1994-05-09 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES51 MINUTES OF JOINT PUBLIC HEARINGS OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 9, 1994, AT 7:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The hearings were called to order with the following present: Acting Mayor Pro Tem David Smith Councilmember D. A. Miller Councilmember Benny Frank Councilmember Randy Weber Planning & Zoning Chairman Richard Tetens Planning & Zoning Vice Chairman Emil Beltz Commissioner Helen Beckman Commissioner Pat Lopez Commissioner Jack Womack City Manager Paul Grohman Acting City Attorney Marilyn Mieszkuc City Secretary Pat Jones Others in attendance: Division Directors Richard Burdine and Glen Erwin and City Engineer John Hargrove. Absent from the hearings: Mayor Vic Coppinger, Councilmember Joy Colson, Commissioners Barbara Lenamon and Rob Larsen, and City Attorney Dick Gregg, Jr. i NUMBER OF SIGNATURES ON ATTENDANCE ROSTERS: 0 PURPOSE OF THE HEARING: SPECIFIC USE NO. 32, REQUEST OF ROBERT L. THOMPSON, OWNER, FOR A SPECIFIC USE PERMIT IN A SINGLE FAMILY DWELLING DISTRICT (R- 1) TO ALLOW ANIMAL HUSBANDRY ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: 19.5704 ACRES ( CALLED 20 ACRES) OUT OF LOTS 81 & 82 OF THE GEORGE W. JENKINS SUBDIVISION, W.D.C. HALL SURVEY, ABSTRACT 70, BRAZORIA COUNTY, TEXAS (3500-3600 DIXIE FARM ROAD) SPEAKING FOR THE PROPOSED REQUEST: 1. Robert Thompson, 1116 Nancy. Mr. Thompson stated that he had been looking for land for his personal horses and didn't realize he needed a specific use permit until he tried to erect a barn on the property. Mr. Thompson informed he will build a home and eventually reside there. SPEAKING AGAINST THE PROPOSED REQUEST: ! 1. Oma Hebble, 1807 Meadowcreek. Ms. Hebble stated she owned property across the street and questioned whether this would be a business or for personal use. Ms. Hebble indicated she had no objection to a personal use. Richard Tetens, Chairman of the Planning and Zoning Commission, stated the request is for a specific use permit and could be written with the restriction for personal use. Chairman Tetens introduced his fellow commissioners. 52 QUESTION AND ANSWER PERIOD: The location of the property on Dixie Farm Road was questioned and it was noted that Mary's Creek Bypass halves the property. ADJOURNMENT The hearing adjourned at 7:13 P. M. Chairman Tetens announced the Commission would meet in the second floor conference room to consider this request, as well as the one to follow, immediately after the public hearings. PURPOSE OF THE HEARING: APPLICATION NO. 44, REQUEST OF BILL NOLES, OWNER, FOR AN AMENDMENT TO THE LAND USE ORDINANCE FROM CLASSIFICATION SINGLE - FAMILY DWELLING DISTRICT (R-2) TO COMMERCIAL (C), ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: 20 ACRES, BEING LOTS 24 & 25 OF THE SUBDIVISION OF SECTION 6, H.T. & B.R.R. SURVEY, ABSTRACT 544 (1780 HATFIELD ROAD) SPEAKING FOR THE PROPOSED REQUEST: 1. Bill Noles, 10623 Kirkglen. Mr. Noles explained he has been operating at this location for six years and has a fish farm and restaurant. In order to get a health permit, he was advised he would have to request a change in zoning. SPEAKING AGAINST THE PROPOSED REQUEST: None QUESTION AND ANSWER PERIOD: During discussion, it was determined Mr. Noles wants to expand his business operations to a commercial fish cleaning operation, enabling him to clean and sell fish. When questioned why the zoning request was not for general business, Division Director Richard Burdine replied a commercial zone would best allow Mr. Noles to do all that he wants.
