile drawings at locations specified by
CenterPoint Energy,and
d. Addition of one power conduit to John Lizer plan&profile drawings(one conduit,and
incorporation of connection details provided for under original agreement as traffic signal
conduit),
4. Wheelchair Ramps&Sidewalks:
a. Revise/modify ROW and or easement limits to accommodate revisions to existing wheelchair
ramp configurations as directed the City,and
b. Revise/modify R-0 W and or easement limits to accommodate completion of sidewalks on both
sides of John Lizer from SH 35 to Pearland Parkway as directed the City.
