1966-07-28 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 28, 1966, AT 7:30 P. M A regular meeting of the City Council was called to order by Mayor Hawkins in the City Hall with the following present: Mayor Councilman Councilman Councilman Councilman City Secretary City Attorney City Engineer Absent: Councilman Lloyd C. ThIllace, Jack B: Idoux, Marie Moore, Gene E. Sanders and Mr. and Mrs. N. J. Deisch. Meeting opened with a prayer by Reverend Paul Wilson. For the first order of business a motion was made by Councilman Calvin, seconded by Councilman Cogbill that the minutes of a regular meeting held on July 13, 1966 be approved. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye." with no "noes." A motion was made by Councilman Calvin, seconded by Councilman Wasek that minutes of a special meeting held on July 14, 1966, be approved. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." A motion was made by Councilman Calvin, seconded by Councilman Cogbill, that the payroll and invoice check list dated July 28, 1966, be approved for payment. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." A motion was made by Councilman Calvin, seconded by Councilman Cogbill that Check No. 1553, payable to Layne Texas Company, held up from a previous meeting, be approved for payment at this time. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." A motion was made by Councilman Ellis, seconded by Councilman Wa.sek that Check No. 1532 payable to the Utility Supply Company, held up from a previous meeting, be approved for payment. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." Councilman Cogbill stated that a meeting had been held with representatives of Manvel, Brookside Village and the Brazoria County Health Department regarding the garbage dump. Another meeting has been set for August 8, 1966, with the same representatives and a member of the State Health Department. After this meeting a recommendation will be submitted to the City Council. A motion was made by Councilman Calvin, seconded by Councilman Ellis that all fees for permits be waived for the Community Building which will be erected by the Pearland Lion's Club. Regular inspections to be made as usual. WHEREUPON, the question was asked and the I motion carried, all Councilmen present voted "aye" with no "noes." A motion was made by Councilman Calvin, seconded by Councilman W'"sek that the following Ordinance be passed as an amendment to the Building Code Ordinance No. 116 - said Ordinance to be known as Ordinance 116A, AN ORDINANCE AMENDING THE BUILDING CODE ORDINANCE OF THE CITY OF PEARLAND, TEXAS: AN ORDINANCE TO BE CALLED "BUfL-DING CODE OF THE CITY OF PEARLAND" CREATING A BUILDING CODE PRESCRIBING ---DUTIES AND QUALIFICATIONS OF INSPECTORS, TO BE SUPERVISED BY GENERAL -BUILDING -.BOARD OF FIVE MEMBERS; PROVIDING FOR PERMITS DOING OR-CAUSING-TO'BE DONE CONTRACT WORK; PRESCRIBING FEES: PROVIDING EXCEPTIONS: REGULATING QUALITY, TYPE AND KIND OF MATERIAL AND MANNER OF INSTALLATION REFERRING TO SOUTHERN STANDARD BUILDING CODE AND ADOPTING SAME; PROVIDING -FOR APPOINT- MENT OF BUILDING INSPECTOR AND INSPECTION OF ALL BUILDING, THIS BUILDING CODE INCLUDES METES AND BOUNDS OF THE CITY OF PEARLAND, ALL BUILDINGS AND REMODELING MUST HAVE BUILDING PERMIT AND MUST ACQUIRE IT FROM CITY SECRETARY OR TAX DEPARTMENT ON REMODELING OF HOMES, OWNER MUST HAVE ELECTRICAL AND PLUMBIlf INSPECTIONS. THERE WILL BE NO CHARGE IF CONTRACT DOES NOT EXCEED $1,000.00. PERMIT FEE SHALL BE BASED ON 1 - PER: SQUARE FOOT ON COVERED AREA ON THE STRUCTURE FOR WHICH SUCH PERMIT IS ACQUIRED. THE BUILDING INSPECTOR MUST MAKE AN INSPECTION BEFORE THE SLAB IS POURED: AFTER BUILDING DRIES IN SO INSPECTOR CAN SEE CORNER BRACES, COLLAR BRACES AND RAFTERS, AND TYPE OF MATERIALS USED., FINAL INSPECTION AFTER. JOB IS COMPLETED; PROVIDING FOR A PENALTY. P- OR -.VIOLATION THEREOF AND DECLARING AN EMERGENCY. THIS ORDINANCE IS -NOT INTENDED TO SUPERSEDE OTHER EXISTING GOVERNMENTAL REGULATIONS SUCH AS STATE, -COUNTY OR FEDERAL REQUIREMENTS. CONTRACTS SIGNED PRIOR TO MAR -GH 2�;, 19662- NOT AFFECTED BY THIS ORDINANCE. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted" "aye" with no -"noes." A motion was made by Councilman Ellis, seconded by Councilman -Calvin that a $1,00 service charge be added to each invoice for grass and weed mowing. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." A motion was made by Councilman Ellis, seconded by Councilman Cogbill that any contractor or sub contractor doing work for the City of Pearland must file proof of liability insurance. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no 11noes.1' A motion was made by Councilman Wasek, seconded by Councilman Calvin that a letter be written to the Texas Highway Department'requesting a study of traffic on Highway FM 518 from Main Street east to the County line with a view of slowing traffic down, especially near town and subdivision gntrances. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." Following due discussion, Councilman Calvin recommended that the City Council meet with local law enforcement officers and determine where speed zones might be needed. A motion was made by Councilman Wasek, seconded by Councilman Ellis that the offer of the car air conditioner by Niday Funeral Home be accepted and the same be placed in the 1966 Dodge police car. WHERE- Ur011,the question was asked and the motion carried, with Councilmen Wasek, Ellis and Calvin voting "aye" and Councilman Cogbill voting "no." A motion was made by Councilman Calvin, seconded by Councilman Cogbill that the contract to Texala, previously approved on a low bid basis on May 17, 1966 as Contract A-3 be signed by the Mayor and City Secretary for the sum of $142,211.00. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." City Secretary instructed by Council to write letter to Mrs. Waldo Gonzales expressing their appreciation for the many civic duties Waldo had donated his time and efforts to in serving the community as a whole. A motion was made by Councilman Calvin, seconded by Councilman Wasek that upon the recommendation of Engineer Jim Bell, representing_ Walsh & McLaren, that the Council accept and execute the Certificate of Completion and the Certificate of Acceptance for the Kay Service Company contract "Additions to Water Distribution System - Old Townsite." A motion was made by Councilman Calvin, seconded by Councilman Wasek 82, that the engineer be instructed to plan for the installing of water and sewer lines for Shadycrest Subdivision in the street right -of ways.
