R2026-79 A Resolution of the City Council of the City of Pearland, Texas, canvassing the General and Special Elections held in the City of Pearland, Texas, on May 2, 2026, and providing for other related matters related thereto. WHEREAS, the City Council of the City of Pearland, Texas held a General Election on May 2, 2026, for the purpose of electing three (3) Councilmembers by position, from the City at large, for Mayor; Councilmember, Position three (3); and Councilmember, Position seven (7), for a term of three (3) years; and WHEREAS, the City Council of the City of Pearland, Texas held a Special Election on May 2, 2026, for the purpose submitting to the qualified voters of the City the following Proposition A: “Shall the City Charter be amended in Sections 3.08, 3.10, 5.06, 6.17, 7.01, 8.06, 8.11, 9.04, and 10.03 to provide that notices and required publications be provided in accordance with state law?”; and WHEREAS, the City Council of the City of Pearland, Texas held a Special Election on May 2, 2026, for the purpose of submitting to the qualified voters of the City the following Proposition B: “Adoption of the fire fighters’ civil service law for the Pearland Fire Department.”; and WHEREAS, the City Council has investigated all matters pertaining to the General and Special Elections and has determined that notice of said elections was given as required by law, and said elections were duly and legally held on May 2, 2026, in conformity with the election laws of the State of Texas and the Voting Rights Act of 1965, and WHEREAS, it further appears to the City Council and the Council finds that the Election Judges and Brazoria County Elections Administrator have tabulated the results of said General and Special Elections and certified such tabulation for the City Council and that such tabulation is correct; and WHEREAS, the returns of the general election have been made to the Council for the votes for Mayor, Councilmember, Position Three (3); and Councilmember, Position Seven (7), for a term of three (3) years; and as shown in the Cumulative Report and are attached hereto as Exhibit A; and WHEREAS, the returns of the special election have been made to the Council for the votes for and against Propositions A and B were cast, as shown in the Cumulative Report and are attached hereto as Exhibit A; and WHEREAS, after duly canvassing said returns from each precinct, the City Council finds that the sum of the total votes cast of all City precincts at said election for the candidates for said offices are as follows: MAYOR NAME OF CANDIDATE NUMBER OF VOTES RECEIVED PERCENTAGE QUENTIN WILTZ 6,020 51.09% TONY CARBONE 5,764 48.91% Docusign Envelope ID: 7ECDE4E0-01A1-825E-8227-D3E935BEEBC5 COUNCILMEMBER POSITION NO. 3 NAME OF CANDIDATE NUMBER OF VOTES RECEIVED PERCENTAGE TOSHILA MCLEAN 5,049 44.74% MONA CHAVARRIA 6,236 55.26% COUNCILMEMBER POSITION NO. 7 NAME OF CANDIDATE NUMBER OF VOTES RECEIVED PERCENTAGE RUSHI PATEL 8,738 100% WHEREAS, after duly canvassing said returns from each precinct, the City Council finds that the sum of the total votes cast of all City precincts at said election for Propositions A and B are as follows: PROPOSITION A: SHALL THE CITY CHARTER BE AMENDED IN SECTIONS 3.08, 3.10, 5.06, 6.17, 7.01, 8.06, 8.11, 9.04, AND 10.03 TO PROVIDE THAT NOTICES AND REQUIRED PUBLICATIONS BE PROVIDED IN ACCORDANCE WITH STATE LAW? FOR OR AGAINST NUMBER OF VOTES RECEIVED PERCENTAGE FOR 9,681 89.14% AGAINST 1,179 10.86% PROPOSITION B: ADOPTION OF THE FIRE FIGHTERS’ CIVIL SERVICE LAW FOR THE PEARLAND FIRE DEPARTMENT. FOR OR AGAINST NUMBER OF VOTES RECEIVED PERCENTAGE FOR 9,823 89.81% AGAINST 1,114 10.19% BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: SECTION 1. The Council finds that all of the recitals contained in this resolution are true and adopts them as findings of fact by this governing body. SECTION 2. The Council finds that the results for each precinct of the General and Special elections, as tabulated, received, and canvased, reflect the votes cast at the election; as shown in the Canvass Report and are attached hereto as Exhibit B. SECTION 3. The Council accepts and approves the returns for the general election, as tabulated, received, and canvassed, and declares that the following persons are declared elected and may qualify for the office: Quentin Wiltz, Mayor Mona Chavarria, Council Member, Position Three (3) Rushi Patel, Council Member, Position Seven (7) SECTION 4. With this canvass, Council is making official the precinct returns received from the counties. SECTION 6. The meeting at which this ordinance was approved was a regular meeting of the City Council, and in all things, was conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
