Foster, Pastor of the First Baptist Church, Pearland, Texas. APPOINTMENT OF CITY SECRETARY: A motion was made by Councilman Sanders, seconded by Councilman Ellis that Dorothy L. Cook be appointed City Secretary replacing Councilman Ellis who has been temporarily serving in this capacity. Motion passed 5 to 0. Mayor Keller administered the'Oath of Office to Mrs. Cook, APPROVAL OF MINUTES: It was moved by Councilman Wasek, seconded by Councilman Watson that the minutes of the regular meeting held on April ll, 1968 by approved.. Motion passed 5 to 0. APPROVAL OF EXPENSES: It was moved by Councilman Sanders, seconded by Councilman Courtright that the Payroll Check List dated April 30, 1968 - Check No._-: X116 through Check No. 2143 inclusive, and Check List dated April 25, 1968 representing expenses and drawn of the General Fund - Check No. 3385 through 3402 inclusive, be approved. Motion passed 5 to 0. MAYOR t S ACTIVITY REPORT: 1. Mayor Keller reported that the railroad crossing on Broadway was in the process of being repaired. Copy of letter from W. E. Carmichael, District Engineer - Texas Highway Department to Mr. J. E. Eisemann, The Atchison, Topeka and Santa Fe Railway Company presented to City Secretary for the files. -j 2. Mayor Keller read a letter from Wayne D. Peterkin complementing Officer Norris on the pleasant and efficient manner that he carried out his job. Copy of letter presented to the City Secretary for the files. Mayor Keller requested copy of this letter also to be placed in Officer Norris' personnel file, 3. Mayor Keller reported that for the information of the Council a club called "Top Teens" had been organized. This organization is for youth 13 through 18 - 8th grade through 12th grade. Part of the program would be to have a "teen jury" and study local and state government operations. t(: Mayor Keller reported that he would meet -with Mr. Green of Morman, Mock& Green, Planning Consultants for the City regarding the Urban Planning Assistance Program for Pearland. COMMITTEE REPORTS: Twin Creek and Clear Creek Sewer Project:-, It was moved by- ,Councilman Elli's,'seconded"by Councilman Wasek that the City Engineer be Instructed to proceed with plans for the sewer r. system in Twin Creek Woods and Clear Creek Estates. Motion failed 3 to 2. Councilmen Sanders, Courtright and Watson opposed. Councilman -Sanders stated for the record that his reason for voting "no" on this matter was that we have not been assured of the plant location. Walnut Street, Shadycrest, Cree:kview and County Road 120 Sewer Line Project: It was moved by Councilman Courtright, seconded by Councilman Sanders that the action authorizing the awarding of a contract to Mainland Construction Company for sewer improvements' -on October 17, 1967 be withdrawn and subsequent action pertaining thereto. Motion passed 3 to 2. Councilmen Ellis and Wase:k opposed. Councilman Sanders stated for the record that our legal council advised that this action should be taken. j It was -moved by Councilman Ellis, seconded by Councilman Watson _ that the City Engineer and City Secretary be authorized to prepare bid documents for the extension of sewer services for the areas as described in the bids opened on September 7, 1967 and be pre- pared to advertise same upon notification by the Council. Motion passed 5 to 0. TWIN CREEK WOODS AND CLEAR CREEK ESTATES WATER LINES: 6 io Councilman Vasek reported that water lines in Twin Creek 'goods cost to original lots purchaser $1.50 per foot, however, he had been unable to locate a plat showing the location of the lines in this subdivision. Councilman Wasek -presented lot purchaser's agreement and Mayor Keller recommended that this be passed to the City Attorney for analysis and study. Meeting recessed 8:43 P. M. for Executive Session - (Personnel) Meeting reconvened 9:01 P. M. CITIZENS: 1. Mr. Robert E. Cleary requested that his name be removed from the agenda. 2. R. B. Willman appeared before the Council and presented a petition to the Mayor and Council as follows: City Council of Pearland Pe arl ani., Texas Dear Sirs: We, the undersigned, Taxpayers, landowners, and residents of the Ryan Acres Subdivision in Pearland, Texas do hereby wish to notify the City Council that we do not wish to have city water lines brought into our subdivision. We also wish to express our opposition to the city ordinance requiring hookup to the city water lines when they are brought within two hundred feet of a residence. This ordinance will cause great additional expense and inconvenience to existing residents who have already spent fifteen hundred to two thousand dollars to drill a well because city services were not available. To require abandonment of this existing capital investment is, we feel, neither right nor legal. Mr. Willman stated that the petition was signed by 100% of the residents of Ryan Acres Subdivision. This petition received by the Council April 25, 1968. ORDINANCE - NO PARKING BETWEEN TEXAS AND PARK ON ' BROADWAY: Mayor Keller read the proposed ordinance in full and Councilman Courtright moved that this ordinance be approved on first reading. Seconded by Councilman Ellis. Said Ordinance reading in the caption as follows: AN ORDINANCE ESTABLISHING N0_2PARKING ,AT ANY TIME ON CERTAIN PUBLIC ROADS AND STREETS, -BASED UPON A TRAFFIC INVESTIGATION ON CERTAIN STREETS AND HIGHWAYS AND PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND, AS SET OUT IN THIS ORDINANCE; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200 FOR THE VIOLATION OF THIS ORDINANCE. Motion passed 5 to 0. 11 Tt was moved by Councilman Sanders, seconded by Councilman Courtright that a copy of this proposed ordinance be mailed or delivered to each business fronting within this area on Broadway between Texas Avenue and Park Avenue. Motion carried 5 to 0. CITY OF PEARLAND vs JAMES C. YOUNG: A motion was made by Councilman Wasek, seconded by Councilman Sanders that Attorney Jack Harrison et al be authorized to proceed with rr- the Writ or Error to the Texas Supreme Court in the case of the I City of Pearland vs James C. Young, and authorize an expenditure not v' to exceed $500.00 in this cause. Motion carried 5 to 0. ................. GARBAGE DUMP BANK NOTE: It was moved by Councilman Sanders, seconded by Councilman Courtright that Bank Note #9108 in the amount of $5500.00, and Bank Note #110 in the amount of $8250.00, held by the' Pearland State Bank and -cover- ing 30 acre garbage dump site be renewed for one year. Harris for review, tabulation and recommendation. Motion passed 5 to 0. RESURRECTION CEMETERY: It was moved by Councilman Sanders, seconded by Cpuncilman Watson that 40nacres, .known as Tract 63,69,62,68,93 and 94 - HT BRR A-542 be removed from the tax roll since it is officially dedicated as a cemetery and exempt by state law. Motion passed 5 to 0. ODOR IN SH,A.DYCREST SUBDIVISION: Councilman Wasek made the recommendation that the odor in Shadycrest Subdivision be referred to the City Health Officer, Dr. Armbruster for investigation. D. 1968, the City Council of the City of Pearland, Brazoria County, Texas, convened in a regular session at the City Hall Annex in.the City of Pearland, Texas, with the following members present: D. R_. Keller, Mayor Gene E. Sanders, Councilman. E. A. Wasek, Councilman Dale Watson, Councilman A. G. Ellis, Councilman with -the following members absent: None - B. J Courtright, Councilman constituting a quorum, at which the following proceedings were had and heldz Councilman Courtright introduced a resolution that it be made a matter of record that the majority of the governing body feels that it would be in the best interest of the City of Pearland's citizens and facilitate the flow of traffic from the Pearland-Friends- wood areas into the Houston metropolitan area for Dixie Farm Road to be opened and improved from F.M. 518 to Ellington Field overpass. Seconded by Councilman Sanders. PASSED AND APPROVED THIS THE 25 day oP April A. D. 1968. It was moved by Councilman Sanders, seconded by Councilman Wasek that Check No. 189 in the amount of $7,507.35, drawn on the Construction Fund and made payable to William C. Walsh, for Pre- liminary and Design Phase - Twin Creek Woods and Clear Creek Estate Sewer Facilities, be approved. Motion passed 5 to 0. PERS CANNEL : It was moved by Councilman Sanders, seconded by Councilman Wasek that the following salary adjustments be made effective 4/15/68, and the budget is hereby amended accordingly.
