A regular meeting of the City Council of the City of Pearland was
called to roder by Mayor Keller with the following present:

INVOCATION:
The invocation was given by Mr. James Matlock.
APPROVAL OF THE MINUTES:
It was moved by Councilman Courtright, seconded by Councilman Ellis
that the minutes of the special meeting held on January 16, 1968
be approved. Motion passed 3 to 0.
RECEIVING OF BIDS ON POLICE CAR:
The bids were opened and the results were read as follows:

It wag -moved by Councilman Sanders, seconded by Councilman Courtright
that the bids be referred to the City Administrator for tabulation and
recommendation at the next regular Council meeting, with the Royal
Dodge the apparent low bidder. Motion passed 3 to 0.

EXPENSES:
It was moved by Councilman Courtright, seconded by Councilman Ellis
that Check Nos. 3081 through 3125, excluding Check No. 3124 be
approved. Also, Check Nos. 3127 and 3128, and approve the
voiding of Check Nos. 3068, 3069 and 3126. Also, approve the
check list for the payroll ending January 31, 1968, including 'I
Checks Nos. 1943 through 1970. Motion passed 3 to 0.
MAYORS ACTIVITY REPORT:
1. Mayor Keller reported that a letter had been received
from the Mainland Construction Company concerning the
additional water and sewer lines. He call a special
meeting to be held on Saturday January 27, 1968 at 9:00
A. M., to discuss this matter with Mr. Smith of the
Mainland Construction Company.
2. Mayor Keller stated that he had received telegrams
from the Honorable Jack Brooks and Ralph Yarborough
congratulating the City of Pearland on its WPC 455 Grant
from the Federal Government in the amount of $152,81o.00
for sewer lines and lift stations. !�
3. Mayor Keller read a note from -Mr. R. J. Franklin, Jr.
commending Officer Norris on his courteous attitude on
the manner in which he presented him with a citation for
speeding in the early part of the month. Mayor Keller
directed that a copy of this note be placed in Officer
Norris' personnel file.
4. Mayor Keller read a letter from Mr. Milton Farmer,
Postmaster.

Pearland, Texas 77581
Gentlemen:
This Post Office and Postmaster is again requesting
your consideration of some action to make the public aware
of the necessity of controlling dogs that bite and harass
your City Mail Carriers.
Only recently one of our City Carriers was bitten
by a dog with no rabies shot and which required the
restraining the animal for 10 days, a trip to the doctor

for a tetnus shot not to mention the worry and anxiety
by the person bitten. Every day our carriers are having
to deliver,your mail and fight the dogs off while doing
so and this does not make for good delivery service. We
have had to stop delivery of mail to one person until
the dog was kept up and if necessary, we can stop
delivery for a whole block. Most any morning we can count
six (6) to a dozen dogs in and around the Post Office
and numerous complaints are hitting us over no control.
It is not this;Postmaster's desire to withhold any
mail delivery but unless something is done by the City and
the Public to protect our City Mail Carriers it will be
necessary to do so and as your Postmaster I again urge
you to take some action that will assist us in this matter
As you are well aware, we have only had City Delivery
Service since last April and we appreciate the fact it
was granted by the Post Office Department through the
able assistance of our Congressman and Senator and as
a publice service it is felt that you and I•want to
do the most we can to get the mail to our citizens.

Mayor Keller appointed Councilman Sanders and Ellis to a
Committee to meet with Mr. Farmer and work out a solution
to the dog problem.
5. Mayor Keller gave a report on the Chamber of Commerce
work program for the year and indicated the willingness
of the City to cooperate with the Chamber of Commerce and
make Pearland abetter place in which to live.
COMMITTEE REPORTS:
Councilman Courtright stated that the City of Huntsville had a number
of revolving funds on voluntary assessment programs for a capital
improvements program. It was moved by Councilman Courtright, seconded
by Councilman Sanders that the City Administrator be authorized to
make a one day trip, with expenses paid, to the City of Huntsville to
review these revolving fund systems, if he deems it advantageous
to the City of Pearland. Motion passed 3 to 0.
Councilman Ellis reported that a controversy had arisen on January 24

regarding land lines and fencing in the railroad property at the South
end of Jasmine Street. Mayor Keller instructed the City Administrator
to verify the Cityts position on this matter and determine whether or
not the street right-of-ways were being fenced.in, and write the
Railroad Company a letter of protest if this be the case.,
CITIZENS:
Water Lines - McGinnis Subdivision: Dr. H. E. Hart, Jr., President

of the McGinnis Civic Club presented a petition addressed to the
City Council, Pearland, Texas and stated that the petition contained
48 names. Said petition reading as follows:
"MC GINNIS CIVIC CLUB
MC GINNIS SUBDIVISION
TO: City Council
Pearland, Texas
We the undersigned residents and/or property owners of
the McGinnis Subdivision request that the city water
lines be extended into our subdivision so that each
property owner might avail himself of these services.
It is our understanding after having talked with Mr.
Gene E. Sanders of the City Council that it is possible
to extend these lines at this time. Finances for
these services could be obtained from money that is
presently available."
Mayor Keller received the petition and informed Dr. Hart that the
Council would consider the matter and he would.be informed of the
decision of the Council. When asked a question, City Attorney
Galli reported that if the proposition for water lines on the ballot
for the 1964 bond election did not specifically designate the streets
in which the water lines be laid, the City Council at its own
discretion, could determine were to be installed anywhere in
Pearland, and that the map that advertised the bond issue had no
significance to the election. (Councilman Wasek entered the meeting
at 9:05 P. M. )
City Administrator was requested to have a cost estimate prepared
concerning the water lines to serve McGinnis Subdivision.
Streets: Dr. Hart presented another petition which contained
approximately the same number of names. Said petition reading as
follows:
"MC GINNIS CIVIC CLUB
MC GINNIS SUBDIVISION
TO: City Council
Pearland, Texas
We the undersigned residents and/or property owners
of McGinnis Subdivision of the City of Pearland, do
hereby petition the City of Pearland to do its utmost
to establish a more thorough procedure in maintaining
all existing streets of McGinnis Subidivision 1 and
2. Also, we feel that these subdivisions are well
enough developed to warrant hard surfacing of said
existing streets, and would like in the immediate future
from the City of Pearland a letter projecting its

considerations and intentions of these matters:"
Mayor Keller instructed the City Administrator, with the assistance
of the Director of Public Works to prepare a cost estimate for the
necessary maintenance of the streets in that area, and if the cost
is not prohibitive, meet with the Street and Bridge Committee and
proceed with the necessary maintenance. Otherwise, bring back his
recommendation to the City Council at the next meeting.

APPROVAL OF THE MINUTES:
It was moved by Councilman Courtright, seconded by Councilman Sanders
that the minutes of the regular meeting held January 11, 1968 be
approved. Motion passed 3 to 0 (Councilman Ellis abstained due
to his not being present at the meeting in question.)
SEWER LINE GRANT U. S. GOVERNMENT:
It was moved by Councilman Courtright, seconded byCouncilman Ellis
that the following Resolution be adopted:
WHEREAS, the City Council of the City of Pearland has
authorized a program of construction of sewage works.at an estimated
cost of $478,821.20 and the United States Government, acting through
the Federal Water Pollution Control Administration, has offered a
federal grant in the amount of $152,810.00 as designed on Part A,
Offer and Acceptance, now under consideration by this body.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City
Council of the City of Pearland, that said offer be submitted to-
gether with the terms and considerations thereof, is hereby accepted
and approved; and that D. R. Keller, of the City of Pearland, is
hereby authorized and directed to sign said Offer and Acceptance and any
other necessary documents required to complete the project on behalf
of said City.
BE IT FURTHER RESOLVED that the City of Pearland has
or will procure a fee simple or such other estate or interest in the
site of the project, including the necessary easements and right-of-
way, as to assure undisturbed use and possession for the purposes
of construction, operation and maintenance of the works for the
estimated life of the prlject; and that in the event such title,
estate, or interest in such site, easements or right of way, -ay in the
future be contested, the City of Pearland, will defend and maintain
its title in such site and hold the United States Government blameless
in such action; and that before any federal payment is requested
pursuant to said grant, said City will provide certification as to
the sufficiency of such estate of interest.
PASSED, APPROVED AND ADOPTED at a meeting of the City
Council of Pearland, Texas, on the 25 day of January A. D. 1968.

MAYTrnuc.
It was the consensus of opinion that the proposed taxicab ordinance
be dropped from the agenda because it was felt that it was un-
necessary at this time.
STORM SEWER:
Westminister and Sherwood Subdivisions: A short discussion was
held concerning an equitable participation in the cost of pipe to
install a storm sewer in a ditch dividing Westminister and Sherwood
Subdivisions. No action was taken at this time.
PETROLEUM BIDS:
Upon the recommendation of the City Administrator, it was moved by
Councilman Sanders, seconded by Councilman Wasek to award the bid
for a six month period for petroleum products to Christensen Gulf
Service as being the lowest and best bid, since he has offered a 10
discount at the end;of the month on all purchases, if his bid is based
on price fluctuation of posted pump prices and that the order be
effective February 1, 1968. Motion passed 4 to 0.

It3 was moved by Councilman Sanders, seconded by Councilman Courtright
that the City Attorney prepare an ordinance calling the election for
Mayor and two Councilmen to be held the first Saturday in April and
that the Election Judge be appointed and their rate of pay be
designated. Motion passed 4 to 0.
It was moved by Counpeilman Courtright, seconded by Councilman Wasek
that the meeting adjourn. Motion passed 3 to'l. Councilman
Sanders opposed.
Meeting adjourned at 10:05 P. M.
