HomeMy WebLinkAbout20251215 City Council Regular Meeting MinutesPearland City Council Minutes December 15, 2025 CITY OF PEARLAND, TEXAS CITY COUNCIL REGULAR MEETING MINUTES DECEMBER 15, 2025 The City Council of Pearland, Texas convened in a meeting on Monday, December 15, 2025 at the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I.CALL TO ORDER II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Cole gave the Invocation and Mayor Pro-Tem Byrom led the Pledge of Allegiance III.ROLL CALL AND CERTIFICATION OF QUORUM IV.CITIZEN COMMENTS V.CONSENT AGENDA A.Consideration and Possible Action - Second and Final Reading of Ordinance No. 1650-1 - Pearland, Texas, amending Ordinance No. 1650, the 2025- Budget Ordinance, to facilitate the changes identified herein; providing a savings clause, a severability clause, a repealer clause, and an effective denying Texas-New Mexico Power Company’s proposed rate increase in Docusign Envelope ID: 61A497BD-9D13-46E0-8E13-C71D923DD1C6 Pearland City Council Minutes December 15, 2025 14, 2025; requiring the reimbursement of municipal rate case expenses; authorizing participation in the coalition of similarly situated cities; authorizing intervention and participation in related rate proceedings; authorizing the retention of special cou Resolution of the City Council of the City of Pearland, Texas, authorizing an Interlocal Agreement with Brazoria County for paving services, for the Councilmember Koza made the motion, seconded by Mayor Pro-Tem Byrom to approve the Consent Agenda items A - C. AYES: Byrom, Koza, Carbone, Chavarria, Fernandez, and Patel. NAYS: None. VI.MATTERS REMOVED FROM CONSENT AGENDA VII.PUBLIC HEARING NO. 1 1.Public Hearing: A request by Travis McDonnell, Rockport Ventures LLC., applicant, on behalf of Terry Oppliger, Jachel Partnership LTD., owner, for Professional (OP) District to Planned Devel accommodate a proposed Multifamily development, to wit: Legal Description: A 15.0372-acre tract of land situated in the H.T. & B.R.R. Company Survey, Abstract No. 547, Brazoria County, Texas; said 15.0372 acre tract being all of a called 15.0375-acre tract of record in the name of Jachel Partnership, LTD., in B Number 2018064763. General Location: North of Magnolia Parkway, West of Manvel Road, Pearland, Texas. Mayor Cole opened the Public Hearing. Presentation was provided by Patrick Bauer, Senior Planner. presentation and was present to answer questions from Council. Terry Oppliger, property owner, spoke in favor of the zone change request. Jennifer Evans spoke in favor of the zone change request. Jorge Dela Garza spoke in opposition to the zone change request. Eneida Juarez spoke in opposition to the zone change request. Cathie Tydelski spoke in favor of the zone change request. Carol Compton spoke in favor of the zone change request. Emet Torres spoke in opposition to the zone change request. Tony Void, of Void Associates, answered questions from the Council. Council. Mayor Cole closed the Public Hearing. VIII.NEW BUSINESS NO. 1 1.Consideration and Possible Action - First Reading of Ordinance No. 2000M-278 - Pearland, Texas, for the purpose of changing the classification of certain property; being a 15.0372-acre tract of land situated in the H.T. & B.R.R. Company Survey, Abstract No. 547, Brazoria County, Texas; said 15.0372 acre tract being all of a called 15.0375-acre tract of record in the name of Jachel Par Number 2018064763 (located North of Magnolia Parkway, West of Manvel Road, Pearland, Texas). Zone Change Application No. ZON2025- request by Travis McDonnell, Rockport Ventures LLC., applicant, on behalf of Terry Oppliger, Jachel Partnership LTD., owner, for approval of a zone change for 15.0372 acres of land from Office & Professional (OP) District Multifamily development; provi district map; containing a savins clause, and an effective date and other provisions related to the subject. Councilmember Carbone made the motion, seconded by Councilmember Fernandez to approve the first reading of Ordinance No. 2000M-278. Eight-foot cedar fence along rear Northern property line. 2.Provide trees every five parking spaces along the North property line. 3.Reduce height to three-story and no balcony on the North side. AYES: Byrom, Koza, Carbone, Chavarria, and Fernandez. NAYS: Patel. to approve the first reading of Ordinance No. 2000M-278 as amended. AYES: Byrom, Koza, Carbone, and Fernandez. NAYS: Chavarria and Patel. IX.PUBLIC HEARING 2.Public Hearing: Regarding the proposed amendments to the City Charter. Mayor Cole opened the Public Hearing. Darrin Coker, City Attorney, discussed the next steps for the publication for the changes to the City Charter. There were no citizen comments. Mayor Cole closed the Public Hearing. X.OTHER BUSINESS XI.MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION XII.EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 8:04 p.m. Section 551.074 - Discussion regarding personnel transitions in the Legal Department.
