R2026-106 A Resolution of the City Council of the City of Pearland, Texas, determining the Council’s response to the Pearland Professional Firefighters Association (PPFA) Petition for Recognition of the PPFA, pursuant to Chapter 142 of the Local Government Code (Code), as the sole and exclusive bargaining agent for all firefighters employed by the Pearland Fire Department, excluding the head of the department and exempt employees, for the purpose of engaging in the Meet and Confer process. WHEREAS, The Code allows a firefighters association to submit a petition with the City that is signed by a majority of all firefighters, excluding the department head and exempt employees, to request recognition of a firefighters’ association as the sole and exclusive bargaining agent, for the purpose of engaging in the Meet and Confer process; and WHEREAS, On May 28, 2026, the PPFA, pursuant to Texas Local Government Code Section 142.103(a), submitted to the City Secretary a Petition requesting recognition as the sole and exclusive bargaining agent of covered firefighters; and WHEREAS, Pursuant to Section 142.0103(a) of the Code, on or before 30 days of receipt of the petition, City Council shall take one of three actions regarding a Petition. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. Pursuant to Section 142.103(a) of the Code, the City Council hereby elects the following option with respect to the PPFA’s Petition: __X___ Option A: Grants recognition of the association as requested in the Petition, and determines by majority vote that the City may Meet and Confer, without conducting an election by the voters under Section 142.105 of the Code; or _____ Option B: Defers granting recognition of the PPFA and hereby orders an election by the voters in the City under Section 142.105 of the Code regarding whether the City may engage in Meet and Confer; or _____ Option C: Orders a certification election under Section 142.104 of the Code to determine whether the PPFA represents a majority of the affected firefighters.
