HomeMy WebLinkAbout20260305 Zoning Board of Adjustments Regular Meeting Minutes MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF PEARLAND,TEXAS HELD ON MARCH 5,2026 AT 6:00PM IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DR. CALL TO ORDER Chairperson Lewis opened the meeting for the Zoning Board of Adjustment at 6:00pm. In attendance were: ZBA Chairperson, Mark Lewis ZBA Vice Chairperson,Jerry Acosta ZBA Member,Todd locco ZBA Alternate Member, Christopher Tristan Also present were Senior Planner Patrick Bauer, Planning Technician Stacey Haas, Director of Community Development Vance Wyly and City Attorney Lawrence Provins. Chairperson Lewis stated that since only 4 members of the Board were present, any decision to approve would have to be unanimous. He asked the applicant if they understood and still wished to proceed. The applicant responded that they did want to proceed with the meeting. APPROVAL OF MINUTES Consideration and Possible Action-Approve the ZBA Meeting Minutes from December 4, 2025. Chairperson Lewis read into the record the items on Approval of Minutes. Member locco made the motion to approve and Alternate Member Tristan seconded the motion. Motion passed 4-0. NEW BUSINESS Chairperson Lewis read into the record the item on Consideration and Possible Action-VAZ2026- 0010: Variance for the Reduction of the Corridor Overlay District Parking Setback for Office Warehouses. Consideration and Possible Action-VAZ2026-001 0:Variance for the Reduction of the Corridor Overlay District Parking Setback for Office Warehouses Public Hearing:A request by Salim Obied, applicant, on behalf of Niyaz Irsaliev, owner,for approval of a variance, as permitted by the Unified Development Code, ordinance No. 2000-T,to allow a variance to reduce the minimum setback for offstreet parking and maneuvering areas on a Corridor Overlay District(Section 2.4.5.1(c)(2)),to wit: Legal Description: Lot 1, Block 1, Minor Subdivision Plat of McHard Business Park, a subdivision in Brazoria County,Texas, according to the map or plat thereof recorded in County Clerk's File No. 2025031638 in the Plat records of Brazoria County,Texas. General Location: 3919 McHard Road, Pearland, Texas Senior Planner Bauer presented the staff report with exhibits. He stated that no written comments or phone calls had been received in support or opposition to the request. He gave a brief history of the site and noted that the site was platted in 2025 and received approval for a plat variance from the minimum lot depth requirement. He went on to explain that the parking setback is 30 feet along McHard Road, as this is part of the Corridor Overlay District, and the applicant is requesting an encroachment for a depth of 4.5 feet for a total of 194 square feet. He stated that Staff found the request met 6 of the 8 criteria for granting a variance. However, he also stated that the curved alignment of the property did not deprive the applicant of the beneficial use of land as the site is undeveloped, and an Office Warehouse could be developed that would meet the parking setback. Therefore, he said Staff did not recommend approval of the variance. He also stated that if the Board did approve the variance, Staff recommended that the following be included as a condition of approval: • The proposed drive aisle shall only be allowed to encroach into the parking setback for a total of 194 square feet and 4.5 feet, as shown on the proposed site plan in the Applicant's Packet. The applicant Salim Obied, 580 Westlake Park Boulevard#1125, Houston,Texas 77079 was in the Council Chamber and made a short presentation. He stated that if the variance is not granted,they would have to get closer to the building and they would lose a parking space in front. He also stated that they are offering additional landscaping elsewhere to accommodate the lost area. He stated that the straightened alignment and alignment with the building facade accomplished the goal of beautification along McHard Road. He further stated that people would probably use the area to park in anyway, even if it was not striped. Chairperson Lewis called for public input. There were no persons wishing to speak in favor or opposition to the request. The Board discussion focused on setbacks,the feasibility of moving the building and size of parking spaces. There was no further discussion from staff,ZBA Board or public input. Chairperson Lewis read into the record the item on Consideration and Possible Action-VAZ2026- 0010:Variance for the Reduction of the Corridor Overlay District Parking Setback for Office Warehouses.Vice Chairperson Acosta made the motion to approve the Variance as presented with the Staff recommendation and Alternate Member Tristan seconded the motion. Motion passed 4-0. ADJOURNMENT Chairperson Lewis adjourned the Zoning Board of Adjustment Meeting at 6:24pm.
