1996-05-06 CITY COUNCIL SPECIAL MEETING MINUTES207 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 6, 1996, AT 7:30 P. M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Tom Reid - r - Mayor Pro Tem/Councilmember Richard Tetens Councilmember Jerry Richardson Councilmember Randy Weber Councilmember Helen Beckman Councilmember Kevin Cole City Attorney Amy McCullough City Secretary Yolanda C. Benitez Others in attendance: Assistant City Manager Glen Erwin; Police Chief Mike Hogg; Director of Administrative Services Mary Hickling; and Parks & Recreation Director Ed Hersh. Absent: City Manager Paul Grohman. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was given by Police Chief Mike Hogg, and the Pledge of Allegiance was led by PEDC Board Member Bill Berger. APPROVAL OF MINUTES Councilmember Tetens moved that the minutes of the Joint Public Hearing of April 22, 1996, 7:00 p.m., be approved as presented. Councilmember Richardson seconded the motion. Motion passed 5 to 0. Councilmember Tetens moved that the minutes of the Regular Meeting held on April 22, 1996, 7:30 p.m., be approved as presented. Councilmember Richardson seconded the motion. Motion passed 5 to 0. After receiving Council concurrence, Mayor Reid announced that they would dispense with the activity reports and proceed to the citizens portion of the agenda. CITIZENS: 1. Daphne Hereford - Heritage Manor - 2904 Yost Blvd. Ms. Hereford addressed Council with regard to a letter she received. She presented the City Secretary with a copy of the letter for the record. DOCKETED PUBLIC HEARINGS: None UNFINISHED BUSINESS: None NEW BUSINESS: RESOLUTION NO. R96-24 - A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OFFICER'S ELECTION AND SPECIAL ELECTION HELD IN THE CITY OF PEARLAND, TEXAS, ON MAY 4, 1996. The results were as follows: FOR MAYOR OF THE CITY OF PEARLAND (THREE-YEAR TERM) NAME OF CANDIDATE # OF VOTES RECEIVED PERCENTAGE Garey Willbanks 788 34.6% Tom Reid 1,415 62% FOR COUNCILMEMBER (POSITION THREE) Larry Wilkins 779 34% Chip Hosek 885 38.8% David Louwerse 483 21% Thereby, Tom Reid was declared to be the parry duly elected to the office of Mayor of the City of Pearland (Three -Year Term) at the May 4, 1996 election. It was noted that there would be a Runoff Election between Larry Wilkins and Chip Hosek. Mayor Reid also reported that all 77 of the Proposed Charter Amendments had failed. The Mayor expressed his appreciation to all who participated in the election activities. Councilmember Richardson moved for the adoption of Resolution No. R96-24, seconded by Councilmember Tetens. Voting "Aye" - Councilmembers Beckman, Cole, Tetens, Weber and Richardson. Voting "No" - None. Motion passed 5 to Q. RESOLUTION NO. R96-25 - A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ORDERING THE HOLDING OF A RUNOFF ELECTION ON THE 1ST DAY OF JUNE, 1996, FOR THE PURPOSE OF ELECTING A COUNCILMEMBER (POSITION THREE) FOR THE CITY OF PEARLAND, TEXAS; ESTABLISHING POLLING PLACES; NAMING CLERKS; AND ESTABLISHING PROCEDURES FOR SAID RUNOFF ELECTION. City Attorney Amy McCullough explained that the resolution had been revised to note that the election will be held on June 1st, and to add the name of Mary Hickling as an additional Deputy Early Voting Clerk, and the run-off will be conducted with a punchcard ballot. Councilmember Beckman thanked Inez Farmer, Yolanda Benitez, and all of the election clerks and counters who worked during the election process. City Secretary Yolanda Benitez also expressed her appreciation to Mary Starr who worked 23 hours non-stop and had served not only as a counter, but as a Presiding Judge during the early hours on Sunday morning. Councilmember Weber moved for the adoption of Resolution No. R96-25. The motion was seconded by Councilmember Tetens. Voting "Aye" - Councilmembers Richardson, Weber, Tetens, Cole and Beckman. 209 Voting "No" - None. Motion passed 5 to 0. RESOLUTION NO. R96-28 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPOINTING PERSONS TO SERVE AT THE CENTRAL COUNTING STATION, BRAZORIA COUNTY COURTHOUSE, ANGLETON, TEXAS, FOR THE RUNOFF ELECTION TO BE HELD ON THE 1ST DAY OF JUNE, 1996. City Attorney Amy McCullough explained that this is a routine procedure when using the punchcard ballots which authorizes the Central Counting Station to tally the ballots for the runoff election. Councilmember Tetens moved for the approval of Resolution No. R96-28. The motion was seconded by Councilmember Richardson. Voting "Aye" - Councilmembers Beckman, Cole, Tetens, Weber and Richardson. Voting "No" - None. Motion passed 5 to 0. ISSUANCE OF CERTIFICATE OF ELECTION TO NEWLY ELECTED OFFICIALS City Secretary Yolanda Benitez issued the Certificate of Election to the newly elected Mayor, Tom Reid, and announced that he had received 1,415 votes in the election held on May 4, 1996. ADMINISTRATION OF OATH OF OFFICE TO NEWLY ELECTED OFFICIALS Judge Bill Todd administered the Oath of Office to Mayor Tom Reid. Mayor Reid expressed his appreciation to the citizens and noted that his goal is to make the City of Pearland a place that everyone is proud of, with the help of constructive and positive citizens pulling together as a community. Mayor Reid noted that the election of the Mayor Pro Tem would take place after the entire Council is seated which will take place after the Runoff Election. He also stated that Councilmember Weber will receive his award at that time, as well. RESOLUTION NO. R96-27 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT AND AGREEMENT BY AND BETWEEN THE CITY OF PEARLAND AND THE CITY OF FRIENDSWOOD FOR THE PROVISION OF WATER AND SEWER SERVICE. Councilmember Cole moved for the adoption of Resolution No. R96-27. The motion was seconded by Councilmember Beckman. Mayor Reid explained that the City of Friendswood and the City of Pearland have a standing mutual agreement regarding the provision of water and sewer service, and the City Council of the City of Friendswood executed this contract at their Council meeting held on April 15. Voting "Aye" - Councilmembers Beckman, Cole, Tetens, Weber and Richardson. Voting "No" - None. Motion passed 5 to 0. AUTHORIZATION FOR THE MAYOR TO EXECUTE, ON BEHALF OF THE CITY AS GRANTOR, A QUITCLAIM DEED TO ROBERT W. MAUK, GARY L. DUKE, AND Nil CHERYL LYNN DUKE REGARDING RIGHT-OF-WAY ABANDONED ON APRIL 22, 1991, 1N ACCORDANCE WITH CITY OF PEARLAND ORDINANCE NO. 612. Councilmember Beckman moved to authorize the Mayor to Execute this Quitclaim Deed. The motion was seconded by Councilmember Cole. City Attorney Amy McCullough explained that this deed is for the purpose of assisting some property owners in completing a conveyance. She noted that this property was abandoned by the City in 1991, and the City does not have any interest in the property at this point except to assist the owners. Voting "Aye" - Councilmembers Beckman, Cole, Tetens, Weber and Richardson. Voting "No" - None. Motion passed 5 to 0.
