MINUTES OF A REGULAR MEETING HELD ON MARCH 27, 1972 BY THE CITY COUNCIL OFTHE CITY
OF PEARLAND, TEXAS, IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS AT
7:35 P. M.
The meeting was called to order by Mayor Keller with the following present:

INVOCATION & PLEDGE OF ALLEGIANCE:
The invocation was given by Dr. Forrest Hawkins, Council Chaplain. The Pledge of
Allegiance was led by City Attorney Bobby J. Williams.
APPROVAL OF MINUTES:
It was moved by Councilman DeShazer, seconded.by Councilman McComb that the minutes
of the special° meeting held on March 9, 1972 be approved as submitted. Motion
passed 5 to 0.
It was moved by Councilman McComb, seconded by Councilman Wasek that the minutes
of a regular meeting held on March 13, 1972 be approved as submitted. Motion
passed 4 to 0. Councilman DeShazer abstained.
It was moved by Councilman Wasek, seconded by Councilman Frank that the minutes of
a special meeting held on March 16, 1972 be approved as submitted. Motion passed
5to' 0.
APPROVAL OF EXPENSES:
It was moved by Councilman DeShazer, seconded by Councilman Wasek that the following
checks be approved for payment:

1. Mayor Keller administered the Oath of Office to M. L. Singleton, Chief of Police
for the City of Pearland.
2. Mayor Keller called a Special Meeting for April 3, 1972 for the purpose of
canvassing the results of the City Officers' Election held on April 1, 1972
and any business pertinent thereto.
3. Mayor Keller reported that on March 24, 1972 the Council met with the Texas
Water Quality Board and a representive from the Attorney General's office
to discuss the Order 69-9A. The meeting was fruitful and meetings will be
held in the near future J.n an -effort to comply with this Order.
COUNCIL ACTIVITY REPORTS:
1. Third Report - Congressional Hearings on Phosphates - Councilman McComb
Councilman McComb reported that the City and Texas Water Quality Board met in
Austin and he felt that the City could, in an economical manner, comply with
the Board Order 69-9A.
Mr. McComb stated that the two books, Part 1 and Part 2 of Phosphates and Phosphate
Substitutes in Detergents - Hearings - Subcommittee of the Committee on
Government Operations - House of Representatives - October 20, 27, and 28, 1971
are part of the City records and anyone that would like to come in and read
them would be welcome. These books contain transcript of the entire
hearing.
DEPARTMENTAL REPORTS:
I. Authority,to advertise for bids on truck chassis for Pearland Volunteer Fire
Department.
Mr. Wolff reported that when the Budget was prepared it was his intention and
the Council's intention to purchase a truck chassis and to exchange this truck
chassis with the Volunteer Fire Department so that they might build anew tank
truck and the City will take one of the Fire Department's trucks and use it for
a water truck. The Fire Department has submitted specifications for review
and upon final review, Mr. Wolff requested permission to bid this equipment.
It was moved by Councilman McComb, seconded by Councilman Griffin that the
City Manager be authorized to advertise for bids on this truck chassis for the
Pearland Volunteer Fire Department. Motion passed 5 to 0.
2. Bid on pick-up truck for Street & Bridge Department.
Mr. Wolff informed the Council that he had advertised for bids on a pick-up
truck to be used,by the Street & Bridge Department. ;This item was authorized
under the Budget.
CITIZENS:
A discussion was held regarding Section III of the.Rules of Procedure for the City
Council.

It was moved by Councilman Griffin, seconded by Councilman Wasek that the three
citizens who signed request forms to be heard at this meeting be allowed to
speak before the Council. Motion passed 5 to 0.
Mr. J. C. Cullison, Jr - Representing the Mimosa Acres Civic Club -
Mr. Cullision appeared before the City Council regarding the condition of the streets
in Mimosa Acres Subdivision. Mr. Cullison requested that shell be placed on the
streets until such time as the Paving Program could get started in this area.
The Council requested Mr. Wolff to prepare a report for the next regularly scheduled
Council meeting, based on the condition of the streets in Mimosa Acres, some cost
estimates on what it will take to bring the streets up to par as we have been
doing in the past, and a cost estimate of what it will take to permanently improve
the streets according to our current paving program.
Mrs. B. M. Jamison
Mrs. Jamison appeared before the Council regarding certification of Petitions.
Mr. Lee Plyler
Mr. Plyler had signed a request requesting information as to the outcome of the
meeting with the TWQB and Attorney General's office pertaining to 69-9A. This
item was covered in the Mayor's Activity Report.

SECOND AND FINAL READING - ORDINANCE OF NECESSITY ON PAVING IMPROVEMENTS ON PORTIONS
OF CERTAIN STREETS IN SHADYCREST SUBDIVISION. Lon herrid a Drive and Marys
Creek Lane East):
Mayor Keller read Ordinance No. 232 in full. First reading March 13, 1972, and
passed and approved on that date.
It was moved by Councilman Frank, seconded by Councilman McComb that Ordinance No. 232
be passed and approved on second and final reading. Said Ordinance No. 232 reads
in caption as follows:
ORDINANCE NO. 232
AN ORDINANCE DECLARING THE NECESSITY FOR AND ORDERING THE
PAVING AND IMPROVEMENT OF PORTION OF LONGHERRIDGE DRIVE AND
MARYS CREEK LANE EAST, CITY OF PEARLAND, TEXAS; APPROVING
PLANS AND SPECIFICATIONS FOR SUCH WORK; AUTHORIZING THE
CITY MANAGER TO ADVERTISE FOR BIDS IF NECESSARY; DIRECTING
THE PREPARATION OF ESTIMATES; INVOKING AND ADOPTING THE
PROVISIONS OF ARTICLE 1105b, VERNON'S REVISED CIVIL STATUTES;
PROVIDING THE MANNER IN WHICH AND BY WHOM THE COST OF SUCH
IMPROVEMENTS SHALL BE PAID AND PROVIDING FOR ASSESSMENT OF A
PORTION OF SUCH COSTS AGAINST ABUTTING PROPERTIES AND THE OWNERS
THEREOF; PROVIDING FOR THE -TERMS OF PAYMENT OF
SUCH ASSESSMENTS: DIRECTING THE CITY SECRETARY TO
CAUSE A CERTIFIED COPY OF THIS ORDINANCE TO BE
FILED IN THE DEED OF TRUST RECORDS OF BRAZORIA COUNTY,
TE XAS; ENACTING PROVISIONS INCIDENT AND RELATING TO
THE SUBJECT; PROVIDING A SAVINGS CLAUSE.AND AN
EFFECTIVE DATE HEREOF.
