MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING
AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 13,
1996, AT 6:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE,
PEARLAND, TEXAS
The hearing was called to order with the following present:

PURPOSE OF THE HEARING: Application No. 63
REQUEST OF BILLY DON PIERSON, AGENT FOR FIRST ASSEMBLY OF
GOD OF PEARLAND, OWNER, FOR AN AMENDMENT TO THE LAND USE
AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY FROM
CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO SINGLE
FAMILY DISTRICT (R-1) ON THE FOLLOWING DESCRIBED PROPERTY,
TO -WIT:
1.90 ACRES OF LAND SITUATED IN LOTS ONE (1) AND TWO (2), BLOCK
THREE (3), SKYWAY MANOR SUBDIVISION, BEING A SUBDIVISION OF
68.24 ACRES OUT OF THE WEST HALF OF THE NORTHWEST ONE-
QUARTER OF SECTION 15, H.T. & B. R.R. CO. SURVEY, ABSTRACT 241,
BRAZORIA COUNTY, TEXAS (14706 PIPER ROAD).

STAFF REVIEW:
Assistant City Manager Richard Burdine reviewed a map of the area and described the
property involved in the proposed request. He pointed out that this property is in the
area annexed into the City last December. Mr. Burdine also explained that the following
Specific Use request was for the same property which would be to allow the building of
a church, and noted that the two applications go together.
PERSONS WISHING TO SPEAK IN SUPPORT:
Billy Pierson - 13445 Max Road, Space F. Mr. Pierson, who is the Pastor of First
Assembly of God of Pearland, spoke on behalf of the church and their requests
for the rezoning of this property and the building of a church on this property.

DEVELOPMENT ORDINANCE OF SAID CITY FOR A SPECIFIC USE PERMIT TO
ALLOW FOR A CHURCH TO BE BUILT IN A SINGLE FAMILY DWELLING
DISTRICT (R-1) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT:

STAFF REVIEW:
Mayor Reid reviewed the area involved in the proposed specific use request, which was
the same as the area in the zone apalication.
PERSONS WISHING TO SPEAK IN SUPPORT:
Billy Don Pierson - 13445 Max Road, Space F, representing First Assembly of God
Church. Mr. Pierson addressed Council with regard to the proposed request
which is to be allowed to build a church on the described property.

PERSONS WISHING TO SPEAK AGAINST:
1. Melvin Dilling - M.D. Cryogenics and Dilling & Dilling. Mr. Dilling stated that he
was in opposition of this church being built on this property because he has
applied for a state storage lot license. According to the state, he noted that he
cannot have his storage lot within a certain distance from a church.
QUESTION AND ANSWER PERIOD
Question was asked with regard to the direction the door would face, and Pastor Pierson
stated that the door would face Piper Road.
Councilmember Weber asked Mr. Dilling what type of license he had applied for, and Mr.
Dilling replied that it was a storage lot license which is to hold vehicles which are
impounded due to auto accidents, repossessions, confiscations, etc.
The question was also raised with regard to whether Mr. Dilling's property was zoned for
the purpose he has requested a license for, and Assistant City Manager Burdine replied
that it was not.

The hearing for Specific Use No. 41 adjourned at 6:20 P. M.
Mayor Reid announced that after the next public hearing for a zoning change is
adjourned, the Planning & Zoning Commission would retire to the Second Floor
Conference Room to further discuss and address these issues, and the public is invited.
PURPOSE OF THE HEARING: Application No. 64
REQUEST OF SWANELLE SPRADLEY, AGENT FOR TED K. SPRADLEY, OWNER,
FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT
ORDINANCE OF SAID CITY FROM CLASSIFICATION SUBURBAN DEVELOPMENT
RESIDENTIAL DISTRICT, INDUSTRIAL COMPATIBLE (SD -1) TO HEAVY
INDUSTRIAL DISTRICT (M-2) ON THE FOLLOWING DESCRIBED PROPERTY, TO -
WIT:
14.0513 ACRES OF LAND, BEING ALL OF LOTS 9 & 12 AND PART OF
LOT 7 OF PARTITION OF EAST'/2 OF THE NORTHWEST '/a OF SECTION
15, H.T. & B.R.R. CO. SURVEY, A-241, BRAZORIA COUNTY, TEXAS,
ACCORDING TO THE PLAT RECORDED IN VOL. 441, PG. 265 OF THE
DEED RECORDS OF BRAZORIA COUNTY, TEXAS (6906 BROADWAY)
STAFF REVIEW:
Assistant City Manager Richard Burdine reviewed the area involved in the proposed
request. After consultation with City Attorney Amy McCullough, Mr. Burdine explained
that part of the property involved (Lot 8) had been left off of the property description;
therefore, it was his recommendation that this item be tabled until this could be
corrected. He stated that this item would be republished in the paper, notices sent out,
and a new public hearing would be set.
PERSONS WISHING TO SPEAK IN SUPPORT:
Swanelle Spradley - 211 W. Edgewood, Friendswood, Tx. Ms. Spradley came
before Council to note that she had originally requested that Lot 8 be included as
noted on the application; however, someone had scratched it off, therefore she
did not feel that she should be penalized by having to wait another month or so
before coming before the Council to address this matter.
Mr. Burdine explained that the Council could not further discuss this request as it was
incorrect and recommended tabling of this item.
