1969-09-25 CITY COUNCIL REGULAR MEETING MINUTES259 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND TEXAS, HELD IN THE CITY- HALL ANNEX ON SEPTEMBER , 1969, AT 7-7.70 P. M. A regular meeting of the City Council of the City of Pearland was called to order by Mayor Keller with the following present: Mayor Councilman Councilman Councilman Councilman Councilman City Administrator City Attorney City Secretary r INVOCATION: D. APPROVAL OF MINUTES: Minutes of regular meeting held,September 11, 1969, approved as received. APPROVAL OF EXPENSES: It was moved by Councilman McComb, seconded by Councilman Black that the following checks be approved for payment: General Fund Payroll No..2773 through No. 2799 Water & Sewer Payroll No. 2800 through No. 2805 General Fund Expenses No. 949 through No. 98s$— Water & Sewer Expenses No. 4208 through No. 4219 Building Fund Expenses No. 12 Motion passed 4 to 0. Councilman Ellis not present at this -time. MAYOR'S ACTIVITY REPORT: ................... 1. Resolution _-:'Walter D. Bollinger -- Mayor Keller read a resolution commending Mr. Walter D. Bollinger for his service to the community as a member of the Police Reserve force. It was moved by Councilman Griffin, seconded by Councilman McComb that this resolution be adopted. Motion passed 4 to 0. Councilman Ellis not present at this time. 2. City Sales Tax Mayor Keller reported the receipt of a check by the City 260 in the amount of $le,560.98 for City Sales Tax. COMMITTEE REPORTS: Trailer Park Ordinance: Councilman Black reported that the special committee would have their recommendations on the trailer park ordinance by the next regular Council meeting. -,.� City Hall Building: Councilman Wasek reported that the special committee has been working on the plans and hope to have these plans in the hands of the Council by the next regular meeting. J Health & Sanitation Committee: It was moved by Councilman Griffin, seconded by Councilman Black that the following resolution be adopted which authorizes going to bid on the North End Sewer Project. A Resolution authorizing the giving of Notice to Bidders and of Intention to issue time warrants; providing the details relating thereto; and contain- ing other provisions relating to the subject. Whereas, the City Council of the City of Pearland, Texas, has determined, and hereby determines and declares, that it is necessary and desirable for said City to construct permanent improvements, additions and extensions to the City's Sanitary Sewerage System, and that it is also necessary and desirable to issue the time warrants of said City for the purpose of evidencing the indebtedness of the City to pay all or part of the cost of said improvements, including personal and professional services to be rendered in connection there- with and other incidental expenses in connection therewith; and Whereas, the City Council wishes to proceed with authorizing the giving of notice to bidders and of the City's intention to issue such time warrants; Therefore Be it resolved by the City Council of the City of Pearland, Texas: Section I: I That the facts and recitations contained in the preamble of this resolution are hereby found and declared to be true and correct. Section II: That the City Secretary is hereby authorized and directed to cause to be published in the manner required by law a notice to bidders and notice of intention to issue time warrants in substantially the following form, to -wit: 261 Notice to Bidders and Notice of Intention to Issue Time Warrants To Bidders and to the Qualified voters of the City of Pearland, Texas, whose names appear in the last approved tax rolls of Property Taxpayers, and to all other interested persons: r=-- Notice is hereby given that sealed bids, in duplicate, addressed to the City Council of the City of Pearland, Texas will be received at the Pearland City Hall until 12:00 Noon, October 30, 1969, at which time they will be publicly opened and read aloud, for furnishing all labor, materisals, supplies, machinery, equipment, tools and super- intendence for construction of Sanitary Sewerage Improvements for said City, to -wit: (1) Sanitary Sewer Collection System and Interceptor Trunk ;line for Twin Creek Woods and Clear Creek Estates area (2) Sewage Treatment Plant No. I. Bids may be made on one or both items. Bids,received after closing.time will be returned unopened. A cashier's check, Certified Check or Bid Bond payable without recourse to the City of Pearland, Texas, in an amount not less than five percent (5%) of the largest possible total for the bid submitted must accompany such bid. Plans, specifications and bidding documents may be secured from the office of William C. Walsh, Consulting Engineer, 10318 F. M. 518, Pearland, Texas, P. 0. Drawer 888, Friendswood, Texas; on deposit of fifty ($50.00) dollars. Plans and specifications will be available for inspection at the City of Pearland, Texas, City Hall. Each successful bidder respectively receiving the award of a contract shall furnish the following (a) A performance bond in the amount of One Hundred percent (100%) of the total contract price conditioned upon the faithful(�performance of the work in accordance with the plans, specifications and contract documents, and (b) a payment bond in the amount of one hundred percent (1000 of the total contract price for the protection of all claimants supplying labor and materials in the prosecution of the work provided for in each said respective contract, for the use of each such claimant, as provided by Article 5160 Vernon's Texas Civil Statutes�_,as amended. Each and all bonds heretofore mentioned shall be execiited,by Corporatt.te surety or sureties duly authorized to do business in the State of Texas. ^` Attention is called,to the fact that this project has been awarded Federal Grant Assistance, and that pertinent Federal Laws and regulations must be complied with. Bidders are hereby notified of the following requirements covered by President's Executive Orders number 112.6 and 11375 regarding employment practices: Nondiscrimination in Employment Bidders on this work will be required to comply with the President's Executive Order number 112E+6 and the provisions of Executive Order number 11375 as included therein. The requirements for bidders and 262 contractors under these orders are explained in the specifications. Attention is also called to the fact that this is a public work project, and that there must be paid on the same not less than the general, -prevailing wages which have been established for the City of Pearland, and which are on file in the office of the City Secretary. In case of ambiguity or lack of clearness in stating prices in each respective proposal or proposals, the City reserves the right to adopt prices written in words, or to reject the proposal. No bids may be withdrawn after the scheduled closing time for the receipts of bids and for thirty (3) days thereafter, and any bid received after such closing time will be disqualified and will be returned to the sender unopened. The City reserves the right to accept any bid or combination of bids deemed most advantageous and to reject any or all bids and to waive any informality. It is the intentions of the City Council to pay for all or a part of the cost of construcing permanent improvements, additions and extentions to the Cityts Sanitary Sewerage System, including personal and professional services to be rendered in connection therewith and other incidental expenses in connection therewith by the issuance of time warrants in the maximum amount of $100,000, bearing interest at a rate not exceeding Six and one-half percent (620) per annum, and maturing serially over a period of years not to exceed Ten (1) years from their date or dates, with maximum maturity date not later than January 1, 1989. Dorothy Cook City Secretary City of Pearland, Texas Section III That the notice set forth in Section II of this resolution shall be published in the Tri -County Sun Progress once a week for two (2) consecutive weeks prior to October 30, 1969, the date of the first publication to be at least fourteen (14) days prior to October 30, 1969. It is hereby found and declared that the Tri -County Sun Progress is a newspaper published within the City of Alvin, Texas, and is a newspaper of general circulation within the City of Pearland, Texas, there being no newspaper published within said City of Pearland. Acdopy of said notice shall also be posted at the door of the City Hall of said City of Pearland, and the same shall be posted at least fourteen (14) days prior to October 30, 1969. MUNICIPAL COURT: A letter dated September 22, 1969, from Main LaFrentz & Company was discussed.- This letter made various suggestions regarding procedures of the Municipal Court. Recommendations 11 2 and 3 have already been put into effect. Recommendation 4 requires action of the Council. It was moved by Councilman Griffin, seconded by Councilman Wasek that based on the recommendation of Main LaFrentz & Company ann.escrow bank account for the Municipal Court be established to handle cash bond money that they receive, and that the Municipal Court Clerk, City Administrator and Chief -of -Police be authorized to sign checks. Two signatures to be required on each.check. Motion passed 5 to 0. PROPOSED ORDINANCE ESTABLISHING CONDUCT OF COUNCIL DURING MEETING: Councilman McComb suggested that the Council check into the possibility of passage of an ordinance regulating the conduct of the Council during meetings. Mayor Keller appointed a Special Committe of Councilman McComb, Councilman Griffin and City Attorney Williams to check into this matter, CITIZENS: A. E. Hollingsworth - Mr. Hollingsworth appeared before the Council with a request that he be relieved of the mandatory garbage charge as he has no garbage to be picked up. Mayor Keller advised Mr. Hollingsworth that his request would be given consideration by the Council and should the decision be in his favor that the money collected for this date forward would be refunded to him. Decision by the Council will be made by the next regular Council meeting. Ray Nelson - Corrigan Civic Club - Dog Ordinance - Discussion of Dog Ordinance and problems of dogs r- allowed to run loose in residential areas.` I Mayor Keller informed Mr. Nelson that the City plans to include a T dog poundlin the 1969-70 budget to take care of this problem. Mrs. Jane Schupp - Mr. Ray Holder, Attorney - representing Mrs. Schupp presented the City Secretary a petition which he stated contained s-ome 327 names. This petition reads as follows: THE STATE OF TEXAS COUNTY OF BRAZORIA 264 TO THE CITY SECRETARY OF THE CITY OF PEARLAND, TEXAS Pursuant to the provisions of Article 2368a, Vernon's Civil Statutes of Texas, Section Four (4) thereof, and in response to the legal notice of said City published in The Tri -County Sun Progress on September 11, 1969, wherein notice is given of the intention of the City Council of the City of Pearland, Texas, to issue Time Warrants in the amount of 100,000.00, bearing interest at the rate of 64 per annum for financing a portion of the cost of labor, material and equipment for performing all work required for the construction of Sanitary Sewer ;;Collection Lines and Waste Treatment Plant in the City of Pearland, Texas, on January 1, 1970, We, the undersigned qualified voters whose names appear on the last approved tax rolls of said City as property tax payers, hereby petition the City Council of the City of Paarland, Texas, to submit to referendum vote the question as to issuance of said Time Warrants for such purpose: Dated this the 25 day of September, A. Mayor Keller stated that the minutes of this meeting would reflect the receipt of this petition! Mrs. Jane Schupp addressed the Council regarding this petition.
