HomeMy WebLinkAbout20260202 Planning and Zoning Commission Regular Meeting MinutesMINUTES OF THE REGULAR MEETING HELD IN PERSON BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY FEBRUARY 2, 2026 AT 6:30PM IN PEARLAND CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE. CALL TO ORDER Chairperson Derrell Isenberg opened the meeting for the Planning and Zoning Regular Meeting at 6:31 pm. In attendance were: P&Z Chairperson Derrell Isenberg P&Z Commissioner Tommy Echols P&Z Commissioner Trey Haskins P&Z Commissioner Jenifer Ordeneaux P&Z Commissioner Henry Fuertes P&Z Commissioner Shad Comeaux Also present were Senior Planner Katie Peterson, Planner I Aria Bernal, Planning Technician Stacey Haas, Director of Community Development Vance Wyly, Assistant City Attorney Katie Leininger, and Assistant City Engineer Francisco Reyes. CONSENT AGENDA All items listed under the Consent Agenda are considered to be routine and require little or no deliberation by the Planning and Zoning Commission. These items will be enacted/approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action. (ix. Matters removed from the Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. Consideration and Possible Action - Excused Absences - Excuse the absence of Commissioner Tommy Echols, Commissioner Henry Fuertes and Commissioner Jenifer Ordeneaux from the January 13th, 2026 P&Z Regular Meeting. Consideration and Possible Action -Approval of Minutes -Approve the P&Z Regular Meeting minutes from January 13th, 2026. Consideration and Possible Action - RPL2025-0599: Final Plat of Massey Oaks East Lake A request by RG Miller I DCCM, the applicant; on behalf of CastleRock Communities, LLC, and Meritage Homes of Texas, owners; for approval of the Final Plat of Massey Oaks East Lake, creating 1 restricted reserve on 15.77 acres of land, described to wit: Legal Description: A subdivision of 15.77 acres of land located in the H. Stevens survey, A-593, City of Pearland, Brazoria County, Texas. General Location: West of Harkey Road and East of Massey Oaks Trail, Pearland, Texas. Consideration and Possible Action - RPL2025-0600: Final Plat of Massey Oaks West Lake A request by RG Miller I DCCM, the applicant; on behalf of CastleRock Communities, LLC, TC Massey Oaks, FC, LP, and Meritage Homes of Texas, owners; for approval of the Final Plat of Massey Oaks West Lake, creating 1 restricted reserve on 10.50 acres of land, described to wit: Legal Description: A subdivision of 10.50 acres of land located in the H. Stevens survey, A-593, City of Pearland, Brazoria County, Texas. General Location: West of Massey Oaks Trail and East of Magnolia Springs Drive, Pearland, Texas. Consideration and Possible Action - RPL2025-0601: Final Plat of Massey Oaks Basin 3 A request of RG Miller Engineers Inc., the applicant; on behalf of CastleRock Communities LLC., Massey Oaks Homeowners Association, Inc., Meritage Homes of Texas, and Brazoria County MUD #69, owners; for approval of the Final Plat of Massey Oaks Basin 3 creating 2 restricted reserves on ±19.67 acres of land located south of Old Massey Ranch Road and East of Harkey Road. Legal Description: A subdivision of 19.67 acres of land located in the H. Stevens Survey, A-525, City of Pearland, Brazoria County, Texas. General Location: South of Old Massey Ranch Road and East of Harkey Road, Pearland, Texas. Consideration and Possible Action - RPL2025-0628: Final Plat of Alexander Section 3 A request by Gerardo Morales, DHI Engineering, LLC., the applicant; on behalf of Danziger Investments Ltd, owner; for approval of the Final Plat of Alexander Section 3, creating 202 lots, 26 reserves, and 6 blocks on 35.86 acres located south of Bailey Road and West of Main Street described to wit: Legal Description: A subdivision of 35.86 acres of land out of the H. Stevens Survey, A-594, City of Pearland, Brazoria County, Texas General Location: South of Bailey Road and West of Main Street, Pearland, Texas ITEMS REMOVED FROM THE CONSENT AGENDA None. Commissioners Ordeneaux and Fuertes recused themselves from the vote. Commissioner Isenberg called for a motion to approve the consent agenda. Commissioner Haskins made a motion to approve the agenda and Commissioner Echols seconded the motion. Motion passed 4-0. NEW BUSINESS Chairperson Isenberg read into the record the item on Consideration and Possible Action — Conditional Use Permit CUP2025-0571. Consideration and Possible Action - Conditional Use Permit Application: CUP2025-0571 Public Hearing: A request by Benjamin Navo Jr., Draft House Design Studio, LLC, applicant, on behalf of David and Derek Deriso, owners, for approval of a Conditional Use Permit (CUP) for Accessory Dwelling Unit use within the Single -Family Residential -1 (R-1) District, on approximately 0.41 acres of land, to wit: Legal Description: Lot 19 in Block 18 of Green Tee Terrace, Section 2, a Subdivision in the W.D.C. Hall. Survey Abstract No. 23 in Harris County Texas, according to the map recorded in Volume 172, Page 11, et. Seq., of the Plat Records of Harris County, Texas. General Location: 2301 Dublin Circle, Pearland, Texas Planner I Aria Bernal presented the staff report with exhibits requesting an Accessory Dwelling Unit (ADU). The proposed ADU is 665 square feet attached to an existing 547 square foot garage. There were no written comments or phone calls in support or opposition to this request. Planner Bernal also detailed the history of the site and shared the proposed floor plan and elevation renderings. She also shared that the plan met the review criteria for the Future Land Use plan, Thoroughfare plan, United Development Code (UDC) and Utilities. She also stated that all established criteria for approval of a Conditional Use Permit had been met, and that the proposed ADU was not changing the existing character of the surrounding neighborhood. Staff recommended approval of the CUP with the following condition: 1. The CUP shall only allow for the ADU to be occupied by a relative of the person occupying the primary dwelling unit on the property. A representative of the applicant, Chad Creech with HTX Tiny Homes, 1880 S Dairy Ashford Rd., Ste 207, Houston Texas 77077 was present and available for questions. Chairperson Isenberg called for public input. There were no persons wishing to speak for or against this item. The Commissioners discussed their views on ADUs and their impact on the city. There was hesitation on the part of some Commissioners due to the inability to police who lives in ADUs after the applicant for a CUP moves away and another owner comes in. Other Commissioners were supportive of ADUs and did not see a problem approving them. There was no further discussion from Planning and Zoning Commission, Staff or Public Input. Chairperson Isenberg read into the record the item for Consideration and Possible Action CUP2025-0571. Commissioner Trey Haskins made a motion to approve the CUP and Commissioner Shad Comeaux seconded the motion. Motion passed 4-2. Chairperson Isenberg read into the record the item on Consideration and Possible Action — Conditional Use Permit CUP2025-0574. Consideration and Possible Action - Conditional Use Permit Application: CUP2025-0574 Public Hearing: A request by Kenitra Brockington, applicant, on behalf of Thomas D Rasberry, owner, for approval of a Conditional Use Permit (CUP) for Auto Repair (Minor) on approximately 1.12 acres of land within the General Commercial (GC) District, to wit: Legal Description: A 16,462.7 square foot or 0.3779 acre tract of land, being Lot Twelve (12), in Block Twenty (20), of Pearland Townsite, according to the map or plat thereof recorded in Volume 29, page 41 of the Map Records of Brazoria County, Texas; and part of Tract 3, Section 2, H.T.&B. Railroad Company Survey, Abstract 542, City of Pearland, Brazoria County, Texas. General Location: 2418 Main Street, Pearland, Texas. Senior Planner Katie Peterson presented the staff report for a specialized electronics and calibration shop. No written comments or phone calls were received in support or opposition to the proposed CUP. Senior Planner Peterson mentioned that the site is not currently platted, but no expansion is being proposed so it does not need to be. However, any expansion in the future will trigger the need for platting. She also shared the proximity of other auto repair businesses and provided the history of the site. It does meet the criteria for the Future Land Use plan, Thoroughfare plan, UDC and Utilities. The site will need to provide a striping plan for parking. It also meets all the criteria for approval for a CUP and Staff recommends approval. The applicant, Kenitra Brockington, 622 Fite Rd, Pearland Texas, 77581 was available and made a presentation. She is the owner of Modern Speedworks. The intent for her business is to blend in harmoniously with the neighbors and follow all city regulations. She stated that her business is not the typical auto repair shop model. They only work by appointment and referral only — no drop ins are allowed. They do mostly aftermarket design. They are a very small operation. Kenitra works in the office and her husband is the technician. Their space can hold about 8 vehicles with 1 bay, but they do all work indoors. No cars would be left outside. It typically takes them 4 weeks to 1 year to complete a project. Chairperson Isenberg called for public input. There were no persons wishing to speak for or against this request. The Commissioners discussed if there was enough turning radius for fire department vehicles on the frontage road. Senior Planner Peterson stated that the Fire department has reviewed the preliminary site plan, and their only concern was the pinch point where parking is shown to be parallel along the site, but when the owners restripe, they will insure that all requirements for fire access are retained. There was no further discussion from Staff, Planning and Zoning Commission or public input. Chairperson Isenberg read into the record the item on Consideration and Possible Action — CUP2025-0574. Commissioner Haskins made a motion to approve and Commissioner Fuertes seconded the motion. Motion passed 6-0. DISCUSSION ITEMS 1. The City Council update report was given by Senior Planner Katie Peterson. At the January 26th meeting of City Council, the Council postponed the hearing of CUP2025-0572 (Consignment/Resale shop) to February 23rd meeting at the request of the applicant. Applicant could not attend the meeting because of weather. CUP2025-0370 (Antioch Church) at 3801 Liberty Drive was passed 7-0. The UDC amendments related to short term rental and definition of family were passed in first reading 7-0. At the second reading of Zone Change for ZON2025-0457 (Hanover) at 1021 Main Street, Council added a condition that the applicant will enter into an agreement with the City within 90 days of January 26th, 2026 for the reconstruction of Knapp Road and the motion was then passed 6-1. 2. The City Council and P&Z Joint Workshop will be February 9th, 2026 at 4:30pm. 3. The next P&Z Regular Meeting will be February 16th, 2026.
