R2007-084 2007-05-14 RESOLUTION NO. R2007 -84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, EXPRESSING OPPOSITION TO SB 1638 AND ENCOURAGING THE 80TH TEXAS LEGISLATURE TO OPPOSE THE PROPOSED LEGISLATION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: WHEREAS, since the property tax reforms of the 1970's, municipalities have been allowed to utilize a "new construction adjustment" to determine the effective tax rate calculation; and WHEREAS, by excluding "new construction" from each years tax rate calculations, municipalities are able to present an accurate forecast of tax increases or decreases on existing property owners; and WHEREAS, Senate Bill 1638 proposes to remove the "new construction" adjustment from a municipalities effective tax rate calculation; and WHEREAS, if approved, Senate Bill 1638 will contradict the intent of Truth-in- Taxation disclosures by forcing municipalities to provide complicated and misleading information; and WHEREAS, if approved, Senate Bill 1638 will unfairly punish municipalities that are growing at a rapid pace because taxes on "new construction" would count against the effective tax rate. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City Council of the City of Pearland , Texas hereby expresses opposition to SB 1638 and encourages the 80th Texas Legislature to oppose the proposed legislation.
