R2002-158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING WORK AUTHORIZATION #6 SUPPLEMENT #5 FOR ENGINEERING SERVICES ASSOCIATED WITH THE PEARLAND MOBILITY AND DRAINAGE BOND PROGRAM. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain contract by and between the City of Pearland and Turner, Collie and Braden, Inc., ("T C & B) for Program Management of the Pearland Mobility and Drainage Bond Program was authorized by the City Council on December 10, 2001. Section 2. That T C & B has developed work authorization #6 Supplement #5, which is attached hereto as Exhibit "A." Section 3. That work authorization #6 Supplement #5 for engineering services associated with the Pearland Mobility and Drainage Bond Program is hereby approved. H~te~~, .~E.~ ~"- Project Manager CLH/mmc Attachment ATTACHMENT D WORK AUTHORIZATION NO. 6 SUPPLEMENT NO. 5 Exhibit "A" R2002-'i58 This Work Authorization is made pursuant to the terms and conditions of the Pearland Mobility & Drainage Bond Program, hereinafter identified as the "Contract", entered into by and between the City of Pearland ("City"), and Turner Collie & Braden Inc. ("Engineer). PART 1. Work Authorization No. 6 Supplement No. 5 is related to Bailey/Oiler Road from SH 288 to SH 35. The Engineer will perform Wetlands Permitting. PART 2. The maximum amount payable for services under this Work Authorization No. 6, Supplement No.5 is $25,626.00. This amount is based on the following attached fee proposal submitted by Harding ESE dated September 26,2002 in the amount of $25,626.00 for Wetlands Permitting. PART 3. Payment to the Engineer for the services established under this Work Authorization shall be "Lump Sum". PART 4. This Work Authorization shall become effective on October 8, 2002 and shall terminate on November 12, 2005, unless extended by a supplemental work authorization. PART 5. This Work Authorization does not waive the parties' responsibilities and obligations provided under the contract. PART 6. This Work Authorization is hereby accepted and acknowledged below. Box 130089 Houston, Texas 77219-0089 RE: Proposal for 404 Permitting Activities - City of Pearland Dear Mr. Keller: Harding ESE is pleased to submit the attached proposal for subconsultant services for Phase II of 404 Compliance for Bailey/Oiler Road in Peadand, Texas. Phase II will consist of those activities associated with the preparation of permit application packages for the U.S. Army Corps of Engineers (USACE) permits required for construction. The proposed Scope of Work was developed based on previous meetings with Turner Collie & Braden Inc. and wetlands investigations conducted the week of August 26, 2002 and consists of the following tasks: Tasks · Consultation/Coordination for JD: This task includes submitting the preliminary jurisdictional determination to the USACE w/ a cover letter requesting a Jurisdictional Determination (JD). Additionally, this task includes in-person meetings with the USACE and a field visit to assess wetlands jurisdiction. Issues to discuss with the USACE will be the extent of Cowarl and Mary's creeks, Mustang Bayou and its 100-year floodplain (several of the wetlands sampled are w/in the bayou's floodplain), jurisdiction of the American Canal, jurisdiction of partially filled ditches, and jurisdiction of isolated wetlands. · Prepare and Submit 404 permit application and 401Water certification This task includes preparing permit application and drawings based on final JD by the USACE. Drawings will include plan and cross-section views of typical road sections and plan view drawings of jurisdictional wetlands that will be impacted. The cover letter for the application will include any avoidance, minimization, and mitigation measures considered for the project, including the "tiered" detention pond. This task also includes completing the Texas Commission on Environmental Quality (TCEQ) Tier II questionnaire for Clean Water Act (CWA) Section 401 Water Quality Certification. · Consultation/Coordination during permitting process This task includes making sure the USACE has all it needs to "start the clock" for the public notice period, following up with the USACE regarding comments received on the project, and making certain the permit is issued in a timely manner. Individual tasks and associated scope and labor hours are provided in the attached spreadsheet.
