Councilmember Koza made the motion, seconded by Councilmember Cade to
approve the Consent Agenda items A-B.
AYES: Byrom, Koza, Cade, Fernandez, Echols, Chavarria, and Patel.
NAYS: None.
The motion carried.
VI.MATTERS REMOVED FROM CONSENT AGENDA
There were no items removed from Consent Agenda.
VII.PUBLIC HEARING NO. 1
1.Public Hearing: A request by Mario Moreno, applicant and owner, for
approval of a Conditional Use Permit (CUP) for Accessory Dwelling Unit
use within the Single-Family Residential-1 (R-1) District, on
approximately 1.001 acres of land, to wit:
Legal Description: Lot 1, Block 1 of Minor Plat of JC Rodriguez Estates
Partial Replat No 1, Amending Plat No 1 a Subdivision in Brazoria
County, Texas according to the map or plat thereof, recorded under
Brazoria County clerk’s file No. 2024011453, official public records,
Brazoria County, Texas.
General Location: 13025 Wilke Road, Pearland, Texas.
Mayor Wiltz opened the Public Hearing.
Presentation was provided by Katya Copeland, Assistant Director of Planning.
Mario Moreno, applicant, spoke in favor of the zone change request.
There were no citizen comments.
Mayor Wiltz closed the Public Hearing.
VIII.NEW BUSINESS
1.Consideration and Possible Action - Resolution No. R2026-CUP2026-0105
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for Accessory Dwelling Unit
use within the Single-Family Residential-1 (R-1) District, on
approximately 1.001 acres of land, being Lot 1, Block 1 of Minor Plat of
JC Rodriguez Estates Partial Replat No 1, Amending Plat No 1 a
Subdivision in Brazoria County, Texas according to the map or plat
thereof, recorded under Brazoria County clerk’s file No. 2024011453,
official public records, Brazoria County, Texas. (located at 13025 Wilke
Road, Pearland, Texas). Conditional Use Permit No. CUP2026-0105, for
Accessory Dwelling Unit use within the Single-Family Residential-1 (R-1)
at the request of Mario Moreno, applicant and owner, containing a

savings clause, a severability clause, and an effective date and other
provisions related to the subject.
Councilmember Echols made the motion, seconded by Councilmember Byrom
to approve Resolution No. R2026-CUP2026-0105.
AYES: None.
NAYS: Byrom, Koza, Cade, Fernandez, Echols, Chavarria, and Patel.
The motion failed.
IX.PUBLIC HEARING NO. 2
2.Public Hearing: A request by Crystal Duncan, applicant, on behalf of
Kwak Jung Hwan, owner, for approval of a Conditional Use Permit (CUP)
for Adult Day Care Center use within the Neighborhood Service (NS)
District, on approximately 5.5394 acres of land, to wit:
Legal Description: A subdivision of 5.5394-acre tract of land, being
Stepping Stone No.3, located in the H.T. & B.R.R. Company Survey, A-242
Brazoria County, Texas, according to the map or plat recorded under
Brazoria County Clerk’s File No. 00-054657 of the Official Records of
Brazoria County, Texas.
General Location: 7924 Broadway Street Suite #102, Pearland, Texas
Mayor Wiltz opened the Public Hearing.
Presentation was provided by Katya Copeland, Assistant Director of Planning.
Crystal Duncan, applicant, was present to answer questions from the Council.
There were no citizen comments.
Mayor Wiltz closed the Public Hearing.

2.Consideration and Possible Action - Resolution No. R2026-CUP2026-0112
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for Adult Day Care Center use
on approximately 5.5394 acres of land within the Neighborhood Service

clause, a severability clause, and an effective date and other provisions
related to the subject.
Mayor Pro-Tem Chavarria made the motion, seconded by Councilmember
Fernandez to approve Resolution No. R2026-CUP2026-0112.
AYES: Byrom, Koza, Cade, Fernandez, Echols, Chavarria, and Patel.
NAYS: None.
The motion carried.
3.Consideration and Possible Action - Resolution No. R2026-78 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the power of eminent domain to acquire a 0.4168 acre fee interest for a
public road right-of-way and a 0.0815 acre easement for public waterline
and sanitary sewer improvements, located in the Richard T. Blackburn
Survey, Abstract Number 160, City of Pearland, Harris County, Texas,
being a portion of that certain called 2 acre tract conveyed to William D.
Berrios, by an instrument of record under Clerk’s File Number RP-2021-
724669 of the Official Public Records of Harris County, Texas;
authorizing the city attorney, or his designee, and other city officials to
take such actions as are necessary to acquire said property, located
within the city, by donation, purchase, or by the exercise of the power of
eminent domain.
Lawrence Provins, City Attorney, read the motion into record: Consideration
and Possible Action - Resolution No. R2026-78 - A Resolution of the City
Council of the City of Pearland, Texas, authorizing the power of eminent

a 0.0815 acre easement for public waterline and sanitary sewer improvements,
