APPROVAL OF MINUTES: 'It was moved by Councilman Sanders, seconded by Councilman Ellis that the minutes of regular meeting held March 28, 1968 be approved. Motion passed 5 to 0. CANVASSING RESULTS OF BOND ELECTION: Mayor Keller introduced Mrs. Josie Heflin and Mrs. Jack Miller, the Election Judge and Assistant Election Judge, and read the following results of the bond election which was confirmed by the Election Judges present. BOND ELECTION HELD APRIL 6, 1968: PROPOSITION NO, ONE FOR THE ISSUANCE OF $400,000 SANITARY SEWER SYSTEM BONDS 539 votes AGAINST THE ISSUANCE OF 4001000 SANITARY SEWER SYSTEM BONDS 331 votes PROPOSITION NO. TWO FOR THE ISSUANCE OF 2002000 WATERWORKS SYSTEM BONDS AGAINST THE ISSUANCE OF $200,000 WATERWORKS SYSTEM BONDS PROPOSITI -ON N0. ;TBREE FOR THE ISSUANCE OF $125,000 .� MUNICIPAL AND FIRE STATION BUILDING BONDS AGAINST THE ISSUANCE OF $125,000 MUNICIPAL AND FIRE STATION BUILDING BONDS 497 votes 338 votes 579 votes 283 votes A proposed ordinance was read in.full canvassing the election results. It was moved by Councilman Wasek, seconded by Councilman Ellis to adopt Ordinance No. 155 on first and final reading captioned as follows: RESOLUTION CANVASSING RETURNS AND DECMTIM RESULTSOF RTMCTION Motion Passed 5 to 0. CITY OFFICIAL AND SPECIAL PURPOSE ELECTION: r Mayor Keller read the results of the City Official and Special Purpose Election as follows: MAYOR D. R. Kehler 765 votes FOR COUNCILMAN (Two) Sidney I. Barfield 222 votes Ray C. Corder 338 votes Joe T. Price` 275 votes Aubrey G. Ellis 557 votes E. A. Wasek 457 votes PROPOSITIONS 1. One percent (1%) City Sale's Tax, with proceeds to be designated for use in street` repair, y maintenance.and construction and support of the Police Department operations. For 515 votes Against 371 vot.s 2. Sale of land: The approximate thirty acre garbage disposal site may be sold or traded by publicly offered bids at Council discretion. Proceeds to be used for street repair and maintenance after retirement of 13,750.00 indebtness against land 11 and defraying costs of sale or for purchase of other garbage disposal site. For 375 votes Against 501 votes 3. Sale of old sewer plant site: The approximate five acre, old sewer plant site,emay be sold at Council discretion by publicly offered bid. Proceeds to be used to repair and maintain streets or for purchase of other garbage disposal site. For 414 votes Against 449 votes 4. Salaries - Mayor and City Council: Effective October 1, 1968, the following salaries for elected city officials will be authorized: Mayor $100.00 Monthly Councilman 75.00 Monthly For 466 votes Against 412 votes A proposed ordinance was read in full canvassing the results of the City Official and Special Purpose Election, excluding the Sales and Use Tax Election. It was moved by Councilman Watson, seconded by Councilman Sanders that Ordinance No. 156 be adopted on first and final reading captioned as follows: AN ORDINANCE CANVASSING RETURNS AND DECLARING RESULTS OF CITY OFFICIAL AND SPECIAL PURPOSE ELECTION HELD IN THE CITY OF PEARLAND, TEXAS, AND SUSPENDING RULES REQUIRING ORDINANCE TO BE READ UPON THREE SEPARATE DAYS. Motion passed 5 to 0. CITY SALES AND USE TAX ELECTION: After a proposed ordinance was read in full, it was moved by Councilman Watson, seconded by Councilman Wasek that Ordinance No. 157 be adopted on first and final reading captioned as Follows: AN ORDINANCE DECLARING RESULT OF ELECTION FOR LOCAL SALES AND.USE TAX, ORDERING THAT SAID TAX BE IMPOSED, INSTRUCTING CITY SECRETARY TG FORWARD CERTIFIED COPY OF THIS ORDINANCE AND MAF TO COMPTROLLER OF PUBLIC ACCOUNTS, AND SUSPENDING RULES REQUIRING ORDINANCE TO BE READ UPON THREE SEPARATE DAYS. Motion passed 5 to 0. ....... ....... OATH OF OFFICE: Judge Alton C. Arnold, Brazoria .County Judge, was introduced - and administered the Oath of Office to Mayor elect'D. R. Keller. Mayor Keller administered the Oath of Office to Councilman elect E. A. Wasek and Aubrey G. Ellis. City Administrator presented Certificated of Election to Mayor Keller, Councilman Ellis and Councilman Wasek. APPROVAL OF EXPENSES: man It was moved by Councilman Sanders, seconded by Council/Wasek that the Check List for the payroll dated April 15, 1968 which includes Checks 2089 through 2115, and expenses represented by Check List dated April 11, 1968 which includes Checks Nos. 3319 through 3384, with the exception of Check No. 3346, be approved. AUTHORIZATION TO -SELL BONDS: It was moved by Councilman Ellis, seconded by Councilman Court - right that the City Council instruct our Financial Agents, the firm of Underwood, Neuhaus,& Company, to proceed immediately r with preparation of ordinances, resolutions, advertising notices and whatever else might be necessary to proceed with the sale of all unsold city bonds as follows: $400,000.00 Sewer Bonds 200,000.00 Water Bonds 125,000.00 Municipal Building Equipment Bonds Motion passed 5 to 0. SANITARY SEWER CONTRACT WITH MAINLAND CONSTRUCTION COMPANY: It was moved by Councilman Ellis, seconded by Councilman Watson v that the Mayor be authorized to sign the contract with Mainland Construction Company in the amount of $490,213.86, in -order -to proceed with the construction of the sewer line pursuant to the satisfaction of our Bonding Attorney that we may legally proceed with the contract at this time. Motion passed 5 to 0. 6 WATER LINES IN TWIN CREEK WOODS AND CLEAR CREEK ESTATES: It was moved by Councilman Sanders, seconded by Councilman Wasek that the City contact the interested parties involved in the ownership and operation of the water systems in Twin Creek Woods and Clear Creek Estates with the objective of acquiring systems at the lowest possible and equitable cost to the City. Motion passed 5 to 0. Mayor Keller appointed Councilmen Watson and Wasek to a Committee to work on this recommendation. RESIGNATION CITY ADMINISTRATOR: Mayor Keller read a letter of resignation dated April 10, 1968. it The Honorable Mayor and City Council City of Pearland P. 0. Box 157 Pearland, Texas Gentlemen: I hereby submit in writing, confirmation of my verbal resignation made to the City Council on February 15, 1968 as City Administrator and City Secretary of the City of Pearland. Near the first of February, I had determined that it would be necessary for me to move to Arkansas to take care of my financial interests. I apologize for having to leave so soon after by being employed here. If I had known of this prior to my employment, I would not have accepted this position. I will be leaving here with deep regrets. In my short stay I have grown to love the people here. I am deeply indebted to the employees of the City as their cooperative and helpful attitude has helped me greatly in carrying out my duties. I could not have asked for a finer Council to work for. You have treated me with the utmost respect and confidence. I feel that with this type of relationship, my successor will be able to provide a valuable service to you and the City of Pearland. Yours very truly, /sl Jerry D. Henderson" It was moved by Councilman Courtright, seconded by Councilman Sanders that the resignation be accepted with regret effective April 13, 1968. Motion passed 5 to 0. CITIZENS• Mr. John Soland was recognized and read a letter to the City Council expressing the appreciation of the residents of Circle Park, Mimosa Acres and Willowcrest for the improvements that have been made to Cherry Street, and requested that the City Council proceed with hard -surfacing, Cherry Street as.,toon as possible. Mrs. Francis Jamison was recognized and Mayor Keller read an open .letter to Mrs. Jamison in answer to previous questions stating that the 5% interest bearing time warrants were assigned, not sold", to a financial firm to satisfy contractorts claims on water improvements. and that the matter would mot -be -discussed while the Council was in session. The letter was filed for record with the City Secretary. Mayor Keller called a Specil Cpuncil Meeting to be held April 18, 1968 at 7:30 P. -M. to'- conduct- `whatever business ' that might come before the City Council.. It was moved by Councilman Sanders, seconded by Councilman Courtright that from this time until further Council action that regular meetings be held on- the: fir)t four Thursdays of each month.
