M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The hearing was called to order with the following present: Mayor Tom Reid Mayor Pro Tem/Councilmember Richard Tetens Councilmember Jerry Richardson Councilmember Randy Weber Councilmember Helen Beckman Planning & Zoning Chairman Pat Lopez Vice Chairman Emil Beltz Commissioner Marshall Eggers Commissioner Jeffery O'Brien Commissioner Randy Patro City Manager Paul Grohman City Attorney Amy McCullough City Secretary Yolanda Benitez Others in attendance: Assistant City Managers Glen Erwin and Richard Burdine, City Engineer John Hargrove, Chief of Police Mike Hogg, and Economic Development Director Jim Berry. Absent from the hearing: Councilmember Cole. PURPOSE OF THE HEARING: Application No. 57 REQUEST OF HAROLD LOTT, AGENT FOR PEARLAND REALTY HOLDINGS, INC., OWNER, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY FROM CLASSIFICATION LIGHT INDUSTRIAL DISTRICT (M-1) TO HEAVY INDUSTRIAL DISTRICT (M-2) ON THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: LOT 40 ZYCHLINSKI SUBDIVISION IN SECTION NO. 3, H.T.&B. RAILROAD COMPANY SURVEY, ABSTRACT 232, BRAZORIA COUNTY, TEXAS, AS PER THE MAP OR PLAT THEREOF RECORDED IN VOLUME 29, PAGE 43 OF THE DEED OF RECORDS OF BRAZORIA COUNTY, TEXAS, BEING DESCRIBED IN QUITCLAIM DEED, DATED OCTOBER 7, 1994, BUT TO BE EFFECTIVE OCTOBER 11, 1994, FROM THE ESTATE OF LESLIE EINSTEIN FORBES, JOANN ROSENBERGER LANG, AND GERRIE ROSENBERGER SOMAN, TO PEARLAND REALTY HOLDINGS, INC., AND FILED FOR RECORD ON OCTOBER 12, 1994, IN THE OFFICIAL RECORD OF BRAZORIA COUNTY AS INSTRUMENT #94-037254, AND BEING THE SAME PROPERTY DESCRIBED IN WARRANTY DEED FROM FRANCES S. EINSTEIN, TRUSTEE, AND LEO J. ROSENBERGER, TRUSTEE, TO LESLIE EINSTEIN FORBES, JOANN ROSENBERGER LANG, AND GERRIE ROSENBERGER SOMAN, AND RECORDED ON MAY 19, 1980, AT VOLUME 1512, PAGE 423, OF THE DEED RECORDS OF BRAZORIA COUNTY, TEXAS. PERSONS WISHING TO SPEAK IN SUPPORT: 1. Paul Staton - 6550 Fair Street, Houston, Texas. Mr. Staton spoke on behalf of the sellers of the property. He pointed out that this project will create 10-25 jobs and increase the tax base for the City of Pearland. 2. Harold Lott, P. O. Box 79591, Houston, Texas 77279. Mr. Lott stated that he is the agent for the seller, but also has a contract to purchase the land. He explained the proposed uses for the property in question, which is to manufacture urethane products; mix them into two-part components; and package them r. into 1 -gallon containers, 5 -gallon containers, or 55 -gallon drums. Mr. Lott also noted that the products are organic and will not create an environmental problem. He stated that the property would contain an area for manufacturing the products, a laboratory, and an office. STAFF REVIEW: A map of the area in question was shown. Jim Berry, Economic Development Director, stated that the PEDC had been working with this company to help them find a site and recommended that Council approve this application. PERSONS WISHING TO SPEAK AGAINST: None QUESTION AND ANSWER PERIOD Councilmember Beckman requested clarification with regard to why this business was considered heavy industrial over light industrial. Assistant City Manager Burdine explained that it was solely because of the manufacturing process. Planning & Zoning Commission Vice Chair Emil Beltz inquired as to whether EPA had given their approval of this project. Mr. Burdine noted that TNRCC is the issuing agency and further pointed out that approval is not required because of the nature of the product. Mayor Reid announced that the Planning & Zoning Commission would be meeting in the Second Floor Conference Room immediately following the public hearing. ADJOURNMENT The hearing adjourned at 7:20 P.
