CALL TO ORDER
Chairperson Lewis opened the meeting for the Zoning Board of Adjustments Meeting at 6:00 PM.

Also, present were Assistant City Attorney Katie Leiniger, Community Development Deputy
Director Martin Griggs, Planning Manager Katya Copeland, Planner II Katie Peterson, and
Business Administrator Jennifer Danley.
APPROVAL OF MINUTES
Consideration and Possible Action - Approve the ZBA Meeting Minutes from September 4,
2025.
Chairperson Lewis read into the record the items on Approval of Minutes. Member Glenn made
the motion to approve, and Member Shrum seconded the motion.
Motion passed 5-0.
NEW BUSINESS
Chairperson Lewis read into the record the item on Consideration and Possible Action —
VAZ2025-0392: Special Exception to Allow Construction of New Structure on a Lot with Existing
Nonconformities, Variance from Permitted Size of an Accessory Structure.
Consideration and Possible Action - VAZ2025-0392 - Special Exception to Allow
Construction of New Structure on a Lot with Existing Nonconformities, Variance from
Permitted Size of an Accessory Structure
Public Hearing: A request by Brad Kuhn, applicant, on behalf of Timothy S. Achor, owner, for
approval of special exceptions and a variance, as permitted by the Unified Development Code,
Ordinance No. 2000-T, to allow:
a. Special Exception to allow for Construction of a new structure on the same property
where a nonconformity already exists (Section 2.7.3.7(a)(4))
b. A Variance, in accordance with Section 2.2.5.2. to allow for the square footage of
the accessory structures (combined) to exceed 5% of the lot area (Section
2.5.3.1(g))
Legal Description: Lot 1, Block 1 in the Minor Plat of Jordan Addition, a subdivision in Brazoria
County, Texas, according to the map or plat recorded in County Clerk's File No. 2024053382, in
the Plat records of Brazoria County, Texas.
General Location: 6109 Gardenia Street, Pearland, Texas.
Planner II Peterson presented the staff report with exhibits. Ms. Peterson stated the Special
Exception is to allow the construction of a new structure on a lot where non-conformities exist,
and the Variance is to allow the proposed accessory structure to exceed the permitted 5% total
area by 11.6% of the lot area. She noted that staff received one written comment in opposition,
briefly reviewed the history of the property, and summarized the proposed site plan. Ms.
Peterson stated that the Special Exception met criterion six of the Unified Development Code
(UDC) and staff recommended approval. She further stated that the Variance met two and may
meet one additional of the eight criteria outlined in the UDC, and staff was unable to
recommend approval.
Applicant Brad Kuhn, 3009 Green Tee Drive, Pearland, Texas 77581, was present in-person in
Council Chambers to answer questions for the Zoning Board of Adjustment.
Chairperson Lewis called for public input.
Resident Robert Yeo, 6221 Gardenia Street, Pearland, Texas 77581, spoke in favor of the
request, noting the footprint matches the existing structure and the proposal will improve the
neighborhood.
Resident Jennifer Jordan Achor, 6108 Gardenia Street, Pearland, Texas 77581, spoke in favor of
the request, stating it was her childhood home and that they are restoring the property to make it
beautiful again.
Resident Timothy Achor, 6109 Gardenia Street, Pearland, Texas 77581, spoke in favor of the
request, noting that the existing structures were damaged by Hurricane Beryl and the new building
will enhance the property.
Discussion among the ZBA members focused on clarification of the requests and confirmation of
the size of the proposed new structure.
No further discussion from Staff, ZBA Board or Public input.
Chairperson Lewis read into the record the item on Consideration and Possible Action —
VAZ2025-0392: Special Exception to Allow Construction of New Structure on a Lot with Existing
Nonconformities. Vice Chairperson Acosta made the motion to approve the Special Exception as
presented, and Member Glenn seconded the motion.
Motion passed 5-0
Chairperson Lewis read into the record the item on Consideration and Possible Action —
VAZ2025-0392: Variance from Permitted Size of an Accessory Structure. Member Glenn made
the motion to approve the Variance as presented and Alternative Member Tristan seconded the
motion.
Motion passed 5-0.
DISCUSSION ITEMS
2026 Zoning Board of Adjustment Submittal Calendar
Planning Manager Copeland reviewed the 2026 Zoning Board of Adjustment Submittal Calendar
and noted the dates that were adjusted for city observed holidays.
ADJOURNMENT
Chairperson Lewis adjourned the Zoning Board of Adjustment Meeting at 6:30 PM.
