1964-10-01 CITY COUNCIL REGULAR MEETING MINUTESA regular meeting of the Pearland CityCouncilwas held on Thursday
October 10 1964, at the City Hall, 14429 Texas Avenue, with the
following city official and.guests present.
Aldermen Gene E. Sanders, Victor A. Nolen, Thomas P. .Alexander
nd Steven A.-Shukanes. City Secretary W A. McClellan(- and
gity Attorney Jack Harrison. Mayor Kegley - absent.
Guests: Van Boone, F. H. McEly, Robbie Robertson and John Rainey.
Motion made by Shukanes and seconded by Alexander that minutes of
previous meeting be approved, except to -void Check No. 1392, which
was cancelled. All Aldermen voted "aye" with no "noes". Motion
carried.
Motion made by Shukanes and seconded by Alexander that the following
invoices and salaries be paid. All Aldermen voted "aye" with
no "noes.." Motion carried., i 1F
Shukanes reported that Taylor road in McGinnis Subdivision had-
nbeen'shelled according to instructions.

Office manager instructed to have the overhanging tree limbs at
Houston and Plum Street trimmed.
Sanders reported he had received changes in Subdivision Ordinance
from the office and would make a complete report at the next
meeting.
City Attorney Jack Harrison stated that a special election may
have to be held to fill the vacancy created by the election of
Water and Sewer

City Attorney Jack Harrison stated that a special election may

Alderman Kegley as Mayor. He will let the Council know at a
later meeting.
Motion made by Shukanes and seconded by Alexander that City grant
a Junk Yard -Permit totMerle H, Dodd dba Airport•Parts Company and
to allow him 90 days in which to comply with the remaining terms
and conditions of the ordinance. All Aldermen voted "aye" with
no "noes". Motion carried.
Mr. Alexander of the Houston Natural Gas Company presented City
Council with a complete block book of the City of Pearland showing
locEtion of their lines. Nolen requested a letter of appreciation
be written to the company. City Attorney Harrison stated he would
do so.
Motion made by Alexander and seconded by Nolen that City renew
the insurance policy that covers auxiliary police for one year.
All Aldermen voted "aye" with no "noes". Motion carried.
The complaint turned in by Mrs. Burnet who lives in Westminister
Subdivision was handled by a committee that called on her and
discussed the problem. She was told that the City would do every-
thing in their power to remedy the situation as soon as possible.
Mayer Pro -Tem Nolen stated that a meeting will be s-cheduled the
first week in _October be-tween the A]exander Estate and the Right -
of -Way Committee,- together -with the City Engirbeer to discuss the sewer
sitiT for Sewer Plant No.- 2 and associated sewer trunk,right-of-
ways . j
Mottc�n made by Nolen and seconded by Alexander that the following
R ersolution be adopted: )
Whereas, the City Council of the City of Pearland, Texas, has
authorized a program of construction of sewerage works at an
estimated cost of $347,800 and the United States Government,
acting through the ?ublic Health Service, has offered ,a Federal,
grant in the amount of $104,340 as designated on Part A, Offer
and Acceptance, now, under consideration by this body.
Now, Therefore, Be It Resolved by the Mayor and City Council
of the City of Pearland, Texas, that s said offer as submitted,
together with the terms and conditions thereof,_is hereby accepted'
and approved; -and that John G. Kegley, Maxtor of the City of Pearland
is -hereby authorized and directed to'sign s` -aid Offer and Acceptance
and any other necessary doduments required to complete the project
on •behalf of said City.

Be It Further Resolved that the City of Pearland has or will
procure a fee simple o'r such other estate of interest in the site
of -the project, including the necessary easements and right -of-
ways, as to assure �u.ndisturbed use and possession for the purposes
of construction, operation -and-maintenance of the works for the
estimated life of theproject; and that in the event such title,
estate, or interest in such site, easements or right-of-way may in
the -future be contested, the City of Pearland will defend and main-
tain its title in such,site and hold the United States Govermmnent
blameless in such action; and that before any Federal payment is
requested pursuant to said grant, said City will provide certifica-
tion as to the sufficiency of such estate or interest.
All Aldermen voted "aye" with no -"noes." Motion carried.
