HomeMy WebLinkAboutOrd.1661 20260928 ORDINANCE NO. 1661 An Ordinance of the City Council of the City of Pearland, Texas, creating a new chapter in the City Code of Ordinances, to be entitled “Chapter 33 – Fee Schedule”; establishing fees, containing a savings clause, a severability clause, repealing prior ordinances in conflict herewith, providing for codification; providing for publication and an effective date. WHEREAS, charges and fees related to development and permitting were previously adopted by Ordinance No. 1023-11, and its former versions; and WHEREAS, charges and fees for usage, permits, and other services not related to development were previously adopted by Ordinance No. 1358 -22, and its former versions; and WHEREAS, both Ordinance No. 1023-11 and its former versions and Ordinance No. 1358- 22 and its former versions were sometimes published in the City Code of Ordinances as Appendix A; and WHEREAS, the City desires to consolidate and organize adopted fees into one fee schedule; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. Fee Schedule. That a new Chapter shall be and is hereby created and shall be added to the City Code of Ordinances, which Chapter shall be entitled “Chapter 33 – Fee Schedule” and which Chapter shall hereafter read as reflected in Exhibit “A”, incorporated herein for all purposes. Section 2. Savings. All rights and remedies which have accrued in favor of the City under the prior fee ordinances and amendments thereto shall be and are preserved for the benefit of the City. Section 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. That, effective October 1, 2026, Ordinance No. 1023-11, Ordinance No. 1358-33, and Appendix A – Fee Schedule in the City Code of Ordinances are hereby repealed in their entirety. All other ordinances and parts of ordinances in conflict herewith are hereby repealed but only to the extent of such conflict. Section 5. Codification. It is the intent of the City Council of the City of Pearland, Texas, that the provisions of this ordinance shall be codified in the City’s official Code of Ordinances as provided hereinabove. Section 6. Publication. The City Secretary shall cause this Ordinance, or its caption, to be published in the official newspaper of the City of Pearland, upon passage of such Ordinance. Section 7. Effective Date. This Ordinance shall become effective on October 1, 2026.
