R2026-34 A Resolution of the City Council of the City of Pearland, Texas, ordering a Special Election to be held on May 2, 2026, for the purpose of considering the adoption of the fire fighters’ Civil Service Law pursuant to Chapter 143, Texas Local Government Code establishing the procedure; and providing for other related matters related thereto. WHEREAS, Chapter 143 of the Texas Local Government Code authorizes a municipality to adopt the Fire Fighters’ Civil Service Law by election; and WHEREAS, Section 143.004 of the Texas Local Government Code requires the governing body of a municipality to order an election if it receives a petition requesting such an election signed by a number of qualified voters of the municipality equal to at least ten percent (10%) of the voters who voted in the most recent municipal election at which voters cast ballots; and WHEREAS, on January 5, 2026, a petition requesting an election for the “Adoption of the fire fighters’ civil service law” was timely filed with the City Secretary of the City of Pearland; and WHEREAS, on January 9, 2026, the City Secretary executed a Certificate of Sufficiency of Petition certifying that the petition complies with the requirements of Section 143.004, Texas Local Government Code, and is sufficient; and WHEREAS, upon certification of a sufficient petition, the City Council has a mandatory duty under state law to order an election submitting the proposition to the voters; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The City Council hereby finds and determines that the foregoing recitals are true and correct and are incorporated herein for all purposes. Section 2. A Special Election is hereby ordered to be held in the City of Pearland, Texas, on May 2, 2026, a uniform election date prescribed by the Texas Election Code, for the purpose of submitting to the qualified voters of the City the following proposition: “SHALL THE FIRE FIGHTERS’ CIVIL SERVICE LAW BE ADOPTED FOR THE CITY OF PEARLAND?” Section 3. The Special Election shall be conducted in accordance with the Texas Election Code, Chapter 143 of the Texas Local Government Code, and other applicable laws. The election shall be held as a joint election, and the City Secretary is authorized to execute an election services contract with Brazoria County for the conduct of the election. Section 4. The official ballots shall be prepared in accordance with the Texas Election Code, as amended, so as to permit electors to vote “FOR” or “AGAINST” the proposition. Voters should place an “X” in the square beside the statement indicating the way they wish to vote. Section 5. Election Day polling places, early voting locations, voting hours, and election officers shall be those designated by Brazoria County, Texas, in accordance with the Texas Election Code. Each qualified voter who desires to cast an early vote shall be entitled to an official ballot and the right to cast such ballot in accordance with the provisions of the Texas Election Code. Early voting will be conducted by the Early Voting Clerks at the places designated by Brazoria County. The location of the main early voting polling place for each county is as follows: Brazoria County East Annex 1524 E Mulberry Pearland, TX 77515 Early voting by personal appearance shall commence on Monday, April 20, 2026, and end on Tuesday, April 28, 2026, in accordance with the schedules adopted by Brazoria County. Applications for a ballot to be voted on by mail should be mailed as follows: County Clerk 237 E. Locust Street, Suite 102 979-864-1011 County Clerk 1524 E Mulberry #145 Pearland, Texas 77515 If an application is sent to the early voting clerk by fax or email, the original application must still be mailed and received by the early voting clerk no later than the fourth business day after receiving the emailed or faxed ABBM or faxed FPCA, to the address shown above for Regular Mail. The last day to submit an application for a ballot to the respective Early Voting Clerk to be voted by mail is April 20, 2026 (received, not postmarked). Section 7. The Central Counting Stations to receive and tabulate voted ballots shall be located at the Brazoria County East Annex, 1524 E Mulberry, Pearland, TX 77515. Section 8. Notice of the Special Election shall be given in the manner and within the time required by the Texas Election Code and other applicable law. The Mayor and City Secretary are authorized and directed to cause such notice to be given. Section 9. In all matters relating to the ordering and holding of the Special Election, the City shall comply with the Texas Election Code, including Chapter 272 regarding bilingual election requirements, and the Federal Voting Rights Act of 1965, as amended. Section 10. It is hereby officially found and determined that the meeting at which this Resolution was adopted was open to the public and that public notice of the time, place, and purpose of said meeting was given as required by Chapter 551, Texas Government Code. Section 11. This Resolution is effective immediately upon its passage and approval.
