1966-02-10 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF PEARLAND, TEXAS., HELD ON FEBRUARY 10, 1966 IN THE CITY HALL A regular meeting of the Pearland City Council was called to order at - 7:30 P. M., February 10, 1966 withthje following present: Mayor John G. Kegley Councilman Gene B. Sanders Councilman Steven A. Shukanes Councilman Basil L. The first order of business was the opening of bids for clay pipe as advertised in the Pearland Progress. Dalsco, Inc. Lot Price $1910.00 (Cashierls'Check attached $100.00) Black Brollier, Inc. (Bid disqualified, no Cashier's Check attached) Councilman &anders.made a motion, seconded by Councilman Shukanes that the bid submitted by Dalsco, Inc. on the vitreous clay pipe in the amount of $1,910.00, -lot price, be accepted since it was the only qualified bid received. WHEREUPON, the question was asked and the motion failed, with Councilman Shukanes and Councilman Sanders voting "aye" with Councilmen Cogbill, Calvin and Nolen voting "no." The next order of business was the opening of bids for fittings as advertised in the Pearland Progress. WHEREUPON, the question was asked and the motion failed, Councilmen Sanders and Shukanes voting "aye"with Councilmen Cogbill, Nolen and Calvin voting 'ono." WHEREUPON, the original motion was asked and all Councilmen voted "aye" with no `:`noes.'.' The motion carried. Councilman Sanders stated that for the record that he opposed the payment of Checks No. 89 through 97 on the Construction Fund for the reason he felt they were excessive rates. WHEREUPON, the question was asked and the motion carried, all Councilmen voted "aye" with no "noes." Councilman Shukanes recommended that the City Secretary be instructed to write a letter to Dr. John Williams, Chairman of the Civic Affairs Committee, Chamber of Commerce stating the gratitude of the Council in the Chamber of Commerce efforts to improve and beautify our City. A motion was made by Councilman Shukanes, seconded by Councilman Calvin that the Public Work's Director secure three bids for material and necessary ditch work for the Airport Subdivision No. 4 Project and to present it to the City Council at the next regular meeting. Mayor Kegley stated that a special meeting would be held on Thursday Night February 17, 1966 at 7:30 P. M. at the City Hall. A motion was made by Councilman Calvin -seconded by Councilman Coghill that the City Engineer be instructed to make a survey and -stake out Field Village Road from F. -M. 518 North to Mary's Creek. WHERETTPON, the question was asked and the motion carried, all Councilmen voted "aye" with no- I,noes ." Councilman Nolen reported that the Plumbing Committee would make a report soon to the City Council on recommended changes in the plumbing code. A motion was made by Councilman Shukanes, seconded by Councilman Nolen that the Plumbing Ordinance be amended for the house to City pa IR t pipe nection to be either 4 cast iron pipe, 4 vitreous clay pipg, ith nasike type connection. A motion was made by Councilman Calvin, seconded by Councilman Nolen that 500 yards of Class C type of shell be purchased under our contract to apply to street shoulders where it would not conflict with.the Kay Service Company's responsibility. WHEREUPON, the question was asked and the motion carried, all Councilmen voted "aye" with no "noes." The City Secretary instructed to write a letter to the Drainage District requesting them to make a survey of the drainage ditch on the east side of Highway 35 from the Ellis Washateria north to Hickory Slough, to determine why water stands and becomes stagnant. The Subdivision Committee reported that the entrance street into Longwood Subdivision from F. M. Highway 518 had been staked and ready to build up whenever both parties resolved their problems. Dr. John Williams stated to the Council that the Chamber of Commerce will help the City in placing street signs and house numbers. 4 Following due discussion a motion was made by Councilman Shukanes, seconded by Councilman Calvin that the City Engineer's Report and the City Attorney's Report on the Orange Street crossing be accepted and to proceed at once with the work with the street as it is located on the ground. WHEREUPON, the question was asked and the motion carried, all Councilmen voted "aye with no "noes." A motion was made by Councilman Calvin, seconded by Councilman Cogbil.l that the contract form with the Brazoria County Road Precinct No. 3 be executed. WHEREUPON, the question was asked and the motion carried, all Councilmen present voted "aye" with no "noes." Councilman Shukanes absent from the council room at this time. A motion was made by Councilman Nolen, seconded by Councilman Cogbill that Ordinance No. 124 - AN ORDINANCE MAKING CERTAIN FINDINGS CONCERNING CERTAIN CONDEMNATION PROCEEDINGS DESCRIBED IN SAID ORDINANCE; AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO DISMISS SUCH CONDEMNATION PROCEEDINGS; MAKING CERTAIN FINDINGS CONCERNING CERTAIN LANDS DESCRIBED IN SAID ORDINANCE; DETERMINING THAT SUCH LANDS ARE NEEDED FOR THE PUBLIC USES AND PURPOSES DESCRIBED IN SAID ORDINANCE; AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO PURCHASE SAID PARCELS OF LANDS FOR CONSIDERATION OF CERTAIN SUMS OF MONEY; AND AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO BRING EMINENT DOMAIN PROCEEDINGS TO ACQUIRE SUCH LANDS IF THEY CANNOT BE ACQUIRED BY PURCHASE, be adopted. A substitute motion was made by Councilman Sanders that the above motion be tabled and that all condemnation proceedings be dismissed and that the City Council choose a netural representative to negotiate both price and location with the Alexander Estate for Sewer Plant Site No. 2. WHEREUPON, the question was asked and the motion failed, Councilmen Shukanes and Sanders voting "aye" with Councilmen Calvin, Cogbill and Nolen voting "no." The question on the original motion was asked and Councilmen Calvin, Cogbill and Nolen voted "aye" with Councilman Shukanes and Sanders voting "no." Motion carried. Mayor Kegley stated for the record that he would not sign Ordinance No. 124. The meeting adjourned at 10:45 P. M. Minutes approved as read and/or corrected this the day ofza� 1966.
