R2003-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO SUPPLEMENTAL AGREEMENTS WITH KLOTZ ASSOCIATES, FOR ENGINEERING SERVICES ASSOCIATED WITH MCHARD ROAD PROJECT. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain Supplement Agreements by and between the City of Pearland and Klotz Associates, copies of which are attached hereto as Exhibits "A" and "B" made a part hereof for all purposes, are hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest the attached Supplemental Agreements with Klotz Associates, Inc., for engineering services associated with the McHard Road Project. WITNESSETH WHEREAS, the City and Engineer executed a contract on November 19, 2001 for engineering services described as follows: Develop the Schematic, Plans, Specifications and Estimates, Environmental Assessments, Public Involvement, Hydraulic Impact StudY, and Right-of-Way Mapping for the proposed McHard Road Extension. McHard Road will be a four lane divided curb and gutter section that extends from SH 35 to 1.1 mile East to connect with proposed Pearland Parkwq¥. WHEREAS, Article 2, Scope of Services, defines the current scope of work and schedule and it has become necessary to amend such scope of work and schedule; and WHEREAS, Article 4, Compensation, limits the maximum amount payable, of the contract, to $498,523.00, as executed in the Original Agreement; and WHEREAS, it has become necessary to amend the contract. (QCl) is pleased to submit this proposal regarding the above referenced protect. It is our understanding that the initial roadway improvement project for McHard Road (CS J: 0912~31-120) has been developed to the point that it has been determined that the proposed McHard Road extension will require storm water drainage improvements. As discussed with TxDOT, Klotz Associates, and the City of Pearland, the Environmental Assessment will be revised to include the environmental concerns of the storm water drainage ditch improvements. In addition, we have included services to revise the wetland delineation report preparation. We do not anticipate any significant impacts as a result of the proposed project. However, should any significant impacts be identified, we will notify you of our findings and consult with TxDOT, Klotz Associates, and the City of Pearland. This scope of work is based on current regulations and guidelines in effect at the lime of preparation of this scope of work and cost estimate. This scope of work does not cover the proposed changes to the wetland regulatory guidelines regarding "isolated" wetlands, proposed for issuance by the US Army Corps of Engineers (USACE) in January 2003. The proposed regulatory guidance changes could change the quantity of jurisdictional wetlands within the proposed project boundaries. Under current USACE guidelines, only jurisdictional wetland areas are delineated and represented in the wetland delineation reports (Preliminary Jurisdictional Determination report and Final Wetland Delineation Report). Only those wetland areas within the 100-year floodplain will be included in the USACE documentation reports. SCOPE OF WOR,K This Scope of Work will include wetland delineations and collecting additional information for the drainage ditch area for McHard Road (from SH 35 to proposed Pearland Parkway). The drainage ditch ROW is assumed to be approximately 3,000 ft in length and 200 ft wide. Additional Environmental Services Rev 01-13-03 McHard Road Drainage Ditch, City of Pearland, Brazoria County, Texas page 2 Once the drainage ditch alignment has been determined and staked in the field, QCI will document the impacts of the additional right, of-way (ROW). If the proposed alignment for the drainage ditch changes after work is initiated, a revised Scope and Cost will be prepared to cover the changes. WETLAND DELINEATION, PERMITTING, AND MITIGATION QCI will perform offsite and onsite wetland determinations for the proposed drainage ditch project. Subtask 1: Offsite Wetland Determinations Initially, a preliminary wetland assessment will be conducted based on available information including previous wetland reports for the area, USGS Topographic maps, National Wetland Inventory maps, aerial infrared photographs (DOQQ), USDA-NRCS Soil Survey for Brazoria County, and other available information to the extent necessary for comparing potential wetland impacts from each reasonable alternative. Subtask 2: Onsite Wetland Determinations Once a preferred ditch alignment is selected, QCl will then perform onsite wetland determinations using the Corps of Engineers Wetlands Delineation Manual, Technical Report Y-87-1, January 1987, Final Report (1987 Manual). The alignment of the preferred alternative for which onsite wetland determinations will be performed will be staked (by others) in order to facilitate the wetland determinations. Observation points will be selected along the preferred alignment with consideration being given to changes in vegetation, changes in mapped soil types, areas with plant communities comprising hydrophitic vegetation indicative of wetlands and/or observation of saturated or inundated areas. At each observation point, all pertinent data regarding the technical criteria, characteristics, and indicators for each of the three wetland parameters (vegetation, hydrology, and soils) will be recorded onto a Routine Wetland Determination Data Form (Data Form) and a wetland/nonwetland determination will be made. Subtask 3: Wetland Delineations QCI will delineate all wetlands along the preferred alternative and modify the previously prepared Preliminary Jurisdictional Determination (PJD} Report. If required, QCI will accompany a COE Biologist in the field for verification purposes. Subtask 4: Wetlands Surveyin.q and Mapping After the wetland delineation has been verified by the COE, QCI will then survey (using differentially corrected GPS) and map the wetlands. Maps depicting the jurisdictional wetlands and all observation points at which Data Forms were completed will be included. Subtask 5 Coordination and Preparation of Section 401/404 Permit Application QCI will assist in the preparation, coordination, and consultation throughout the permitting process for Nationwide Permits. However, should the ditch wetland impacts or the cumulative project wetland impacts require preparation of an Individual Permit, a revised Scope and Cost would be required. Subtask 7: Prepare Final Wetland Report and Wetland Section of EA QCl will prepare the Final Wetland Delineation report and wetland section of the EA with full documentation of the wetlands analysis and results. The EA will discuss the wetland impacts, if any, from the preferred alternative and any permit requirements. The EA will also discuss any proposed mitigation plans for avoiding, minimizing, rectifying, or compensating impacts to wetlands. SUPPLEMENT ENVIRONMENTAL ASSESSMENT QCI will survey and assess the proposed alignment for the storm water drainage ditch and revise the Environmental Assessment (EA) and include the environmental concerns of the storm water drainage ditch improvements. The revised EA report shall be prepared for the City of Pearland to comply with TxDOT Highway Design Division Operations and Procedures Manual Part II-B and TxDOT Houston District guidance. Once the EA has been revised, the report will be submitted to TxDOT for their review and further processing. QCI will provide four copies of the "Draft" EA for review, one copy each for Klotz (Engineer) and the City of Pearland, and two copies for TxDOT. Upon receipt of comments, QCI will amend the report and provide eight copies of the EA for TxDOT-Environmental Affairs. Upon receipt of comments, QCI will amend the report and provide eight copies of the EA for TxDOT-Environmental Affairs to coordinate with the appropriate regulatory agencies and FHWA. All submittals will be coordinated through the Engineer. Review times are beyond the control of QCI. SCHEDULE AND COST We are prepared to begin work upon receipt of your written authorization. Prior to initiating any work on revising the EA document, the preferred storm water drainage ditch alignment will be staked in the field (by others). The "Draft" EA report and Preliminary Jurisdictional Determination report will be completed approximately 60 calendar days after surveying and staking the proposed alignment. We propose to provide the above services on a lump sum basis. We estimate a total cost for the revisions to the EA report and wetland delineation and permitting services of $18,137.21 as shown in Attachment D. Klotz Associates, Inc. 1160 Dairy Ashford, Suite 500 Houston, Texas 77079 PROPOSAL FOR GEOTECItNICAL SERVICES FOR PROPOSED MCHARD ROAD OUTFALL DITCH PEARLAND, TEXAS Dear Mr. Vanderwalt: Tolunay-Wong Engineers, Inc. (TWEI) is pleased to submit our proposal for additional geotechnical services for the McHard Road Project in Pearland, Texas. Details of the project were provided verbally by you and via email received on October 24, 2002. The proposed outfall ditch alignment will start at the east, em end of the McHard Road Circle and end at the proposed detention pond at Pearland Parkway. The proposed out-fall alignment is about 3000 t~, long and consists of excavating a channel. Previously, sixteen borings were drillecL/sampled betxveen January 17 and 22, 2002 ms part of the Geoteehnical Evaluation performed by TWEI. The proposed additional sample borings are for the ouffall ditch only. Slope stability analysis and cut slope recommendations will be performed as part of this proposed work scope, and two piezometers will be installed. Scope of Ser~Sces Our scope of services will include drilling and sampling addkional soil borings for the outfall ditch, slope stability analysis and cut slope recommendations will be performed based on cross-section geometry that will be provided by Klotz Associates, Inc. (KAI). Field Services. Per your request, we propose to drill three (3) 20-f~ to 25-fl deep soil borings and install two (2) standpipe piezometers for the outfall ditch. We understand that clearing (20-R by 3000-fl cut line) for the alignment will be performed by others. The projoct-bo~ings will be drilled and sampled at continual 2-t~ intervals to a depth of 12 ft and at 5-t~ intervals thereafter to the boring completion depths. Upon completion of drilling and sampling, two of the sample borings will be used for stand pipe piezometer installations. We will install 2-in. PVC screen and casing in the open borehole with a sand filter pack and a bentonite seal for groundwater monitoring. The locations of the piezometers installations will be selected in the field based on observed soil conditions from the sample borings. We will purge/develop the piezometer installations using submersible pumping or bailer methods one or two days alter completion. Water level measurements will be taken at the time of the installations, during development, and additional water level readings will be obtained over at least a 30 day period. Additional water level reading can be taken at your request for additional fees as presented in our budget section. Per your request, we will make provisions to mobilize eXl, uipment and personnel to clear the alignment as part of our scope of work. We will perform soil mechanics laboratory tests to measure physical and engineering properties of selected representative soil samples. The testing will generally include measurement of the total shear slxength, effective shear strength, total unit weight, in situ moisture content, fines content, and plasticity characteristics of the soils. Ail laboratory tests will be performed in accordance with appropriate ASTM standards. We will ke~p the samples for 30 days after the final report is presented. We will discard the samples after that time, unless instructed otherwise. Reoort Preparation. (TWEI) is pleased to submit our proposal for piezometer installation services for the McHard Road Project in Pearland, Texas. Project details were provided verbally by you and via email we received fi.om you on July 2 and July 3, 2002. The proposed alignment will start at just east of S.H. 35 and end at Pearland Parkway. The project alignment is about 1.5 miles long and consists of pavement and storm sewer. 16 Borings were drilled/sampled between January 17 and 22, 2002 as part of the (3eotechnical Evaluation performed by TWEI. The proposed piezometers are to obtain ground water level measurements since surface water and shallow water was encountered during drilling operations. Scope of Services Our scope of services will include drilling, mstallation~ development and extended readings of groundwater piezometers for the proposed project at the boring locations where shallow groundwater was encountered and sand layers were encountered in the borings. Field Services. Per your request, we propose to drill three (3) 15-ft deep piezometer installations along the proposed alignment to evaluate groundwater conditions. We propose to locate the piezometers between soil borings CB-3 and CB-4 and at boring CB-7 and CB~12. These boring locations were selected based upon the soils stratigraphy encountered in the project borings from our geotechnical investigation OWEI Project No. 02-031). The piezomcters will be installed in accordance with TxDOT criteria. The piezometers will be installed using licensed State of Texas monitoring well drillers. The proper state forms for installation will be issued with the state water well board. A 6-in diameter hole will be augered to the full depth of the piezometer installation or to the depth where borehole instability occurs. If water or borebole instability occurs, the borehole will be completed using wet rotary drilling techniques. Upon reaching the target completion depth, a 2-in. by 10- f~ PVC slotted screen will be installed followed by PVC riser pipe to about 2-ft above the ground surface. A clean sand filter pack will be placed around the screen and to within about 5-R of the ground surface. The remaining borehole annulus will be filled with bentonite chips to the ground surface. We are assuming that the piezometer installations will be temporary. No provisions for concrete well pads, protective steel covers or bumper posts are included with this proposal. The day following the installations, we will mobilize back to the site to develop the piezometer using bailing or submersible pumping techniques. CONTACT CONSULTANT We recently sent you the attached letter approving Supplemental Agreement Number 2 for Klotz, Associates, Inc. (Klotz) to perform additional design services on the subject project. However, this letter declined approval for Supplemental Agreement Number 1 due to some questions regarding the increased environmental work. We recently received a revised Supplemental Agreement Number 1. The environmental work has been adjusted per our comments. We have determined that both Supplemental Agreements Numbers 1 and 2 are for a fair and reasonable amount and adequately describe the extra work to be performed. We request that you proceed to execute both supplemental agreements at your earliest convenience. We will need a fully executed copy of both supplemental agreements in order to amend the amount payable to the City of Pearland with our Accounting Section. We request that you provide us with the fully executed st pplemental agreements at your earliest possible convenience.
