1994-03-17 CITY COUNCIL SPECIAL MEETING MINUTES14 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MARCH 17, 1994, AT 6:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The meeting was called to order with the following present: Mayor C. V. Coppinger Mayor Pro Tem/Councilmember Joy Colson Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary D. A. Miller Benny Frank Randy Weber David Smith Paul Grohman Dick Gregg, Jr. Pat Jones Reverend Harold Gentry, President of the Ministerial Alliance, opened the meeting with a prayer. OTHER BUSINESS MEETING RECESSED TO EXECUTIVE SESSION AT 6:05 P. M. Mayor Coppinger read from the posted agenda the following topics to be discussed in Executive Session: SECTION 551.071 - Private consultation with the attorney(s) for the City to seek legal advice regarding threatened and contemplated litigation against the City by Paul Grohman, City Manager, pursuant to Section 551.071 of the Government Code, Subsection (1) (A). SECTION 551.074 - Deliberation of the continued employment and/or dismissal of Paul Grohman, City Manager, pursuant to Section 551.074 of the Government Code, Subsection (a) (1) and (2), unless Paul Grohman requests a public hearing of the deliberations under Subsection (b). MEETING RETURNED TO OPEN SESSION AT 8:42 P. M. NEW BUSINESS REGARDING THE CONTINUED EMPLOYMENT AND/OR DISMISSAL OF PAUL GROHMAN, CITY MANAGER AND, IF APPLICABLE, THE TERMS AND CONDITIONS OF THE TERMINATION OF HIS CONTRACT OF EMPLOYMENT City Attorney Gregg read the following statement into the records: "All emotions are high and conditions are difficult for mature deliberation. There are risks to both sides. Rights on both sides. Concerns on the public's side. All of us are affected. We are willing to consider the possibility of a negotiated agreement to see if it is possible to establish and agree to performance standards and to measure the City Manager by those standards and to see if changes in what Council perceives as unacceptable management practices can be achieved. We shall allow a reasonable time for our City Attorney and our other legal representatives and the City Manager's attorneys to negotiate such an agreement and to present it to us and him for consideration. If we find it acceptable, we shall approach resolution in good faith. If we find it unacceptable, we reserve the right to post the same agenda that notices this meeting and to take whatever action we deem appropriate at that time." It was moved by Councilmember Weber, seconded by Councilmember Frank, that this agenda be tabled until Monday, March 21, 1994, and the City Secretary be instructed to re -post the two identical executive session items from this agenda for Monday, March 21, Tuesday, March 22, and Wednesday, March 23. It was clarified there would be no action items on these agendas. Motion passed 5 to 0. ADJOURNMENT The meeting adjourned at 8:47 P. M. Minutes approved as submitted and/or corrected this day of A.
