1972-06-12 CITY COUNCIL REGULAR MEETING MINUTES75 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND HELD ON JUNE 12, 1972, AT 7:35 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order by Mayor McComb with the following present: Mayor Carlton McComb Councilman E. A. Wasek Councilman Gene E. Sanders Councilman James 0. DeShazer Councilman Benny J. Frank City Manager William E. Wolff City Attorney Bobby J. Williams City Secretary Dorothy L. Cook Absent: Councilman Cecil W. Griffin INVOCATION & PLEDGE OF ALLEGIANCE: Invocation given by Rev. Jerry Laird, Minister of the Bethany Assembly of God Church, Pearland. Pledge of :.Allegiance led by Police Chief M. L. Singleton. APPROVAL OF MINUTES: It was moved by Councilman Sanders, seconded by Councilman Wasek that the minutes of the regular meeting held on May 22, 1972, be approved as submitted. Motion passed 4to0. It was moved by Councilman Wasek,seconded by Councilman Sanders that the minutes of a special meeting held on May 30, 1972, be approved as submitted. Motion passed 3 to 0. Councilman DeShazer abstained. APPROVAL OF EXPENSES: Mayor McComb read the following list of checks to be considered by the Council for approval: General Fund Payroll Nos. 6160 through 6212 Water & Sewer Payroll 6213 through 6224 General Fund Expenditures 4275 through 4389 Water & Sewer Expenditures *5561 5621 through 5644 Water Construction Expenditures 241 Sewer Construction Expenditures 202 * Check No. 5561 - Green Tee Corporation - $2,070.00, withheld on April 24, 1972 check list. Meeting recessed 7:45 P. M. - Reconvened at 7:50 P. M. It was moved by Councilman DeShazer, seconded by Councilman Frank that the Check List be approved. Motion passed 4 to 0. (h Councilman Sanders requested that future check lists bear certification that the items have been previously budgeted. MAYOR'S ACTIVITY REPORT: Appointment of Civil Defense Coordinator: Mayor McComb re -appointed Mr. Harold Sanders as Civil Defense Coordinator. Ordinance No. 106, Civil Defense Ordinance, to be assigned to the Ordinance Committee for revision at a later date. Appointment of a Beautification Committee: Mayor McComb read a prepared statement regarding the need for a Committee to work with various organizations and individuals in an effort to clean up some of the unsightly areas of the City. The following were appointed to the Beautification Committee: Chairman Councilman DeShazer Member Councilman Griffin Member Councilman Frank Ordinance No. 130 - Schedule of Fines: This ordinance referred to the Ordinance Committee for revision and, if possible, to be placed on the next Council agenda for consideration. Southwestern Bell Telephone Company's Request to Houston City Council For Rate Increase: Mayor McComb read the following correspondence relating to the objection by the City of Pearland of the rate increase requested by Southwestern Bell Telephone Company. 1. Letter dated June 2, 1972 to Mayor and City Councilmen. of the City of Houston by,Mayor,.McComb expressing opposition to the proposed rate increase. 2. Letter dated June 5, 1972 addressed to Mayor McComb from Larry McKaskle, Councilman, District A, City of Houston. 3. Letter dated June 5, 1972 addressed to Mayor McComb from Frank Mancuso, Councilman, District E, City of Houston: 4. Letter dated June 5, 1972 from the Greater Houston Civic Council, along with a brochure prepared by Senator Charles Wilson entitled "The Case For Regulations of Texas Telephone Monopolies." COUNCIL ACTIVITY REPORTS: None DEPARTMENTAL REPORTS: Omission of Bid - Bid No. 72-6: 77 City Manager Wolff reported that one bid for liquid chlorine was inadvertently sent to the Accounting Department. This was a bid from the Jones Chemical Company, however, the Dixie Chemical Company was the overall low bidder. Mr. Wolff requested that the records show that three bids were received for liquid chlorine from the following: Jones Chemical Company - S. E. C. Corporation, and Dixie Chemical Corporatii CITIZENS: r' - Mr. David Bowe had requested audience with the Council, however, he was not present at the meeting. DOCKETED PUBLIC HEARINGS: None UNFINISHED BUSINESS: CONSIDERATION OF OFFER FROM THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY REGARDING REMOVAL OF DEPOT BUILDING D-2, PEARLAND, TEXAS: Mayor McComb read a letter from the A. T. & S. F. Railway Company dated May 26, 1972, regarding removal of the Depot building. Mayor McComb assigned this item to the Safety Committee, who will be working with the Railway Company on the Knapp Road Crossing, to discuss the agreement regarding the 90 day period and what they mean-�garding "clean up premises to our satisfaction." SECOND AND (FINAL) READING - REVISED PLUMBING CODE, ORDINANCE NO. 233: This item moved to last item on agenda. NEW BUSINESS: CONSIDERATION OF RELEASE OF AGREEMENT BETWEEN W. E. PARKER AND BRAZORIA COUNTY WATER CONTROL & IMPROVEMENT DISTRICT NO. 3: The Agreement between Mr. Parker and the Brazoria County W. C. & Improvement District was discussed. This agreement was made in 1963 when Mr. Parker developed property within the District and installed lines for water & sewage and when connections were v made, each connection would be reimbursed by $120.00 from the District. Total possible connections 10, however, at this time only -3. -connections have been made and 77 Mr. Parker is agreeable to close out this agreement on that basis. It was moved by Councilman DeShazer, seconded by Councilman Frank the Council Contingency Fund be adjusted by the amount of $840.00 as payment of the Agreement with Mr. W. E. Parker and the Brazoria County Water Control & Improvement District No. 3, with authority to pay the $840.00 upon a signed release agreement. Motion passed 4 to 0. SECOND AND FINAL READING - REVISED PLUMBING CODE - ORDINANCE NO. 233: Ordinance No. 233 read in full by members of the Council and City Manager. 78 It was moved by Councilman Frank, seconded by Councilman Sanders that the Revised Plumbing Code, Ordinance No. 233, be passed and approved on second and final reading. Said Ordinance No. 233 reads in caption as follows: ORDINANCE NO. 233 AN ORDINANCE OF THE CITY OF PEARLAND, TEXAS, REPEALING ALL ORDINANCES, OR PARTS OF ORDINANCES, OR AMENDMENTS THERETO, THAT CONFLICT WITH THE TERMS AND CONDITIONS OF THIS ORDINANCE AND ENACTING IN LIEU THEREOF A NEW ORDINANCE, REGULATING PLUMBING AND GAS FITTING WORK IN THE CITY OF PEARLAND, TEXAS; DEFINING CERTAIN TERMS; PROVIDING FOR CERTAIN EXEMPTIONS; PROVIDING FOR SPECIFICATIONS, MATERIALS AND METHODS OF PLUMBING AND GAS FITTING INSTALLATIONS; PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE AND THE ISSUANCE OF PERMITS AND ESTABLISHING CERTAIN FEES; PROVIDING FOR THE PUBLICATION OF A DESCRIPTIVE CAPTION OR TITLE ON THE ORDINANCE AND THE PENALTY FOR VIOLATION THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AND EFFECTIVE':'DATE;.HEREOF. Voting "aye" - Councilman Sanders, Councilman DeShazer, Councilman Wasek, and Councilman Frank. Voting "no" - none Motion passed 4 to 0.
