PEARLAND. TEXAS. A regular meeting of the City Council of the City of Pearland was called to order by Mayor Keller with the following present: Absent: INVOCATION: Mayor Councilman Councilman Councilman Councilman City Administrator City Attorney City Secretary Councilman D. R. Keller Carlton McComb Melvin L. Black E. A. Wasek James 0. DeShazer William E. Wolff Bobby Williams Dorothy L. Cook Cecil W. Griffin The invocation was given by City Attorney Bobby Williams. APPROVAL OF MINUTES: It was moved by Councilman McComb, seconded by Councilman DeShazer that the minutes of the regular meeting held on August 24, 1970 be approved as submitted. Motion passed 4 to 0. APPROVAL OF EXPENSES: It was moved by Councilman Black, seconded by Councilman Wasek that the following checks be approved for payment: Water & Sewgr Payroll Water & Sewer Payroll General Fund Payroll General Fund Expenses Water & Sewer Expenses Sewer Construction Fund Interest & Sinking Fund Water Construction Fund Building Construction Fund Motion passed 4 to 0. MAYOR'S ACTIVITY REPORT: 1. Firemen's Plaque: No. 3662 through No. 3665 No. 3669 through No. 3712 No. 3666 through No. 3698 No. 2000 through No. 2077 No. 4617 through No. 4663 (4639 void) No. 160 through No. 163 No. 64 through No. 65 No. 222 No. 22 113 Mayor Keller reported that the Fire Department has selected a memorial plaque to be placed in the main Fire Station and he requested the Council consider duplicating this plaque and placing it in the City Hall building. The cost to be approximately 25.00. r— It was moved by Councilman Black, seconded by Councilman E DeShazer that the City Administrator be authorized to spend the appropriate money to duplicate the Firemen's Memorial Plaque. This Plaque to be placed in the City Hall building. Motion passed 4 to 0. Mayor Keller appointed a'Committee of Councilman Black and Councilman DeShazer to devise a similar plaque for members of the Police Department lost in service of the City. It was moved by Councilman DeShazer, seconded by Councilman McComb that the City allow the widows of the deceased members of the Pearland Volunteer Fire -Department and the Reserve Police who die in line of duty„while serving.such volunteer or a izati n, the minimum atner ra�e, sewage rate, and garbage rate as long as these utilities are operated by the City, and as long as the widow resides within the City. Motion passed 4 to 0- 2. Proclamation - V. F. W. Freedom Signature Week Mayor Keller proclaimed the week of September 20-26, 1970 as "V. F. W. Freedom Signature Week” iR the City of Pearland. COMMITTEE REPORTS: Building Committee: Councilman DeShazer reported that the City Hall building would possibly be ready for occupancy the first week in October. Park Committee: Councilman Black reported that the Park Committee met with Mr. Barlow and the park site at Sewer 191ant 2 should be available for public use as a picnic site within the next two weeks. Councilman Black stated that the City needed some publicity regarding interested persons serving on the Park Board. Auxiliary Police Committee: Councilman DeShazer reported that the Committee assigned to draft an 114 ordinance covering the Auxiliary Police had no activity to report at this time. CITIZENS• Mr. A. Charles Schupp Mr. Schupp appeared before the Council and requested information regarding the City's request for a review of the customer rate charges by Southwestern Bell Telephone Company. Mayor Keller stated that he had discussed this matter with the Telephone Company and they advised him that they were working on this. OLD BUSINESS: DISCUSSION OF TEXAS WATER QUALITY BOARD ORDER NO. 69-9A: Mayor Keller reported that the City of Pearland was directed to appear in Austin on August 28, 1970 to show cause why its Waste Water Permits should not be amended to comply with 69-9A - Board Order of the Texas Water Quality Board. Mayor Keller reported that the essence of this order is that the City of Pearland has until October 1, 1970 to provide the Water Quality Board with evidence that it proposes to either' divert its waste into another water shed, combine its waste with some other entity, totally contain its wastes so that no discharge will be made, or provide tertiary or advanced waste treatment as per this order. Mayor Keller stated that he has sent a letter to the Governor regarding the conduct of the Hearing on August 28, 1970• A reply has been received stating the Governor will secure a transcript of the meeting and advise the Mayor further MEETING RECESSED 6:35 P. M. - RECONVENED 8:37 P. M. It was moved by Councilman McComb, seconded by Councilman Wasek that we advise the Texas Water Quality Board that we have chosen tertiary treatment as the route to go with an addendum endorsing the activities of the Gulf Coast Waste Disposal Authority and the route they are taking. Motion passed 4 to 0. NEW BUSINESS: SUN PROGRESS CONTRACT - 10/1/70: It was moved by Councilman Black, seconded by Councilman McComb that the Sun Progress be named as the official newspaper of the City of Pearland for the fiscal year 1970 and the Mayor be authorized to execute the contract. Motion passed 4 to 0. DISCUSSION OF MUNICIPAL BONDS Mayor Keller read a letter from Mr. R. N. Eddleman, Vice President of Underwood, Neuhaus & Company - Fiscal Agents for the City regarding r� reissuance of $20,000 Series 1968 - General Obligation Bonds 10 through 13, inclusive, lost in the mail between Austin and -San Antonio, Texas. Mayor Keller absent from the Chair at 9:05 P. M. - Mayor Pro Tem Wasek presiding. It was moved by Councilman McComb, seconded by Councilman DeShazer that action on the request to reissue bonds be postponed until the next regular Council meeting. Motion passed 4 to 0. PEARLAND VOLUNTEER FIRE DEPARTMENT: Mayor Keller returned to Chair 9:10 P. M. It was moved by Councilman McComb, seoonded by Councilman DeShazer that the following certification be made to Mr. Luke E. Robinson, Retirement Claims Officer, Employees Retirement System of Texas. STATE OF TEXAS I COUNTY OF BRAZORIA KNOW ALL MEN BY THESE PRESENTS: WE, the undersigned duly elected officials of the City of Pearland, a municipal corporation of the Counties of Brazoria d.nd Harris, do hereby certify that the Volunteer Fire Department of the City of Pearland meet each and every defined standard as set forth in Article 6628f, Section 2, Subsection 6 of Vernons Annotated Civil Statutes, as amended, and in support of this certification present the following, to wit: 1. Active members, inside and outside Pearland City limits - Forty-three (43). 2. Fire Department minutes reflect two drills each month, r' each being a minimum of two hours. Department submits quarterly reports to Insurance Board in Austin on drill time per month. 3. Fire Department minutes reflect that since 1960 a majority of active minutes were present at each meeting. 4. The volunteer members serve without pay for work performed. Cook, City Secretary RECONSIDERATION OF PREVIOUS MOTION - MUNICIP'AL BONDS: It was moved by Councilman McComb, seconded by Councilman DeShazer that the previous motion regarding municipal bonds be reconsidered at this time. Motion passed 4 to 0. It was moved by Councilman McComb, seconded by Councilman DeShazer that the motion be amended to consider reissuance of bonds at the next regular or a special meeting. Motion passed 4 to 0. CITY ADMINISTRATOR'S ITEMS: Release & Quitclaim - N. M. McGlathery City Administrator Wolff advised the Council that Mr. McGlathery had signed a Release & Quitclaim for 500.00 which was his part of an Agreement with the Brazoria County Water Control and Improvement District dated December 23, 1963. Police Patrol Units: City Administrator requested permission to bid for two police patrol units, with or without trade-ins, to be opened the first meeting in October.
