CALL TO ORDER
Chairperson Lewis opened the meeting for the Zoning Board of Adjustments Meeting at 6:04 PM.

Also, present were Deputy City Attorney Lawrence Provins, Assistant City Attorney Katie Leiniger,
Community Development Director Vance Wyly, Planning Manager Katya Copeland, Senior
Planner Patrick Bauer, and Business Administrator Jennifer Danley.
APPROVAL OF MINUTES
Consideration and Possible Action - Approve the ZBA Meeting Minutes from November 6,
2025.
Chairperson Lewis read into the record the items on Approval of Minutes. Member Glenn made
the motion to approve, and Member Shrum seconded the motion.
Motion passed 4-0.
NEW BUSINESS
Chairperson Lewis read into the record the item on Consideration and Possible Action —
VAZ2025-0488: Special Exception for Development to Occur on a Property with an Existing
Non conformities.
Consideration and Possible Action -VAZ2025-0488: Special Exception for Development to
Occur on a Property with an Existing Nonconformities
Public Hearing: A request by ABC Awning Company,applicant, on behalf of AirGas USA, LLC.,
owner, for approval of a special exception, as permitted by the Unified Development Code,
ordinance No. 2000-T, to allow for development to occur on a property with existing
nonconformities (Section 2.7.3.7(a)), to wit:
Legal Description: Lot 1, Block 1, Minor Subdivision Plat of Air Specialty Gas, a subdivision in
Brazoria County,Texas, according to the map or plat thereof recorded in County Clerk's File No.
2013029988 in the Plat records of Brazoria County, Texas.
General Location: 4344 Main Street, Pearland, Texas.
Senior Planner Bauer presented the staff report with exhibits, explaining that the Special
Exception request would allow development on a property with existing nonconformities. He
noted there were no written comments in favor or in opposition to the request. Mr. Bauer
reviewed the property history and existing nonconformities on the property and stated that the
request met criterion four of the Unified Development Code (UDC). Staff recommended
approval.
Applicant Ozzie Rios, 3703 Broadway Street, Houston, Texas 77017, was present in-person in
Council Chambers to answer questions.
Chairperson Lewis called for public input.
There were no persons wishing to speak in favor or opposition to the request.
The Zoning Board of Adjustments members discussion focused on clarifying the request and the
previous improvements made on the parcel.
No further discussion from Staff, ZBA Board or Public input.

Real Estate Holdings, LLC. And 14739 Almeda School Road LLC., owner, for approval of a
special exception, as permitted by the Unified Development Code, ordinance No. 2000-T, to plat
a property with existing nonconformities (Section 2.7.3.7(a)), to wit:
Legal Description: A 37.99-acre tract of land in the R.T. Blackburn Survey, Abstract No. 160,
Harris County,Texas; being all of a called 0.800 acre tract of land conveyed to BHVA Real Estate
Holdings, LLC as recorded under Harris County Clerk's File Number(H.C.C.F.)RP-2022-448114,
all of a called 1.2723 acre tract of land conveyed to BHVA Real Estate Holdings, LLC as recorded
under Harris County Clerk's File Number(H.C.C.F.) RP-2022-124488, all of a called 0.7459 acre
tract of land conveyed BHVA Real Estate Holdings, LLC as recorded under Harris County Clerk's

General Location: 322 Riley Road, Pearland, Texas.
Senior Planner Bauer presented the staff report with exhibits and explained that the request was
for a Special Exception to allow for a property with existing nonconformities to be platted. Mr.
Bauer noted that no written comments were receive by staff in favor or opposition to the request.
He reviewed the property history and existing nonconformities, stating that the Special Exception
met criterion four of the Unified Development Code (UDC). Staff recommended approval.
Applicant, Jeff Boutte, 10011 Meadow Glen Lane, Houston, Texas 77042, was present in person
in Council Chambers to answer any questions.
Chairperson Lewis called for public input.
There were no persons wishing to speak in favor or opposition to the request.
The Zoning Board of Adjustment members discussion focused on clarifying the request, asking
when the buildings were constructed and whether the applicant would need to return the board in
the future.
No further discussion from Staff, ZBA Board or Public input.

VAZ2025-0530: Special Exception to Plat a Property with an Existing Nonconformities. Member
Glenn made the motion to approve the Special Exception as presented, and Member Shrum
seconded the motion.
Motion passed 4-0.
