1968-09-16 CITY COUNCIL SPECIAL MEETING MINUTESam MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND TEXAS, HELD IN THE CITY HALL ANNEX ON SEPTEMBER 16, 1968, AT 7:35 P. M. A special meeting of the City Council of the City of Pearland was called to order by Mayor Keller with the following present: Mayor D. R. Keller Councilman E. A. Wasek Councilman Dale Watson Councilman B. J. Courtright Councilman A. G. Ellis Councilman Gene E. Sanders City Administrator Buford D. Waldrop City Secretary Dorothy L. Cook INVOCATION: The invocation was given by Mayor D. R. Keller. Councilman Wasek entered council chambers at 7:40 P. M. OLD BUSINESS: Charles Kliesing, et ux - Colony Park Subdivision: Mayor Keller read a proposal from Charles Kliesing regarding water and sewer facilities to Colony Park Subdivision.- It ubdivision: It was moved by Councilman Courtright, seconded by Councilman Ellis that the motion made on September 12, 1968, regarding adoption of Ordinance No. 163 - annexation of property owned by Charles Kliesing, et ux, be brought from the table and voted on. Motion passed 4 to 1. Councilman Watson opposed. It was moved by Councilman Ellis, seconded by Councilman Wasek that Ordinance No. 163 - AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, RECEIVING AND ANNEXING AS A PART OF SAID CITY -OF PEARLAND, TEXAS, THE FOLLOWING UNINHABITATED TERRITORY LYING ADJACENT TO THE CITY OF PEARLAND, TEXAS, and owned by Charles Kliesing and wife, Ruby Kliesing and known as'Lot or Tract 11, Section No. 5, HT & B RR Company Survey, Abstract 237, be adopted on first and final reading. Motion failed 5 to 0. It was moved by Councilman Courtright, seconded by Councilman Ellis that Ordinance No. 163 - AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS RECEIVING AND ANNEXING AS A PART OF SAID CITY OF PEARLAND, TEXAS, THE FOLLOWING UNINHABITATED TERRITORY LYING ADJACENT TO THE CITY OF PEARLAND, TEXAS, and owned by Charles Kliesing and wife, Ruby Kliesing and known as Lot or Tract 11, Section No. 5, HT & B RR Company Survey, Abstract 237, be passed on the first of three readings, and that the second reading be held at the regular Council meeting on September 26, 1968, and the subsequent third reading not before the 10th of October, 1968. Motion passed 4 to 1. Councilman Watson opposed. Proposed Drainage District Plans For Southwest Portion of Old Townsite: Commissioner O'Day and Commissioner Johnston of the Drainage District MR •• appeared before the Council to explain the various plans for the drainage in the wouthwest portion of the old townsite. A motion was made by Councilman Courtright, seconded by Councilman Sanders that the City request the Drdnnage District to start Stage 1 of the drainage southwest portion of old townsite according to the Drainage District map as presented by the Drainage District Commissioners. Motion passed 3 to 2. Councilman Ellis and Councilman Wasek opposed. A motion was made by Councilman Courtright, seconded by Councilman -- Ellis that the ditches on McLean Road from Mary's Creek south to the city limits be opened up and cleared, and that a letter be sent to the Drainage District confirming this request. Motion passed 5 to 0. A motion was made by Councilman Sanders, seconded by Councilman Wasek that the City Administrator work with the Drainage District to research the as -built drainage on the section of Westminister Drive between Westminister Subdivision and East Broadway, and report back to the Council at his earlies convenience any recommendations he might have. Motion passed 5 to 0. A motion was made by Councilman Courtright, seconded by Councilman Ellis that the City send the Drainage District a letter authorizing them to make an emergency cut on Walnut Street during the construction period in case it is need to alleviate drainage. Motion passed 5 to 0. Meeting recessed 9:40 P. M. - Reconvened 9:47 P. M. Lion's Club Turkey Shoot: A motion was made by Councilman Courtright, seconded by Councilman Wasek that the Lion's Club be given a permit for their Annual Turkey Shoot, with the City's best wishes of a successful and safe venture. Motion passed 5 to 0. Mobile Homes Ordinance: Mayor Keller read proposed ordinance in full. It was moved by Councilman Courtright, seconded by Councilman Sanders that ORDINANCE NO. 164 - captioned as follows be passed on the first of three readings, and that the Ordinance be posted on the City Hall bulletin board. ORDINANCE NO. 164 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, PROHIBITING MOBILE HOMES FROM ANY LOT, TRACT, OR PARCEL OF LAND NOT AUTHORIZED THEREFOR BY THE CITY OF PEARLAND; PROVIDING FOR AN PENALTY NOT TO EXCEED TWO HUNDRED (200.00) FOR EACH OFFENSE. -- Motion passed 5 to 0. Moving Walnut Street Sewer Line: Councilman Courtright made a motion that the following rules of order be adopted by the Council for discussion of the Walnut Street sewer line only: 1. Each Councilman and the Mayor will be allowed a maximum of 5 minutes to express their opinion. 89 2. No other person -will be allowed to speak, question or interrupt during this period. 3. Discussion will be limited solely to ,facts relevant to the question and comments about past actions or_ motivations of any individual, opinions or reasons for line location and other comments=of-a personality nature shall be considered out of order. 4. Any Councilman or the Mayor will then be allowed a maximum of 2 minutes rebuttal, at which time the floor will be open for any motion and vote will be take without further delay. Motion died for lack of a second. Councilman Ellis'' motion made at the previous meeting that we abandon consideration of the two plans to move the Walnut Street sewer line as follows: 1. 430 ft. South of Walnut Street, C. R. 104, F. M. 518 and Texas Avenue. 2. 430 ft. South of Walnut Street, Johnston Street, Texas Avenue and C. R. 104. was read by the Secretary. Motion died for lack of a second. I.t was moved by Councilman Sanders, seconded by Councilman Watson that after having considered all known face#ts of the proposition, that the Walnut Street trunk sewer in WPC TEX 455 be re-routed approximately w, 430 feet southward from its present designed location in Walnut Street provided only that satisfactory right-of-way negotiations can be consummated within one week for the rights-of-way required east of the termination of Addeline Street. The Administrators shall advise the Engineer and the Contractor of this decision and shall cause any operations which could conceivably be duplicated in the rerouting to be suspended. Immediately upon conclusion of the rights-of-way negotiation, the Administrator shall cause the Engineer to proceed with necessary engineering changes, shall submit such documents as necessary to the Federal Government Agencies and shall in all things expedite and correlate for the most expeditious conclusion of this matter, provided we can within this one week of right-of-way negotiations also obtain a letter from Mr. Fleming of the Texas Water Quality Board verifying - the conversation between Councilman Courtright and Mr. Fleming on 9/16/68 regarding approval of a change order. Councilman Courtright to obtain this letter from Mr. Fleming. Motion passed 3 to 2. Councilmen Ellis and Wasek opposed. Meeting adjourned by motion 10:45 P. M.
