TEXAS VE UE, E ND, EX S. A regular meeting of the City Council of the City of Pearland was called to order by Mayor Keller with the following present: Mayor D. R. Keller Councilman Cecil W. Griffin Councilman E. A. Wasek Councilman James 0. DeShazer Councilman Carlton McComb Councilman Benny J. Frank City Manager William E. Wolff City Attorney Bobby J. Williams City Secretary Dorothy L. Cook T••11IAMIITTA.1 The invocation was given by Council Chaplain Forrest Hawkins. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by City Attorney Bobby Williams. 4 APPROVAL OF MINUTES: It was moved by Councilman DeShazer, seconded by Councilman McComb that the minutes of the regular meeting held on July 12, 1971 be approved as submitted. Motion passed 5 to 0. APPROVAL OF EXPENSES: It was moved by Councilman Wasek, seconded by Councilman Frank that the following checks be approved for payment: 1 General Fund Payroll Water & Sewer Payroll General Fund Expenditures Water & Sewer Expenditures 4799 through 4801 4808 through 4842 4802 _.through 4807 4843 through 4858 3114 through 3145 5134 through 5151 (Check No. 5135 and 5150 void) Sewer Construction Fund 183 through 184 Interest & Sinking Fund 74 Motion passed 5 to 0. MAYOR'S ACTIVITY REPORT: 1. Mayor Keller read a letter from the Eagle Transport Company commending the Volunteer Fire Department, Police Department and the City Manager for the handling of a fire as a result of accident of one of their trucks. 2. Mayor Keller reported that Joe Bryant, one of the City's police officers was in the Southeast Baptist Memorial Hospital. Mr. Bryant was severly beaten by three unidentified individuals after he had stopped their car. COMMITTEE REPORTS: Commemorative Plaque - r-- This item to be handled at a later time in the meeting. UNFINISHED BUSINESS: SECOND AND FINAL READING - ORDINANCE NO. 219 - GROSS RECEIPTS - COMMUNITY PUBLIC SERVICE Proposed Ordinance No. 2.19 was read in full by Mayor Keller. It was moved by Councilman McComb, seconded by Councilman Griffin that Ordinance No. 219 be passed, approved and adopted on second and final reading. Said Ordinance No. 219 reads in caption as follows: ORDINANCE NO. 219 AN ORDINANCE PROVIDING FOR PAYMENTS TO THE CITY BY r— COMMUNITY PUBLIC SERVICE COMPANY, A PUBLIC UTILITY ENGAGED IN THE SALE OF ELECTRICITY, AS COMPENSATION FOR THE USE AND OCCUPANCY OF PUBLIC ROADS, HIGHWAYS, STREETS, LANES, ALLEYS, UTILITY EASEMENTS AND PUBLIC PLACES OF THE CITY; REGULATING THE USE OF STREETS BY SUCH UTILITY AND THE REPAIR AND RESTORATION OF THE STREETS DISTURBED BY CONSTRUCTION; PROVIDING FOR FIRST CLASS SERVICE FOR THE CUSTOMERS OF SUCH UTILITY AS PROVIDED BY ITS RATE SCHEDULES EXCEPT UNDER CONDITIONS BEYOND THE UTILITY'S CONTROL; PROVIDING FOR THE TEMPORARY REMOVAL, RAISING AND LOWERING OF WIRES AND OTHER APPURTENANCES AND ESTABLISHING STANDARDS FOR THEIR CONSTRUCTION; PROVIDING FOR INDEMNITY BY SUCH UTILITY TO THE CITY; RESERVING ALL POWERS OF REGULATION; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; 240 AND MAKING MISCELLANEOUS PROVISIONS RELATIVE TO THE FOREGOING MATTERS. Voting "aye" - Councilman Frank, Councilman Wasek, Councilman McComb, Councilman DeShazer, and Councilman Griffin. Voting "no" - None COMMITTEE REPORTS - Motion passed 5 to 0. Councilman DeShazer presented Chief Norris with the Plaque to commemorate police officers killed in line of duty. on behalf of the Police Department. UNFINISHED BUSINESS - CONTINUED: Chief Norris thanked the Council for the Plaque Plaque to be placed in the Council Chambers. Meeting recessed 8:05 P. M. - Reconvened at 8:20 P. M. FIRST READING - WATER RATE ORDINANCE: Proposed Water Rate Ordinance read in full by Mayor Keller. A discussion was held regarding various sections of this proposed ordinance. It was moved by Councilman Griffin, seconded by Councilman McComb that prdlnance No. 220 be passed and approved on first reading. Caption of Ordinance No. 220 reads as follows: ORDINANCE NO. 220 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS ESTABLISHING RATES OR CHARGES FOR WATER SERVICES FURNISHED BY THE CITY; CONTAINING OTHER REGULATORY PROVISIONS RELATING TO THE CITY WATER SYSTEM; REPEALING ALL LAWS IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. Voting "aye" - Councilman Frank, Councilman Wasek, Councilman McComb, Councilman DeShazer, and Councilman Griffin. Voting "no" - none Motion passed 5 to 0. NEW BUSINESS: r— 241 FINAL APPROVAL OF SECTION III - CORRIGAN ADDITION: To be placed on the next Agenda, not yet complete. CITY MANAGER'S ITEMS: REPORT ON PROPOSED BUDGET 1971-72: City Manager Wolff requested that a Special Meeting be called by the Council on July 30, 1971 to receive the proposed budget for the fiscal year 1971-72. Mayor Keller, with the consent of the City Council, called a Special Council Meeting for July 30, 1971 to receive the proposed budget for the fiscal year 1971-72. RELEASE OF SEWER LINE EASEMENT - PEARLAND INDEPENDENT SCHOOL DISTRICT AND ST. HELEN'S CATHOLIC CHURCH: The City Council discussed the Release of Easement and it was decided that the Release of Easement would be executed after the completion of the new line. New Easement Deeds have been prepared to be executed by the School and the Catholic Church. ADJOURN: It was moved by Councilman Frank, seconded by Councilman DeShazer that the meeting adjourn.
