The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:35 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Carbone gave the Invocation and Councilmember Koza led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. Kevin Cole Mayor Pro-Tem Clint Byrom Councilmember Joseph Koza Councilmember Tony Carbone Councilmember Layni Cade Councilmember Rick Fernandez Councilmember Rushi Patel City Manager Trent Epperson City Attorney Lawrence Provins City Secretary Frances Aguilar All members were present except for Councilmember Mona Chavarria. IV. CITIZEN COMMENTS Kyle Haynes addressed Council, stating his concerns about townhomes to be built in Alexander, a DR Horton Community. David Deriso addressed Council, stating his concerns about the denial of a Conditional Use Permit for an Accessory Dwelling Unit and requesting another opportunity to bring it before Council. V. CONSENT AGENDA A. Pulled for discussion. B. Consideration and Possible Action - Resolution No. R2026-60 - A Resolution of the City Council of the City of Pearland, Texas, ("City") regarding the Interim Rate Adjustment Application of CenterPoint Energy Resources Corp. d/b/a CenterPoint Energy Entex and Centerpoint Energy Page 1 of 6 Pearland City Council Minutes March 23, 2026 Docusign Envelope ID: 0ED687C5-2691-462D-9708-B41EF8CE4348 Texas Gas, Texas Coast Division, for the 12 -month period ending December 31, 2025. C. Consideration and Possible Action - Resolution No. R2026-58 - A Resolution of the City Council of the City of Pearland, Texas, declaring intention to reimburse project expenditures from proceeds of future tax- exempt obligations. D. Consideration and Possible Action - Resolution No. R2026-50 - A Resolution of the City Council of the City of Pearland, Texas, accepting the City's Investment Reports for the quarters ending in September of 2025 and December of 2025. E. Consideration and Possible Action - Resolution No. R2026-1 - A Resolution of the City Council of the City of Pearland, Texas, awarding a 3 -year contract (1 -year initial term; two 1 -year renewals) for tree maintenance services to Texans Professional Tree Service, in the annual estimated amount of $258,500.00. This item was pulled from the agenda. Councilmember Koza made the motion, seconded by Councilmember Cade to approve Consent Agenda items A -D, except A. AYES: Byrom, Koza, Carbone, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VI. MATTERS REMOVED FROM CONSENT AGENDA A. Consideration and Possible Action Resolution No. R2026-62 - A Resolution of the City Council of the City of Pearland, Texas, authorizing participation in an Interlocal Agreement with the Gulf Coast Center associated with the creation of a Crisis Co -Response Team. Councilmember Koza made the motion, seconded by Councilmember Carbone to approve Resolution No. R2026-62. AYES: Byrom, Koza, Carbone, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VII. NEW BUSINESS 1. Consideration and Possible Action - Resolution No. R2026-51 - A Resolution of the City Council of the City of Pearland, Texas, accepting the City's Annual Comprehensive Financial Report for Fiscal Year 2025 and the accompanying independent audit as presented by the accounting firm of Whitley Penn, LLP. Presentation was provided by Andrew Jennett, CPA, Senior Manager with Whitley Penn, LLP. AYES: Byrom, Koza, Carbone, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 2. Consideration and Possible Action - Resolution No. R2026-57 - A Resolution of the City Council of the City of Pearland, Texas, adopting the City of Pearland's Strategic Priorities and Milestones promulgated during the City's 2026 Annual Planning Retreat. Mayor Pro -Tern Byrom made the motion, seconded by Councilmember Cade to approve Resolution No. R2026-57. AYES: Byrom, Koza, Carbone, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 3. Consideration and Possible Action - Resolution No. R2026-59 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a professional service contract with Consor North America, Inc., for design, bidding and construction services associated with the Broadway Street Expansion Project, in the estimated amount of $616,812.98. Councilmember Cade made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2026-59. AYES: Byrom, Koza, Carbone, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 4. Consideration and Possible Action - Resolution No. R2026-64 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire: (1) a 2.399 acre fee simple interest for a public road right-of-way and a public utility improvement (water tower and related appurtenances) , and (2) a 0.2454 acre easement for public water line and sanitary sewer improvements, all located in the James Hamilton Survey, Abstract Number 876, City of Pearland, Harris County, Texas, being a portion of Lot 52 1/2 and Lot 61, Block F, of Allison Richey Gulf Coast Home Co's Part of Suburban Gardens Subdivision, a subdivision of record in Volume 3, Page 40 of the Map Records of Harris County, Texas, more particularly being a portion of that certain residue of Lots 51 1/2 and 61 Block of said Allison Richey Gulf Coast Home Co's Part of Suburban Gardens conveyed to Wilbert L. Ullrich by an instrument of record under File Number K185772 of the Official Public Records of Real Property County, Texas (H.C.O.P.R.R.P.); authorizing the city attorney, or Page 3 of 6 Pearland City Council Minutes March 23, 2026 Docusign Envelope ID: 0ED687C5-2691-462D-9708-B41EF8CE4348 his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain. VIII. OTHER BUSINESS There were no other business items. IX. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no other issues to discuss. X. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 7:34 p.m. Section 551.074 - Personnel Matters - Deliberations regarding City Boards and Commissions appointments. Consideration and Possible Action - Regarding the performance evaluation and appointment of the Municipal Court Judge. Councilmember Carbone made the motion, seconded by Councilmember Koza to approve the appointment of Catherine Samaan as a part-time presiding Municipal Court Judge for a 2 -year term. AYES: Byrom, Koza, Carbone, Cade, Fernandez, and Patel. NAYS: None. The motion carried. XII. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 8:08 p.m. Section 551.074 - Personnel Matters - Deliberation regarding ratification of the City Manager's appointment of a Fire Chief. Conducted. Council returned from Executive Session at 8:23 p.m. XIII. NEW BUSINESS CONTINUED 5. Consideration and Possible Action - Regarding ratification of the City Manager's appointment of a Fire Chief. Councilmember Carbone made the motion, seconded by Mayor Pro -Tern Byrom to approve the ratification of the City Manager's appointment of Fire Chief Lewis Harris. AYES: Byrom, Koza, Carbone, Fernandez, and Patel. NAYS: None. The motion carried. XIV.
