A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING A CONTRACT FOR ENGINEERING SERVICES
ASSOCIATED WITH THE MAGNOLIA ROAD SEWER IMPROVEMENTS
(SEGMENT 4).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain amended contract for engineering services associated
with the Magnolia Road Sewer Improvements, a copy of which is attached hereto as
Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest an amended contract for engineering services associated
with the Magnolia Road Sewer Improvements.

STANDARD AMENDMENT TO
ENGINEERING SERVICES AGREEMENT
R2007 -44

This Amendment (hereinafter "Amendment") is made between the City of
Pearland, Texas (hereinafter "City"), and Cobb Fendley & Associates (hereinafter
"Consultant") to amend that consultant services contract (the "Contract") between the
City and the Consultant for Design Engineering Services in connection with the design
of a 24-inch gravity sanitary sewer line along the proposed Magnolia Road alignment to
allow the city to decommission two sanitary sewer lift stations in the West Oaks Village
and West Oaks subdivision, project number T70041 (P.O. 052620). See Exhibit A,
attached, for a detailed SCOPE OF WORK and PROJECT schedule. The PROJECT
schedule shall be submitted in digital and hard copy form in the Microsoft Project for
Windows format.
1. Amended Terms. The Consultant hereby agree that the Contract is amended as
follows:
A. Increase Maximum Contract Amount From $403,920.00 to $500,920.00; an
increase of $97,000.00.
B. The above amended amount is a lump sum fee for additional services not added
to original contract.
2. Contract to Remain in Force. Other than the provisions of the Contract expressly
amended herein, the Contract shall remain in full force and its enforceability shall be
unaffected by this Amendment.

Proposal for Professional Engineering Services (Revised)
Dear Ms. Brinkley:
Cobb, Fendley & Associates, Inc. (CFA) is pleased to present this proposal to perform
professional engineering services in connection for the design of a 24-inch gravity sanitary
sewer line along the proposed Magnolia Road alignment from Harkey Road to FM 1128,
and for two 12-inch gravity sanitary sewer lines north of the proposed alignment. The
addition of the 12-inch lines will allow for the decommissioning of two existing lift stations,
and will convey flows south to the proposed 24-inch sewer.
It is our understanding that this project will be included as an "add-alternate" into the bid
set for the Magnolia Road project. This proposal is to prepare only the necessary
drawings for the wastewater portion of the project. It does not include the preparation of
any details, general' construction plans, or specifications, other than those not already
included in the Magnolia Road construction documents. If the City decides to bid the
sanitary sewer line addition project as a stand-alone project, then we will request
additional funds to prepare the full set of plans and specifications.
Scope of Services
The specific tasks to be performed in conjunction with this project are outlined in Exhibit A.
Please note that the scope of services does not include research or development of plans,
specifications or cost estimates for construction methods other than conventional open-cut
construction with well pointing dewatering methods. "Additional Services" are presented
in Exhibit "A", and will be provided if requested and/or authorized by the City.
Preliminary Construction Estimate
The construction of this addition to the project is expected to cost approximately
$1,539,000. A construction cost estimate is included in Exhibit B.
Schedule
CFA can begin work on this project immediately upon receipt of notice to proceed. Due to
the fact that this project will be included in the Magnolia bid, this will be on a fast~track

schedule. The current schedule calls for the Magnolia project to be advertised this spring.
We will expedite our design services in order to meet this aggressive schedule. We
expect to complete the design within six (6) weeks after receipt of the topographic survey,
excluding the time for City reviews.
Compensation
The total requested fee for the professional engineering Basic Services described in
Exhibit A is $97,000.00, including all allowances and contingency items.
We propose to perform the Basic Services for a lump sum fee. We propose to perform
any Additional Services on a reimbursable basis, due to the fact that we cannot accurately
anticipate the labor effort that may be required. The labor effort for any Additional
Services will be paid for according to the hourly fee schedule shown in Exhibit C.

Scope of Services
Basic Services
1. Prepare plans and specifications for new 24~inch and 12-inch sanitary sewer lines,
under the assumption that conventional open-cut construction methods and well
pointing dewatering systems will be possible. Our scope will include the sewer line
design along the proposed Magnolia Road alignment from Harkey Road to FM 1128,
and for two 12-inch lines perpendicular to Magnolia: one between English Oaks and
West Oaks, and the other between Keithwood Circle and Autumn Forest Drive.
2. Prepare and submit review sets at 50 and 90 percent complete. The documents to
be submitted for each review submittal is listed below:

It is anticipated that the City's review of each design submittal will take two (2) weeks
to complete.
3. Prepare quantity take-ofts and construction cost estimates for each review submittal.
4. Attend monthly design progress meetings.
5. Prepare applications for all necessary permits within our project limits. This does not
include any wetlands permits, if necessary.
6. Assist the City in Bidding Phase services. This includes attending the Pre-Bid
Conference, preparing any necessary addenda, preparing the Bid Tab, reviewing the
bids, and making a recommendation to award. If an addendum is necessary due to
a situation outside of our control, such as a change in scope, then additional funds
may be requested.
7. Assist the City in Limited Construction Phase Services. This includes attending the
Pre-Construction Conference, reviewing shop drawing submittals, and responding to
requests for information (RFls).

Assumptions and Exclusions
1. This project will be included as an "add-alternate" into the Magnolia construction
package. If the City decides to bid the sanitary sewer line addition portion of the
project separately, then additional funds will be required to prepare a full set of plans
and specifications.
2. CFA will not be responsible for preparing the base sheets for the existing
topographic plan or profile. This information will be provided by the City.
3. It is anticipated that the City will take approximately two (2) weeks to perform each
interim review submittal. If that time is exceeded, it may have an impact on the
overall schedule and design fee.
4. Platting for any easements or rights-of-way, if necessary, wilt be performed by
others.
5. Fee estimate does not include any fees for required permits. These fees will be paid
for by the City.
Additional Services {to be provided only if requested and authorized by Client)
As a result of the preliminary nature of the knowledge associated with the project site
development issues, Cobb Fendley may perform the services listed below if required,
and only if requested and authorized by the Client by execution of a Supplement to the
Original Agreement.
1. In the event that conventional open-cut construction and/or well pOint dewatering
methods are not feasible for the design and construction of this project, Cobb
Fendley will investigate the means and costs associated with alternative
methods. and will make the appropriate additions and modifications to the plans,
specifications, and cost estimates. .
2. Any other services not identified above as a Basic Service which is found to be
required or desirable for the development of the project.
