1974-07-15 CITY COUNCIL PUBLIC HEARING MEETING MINUTESas MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 15, 1974, AT 7:30 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Carlton McComb Councilman Cecil W. Griffin Councilman Harry Farley Councilman Gene E. Sanders Councilman Tom Reid Councilman Benny J. Frank City Manager William E. Wolff City Attorney Bobby J. Williams City Engineer Malcolm Collins Assistant City Secretary Patty Goldenberg Others present: C. Earle Maxwell, Realtor, Gary L. Schafer, E. G. Felty, Mrs. E. G. Felty, Harry S. Smith, John DeMuri, J. 0. Hazelwood, Anna Williamson, Wenzel G. French, Richard Tetens, Dan R. Keller, Dean Campbell, Jeanne Lee Crews, Albert H. Crews, Mrs. Jake Jamison, Frances Jamison, L. C. Krchnak, and Sandra Krchnak. INVOCATION AND PLEDGE OF ALLEGIANCE: The invocation was given by Tom Reid. The Pledge of Allegiance was led by Cecil Griffin. 01— PURPOSE OF THE HEARING: Street Assessment Hearing against abutting property owners for a portion of the cost of improvements to Shadycrest Drive, Shadybend Drive, Marys Creek Lane West and Marys Creek Lane East. STREET IMPROVEMENT COST DISTRIBUTION: Shadycrest Drive - Total Footage 4,257.7 feet. Total Property Footage 8,368,98 feet. Owner Assessment $2.00 per front foot; Property Owner's Cost $16,737.96; City's Cost above assessment $15,833.60; Total Construction Cost $ 32,571.56. Shadybend Drive -, Total Footage 839.41 feet. Total Property Footage 1,558.81. Owners Assessment $2.00 per front foot; Property Owner's Cost $3,117.62; City's Cost above assessment $ 3,303.87; Total Construction Cost $6,421.49. Marys Creek Lane West -- Total Footage 805.58. Total Property Footage 1,551.11, Owners Assessment $2.00 per front foot; Property Owner's Cost $3,102.22; City's Cost above assessment $3,060.47; Total Construction Cost $6,162.69. Marys Creek Lane East A Total Footage 605.11. Total Property Footage 1,056.88. Owners Assessment $2.00 per front foot; Property Owner's Cost $2,113.76; City's Cost above assessment $2,515.33; Total Construction Cost $4,629.09. TESTIMONY ON BEHALF OF THE CITY: Bobby Williams, City Attorney, called for testimony by Malcolm Collins, City Engineer. Mr. Collins testified that prior to improvements the streets were shell street with bar ditches - 18 feet to 20 feet wide. The streets now have a 7 inch layer of crushed concrete with a double penetration of asphalt and rock. Mr. Collins explained that Property footage is figured percentage wise and the City is paying between 48, and 54% of the street paving cost. Mayor McComb asked the audience if any present would like to ask questions of the City Engineer. The following responded: John B. Williamson - Asked about street width and depth, also, about grass growing on edges of streets. Mr. Collins advised that he check the streets about two weeks ago and the streets met specifications. Richard Tetens - Asked about inspection made by the Engineer and whether or not any deficiencies were found. Mr. Collins advised that that he found some areas of deficiencies but that they were now corrected. Albert Crews - Asked when the improvement were made. Mr. Collins advised that it was approximately 2 years ago. E. G. Felty - Asked about the grass growing through the streets. Mr. Collins advised that this was a maintenance problem and that the streets would be maintained. John DeMuri - Asked that the Engineer make another inspection of the streets. L. C. Krchnak - Discussed with the Engineer the condition of the street in front of his home. Jeanne L. Crews - Made statement that as new residents they thought that the roads would be paved, she did not realize that they were completed. Dan Keller - :Asked several questions regarding the width, depth, etc. of Marys Creek Lane West. Mr. Collins advised that this street met the specifications as set out in the participation paving program. Cold mix asphalt was used to bring the street up to specifications, however, he -consider ed this to be as good as or better than the double penetration asphalt, Bobby Williams, City Attorney, called for testimony from C. Earle Maxwell, Realtor, Mr. Maxwell advised that the streets referred to in this public hearing were in very poor condition prior to work done by the City on the participation paving program, Mr. Maxwell testified that the property has appreciated in value since the completion of this paving program. He further testified that the front foot of each piece of property has been enhanced in value of a minimum of $2.00 per front foot. several individuals from the audience asked questions of Mr. Maxwell. PROPERTY OWNER'S TESTIMONY: Jeanne Lee Crews asked for an explanation of the Street Participation Paving Program of the City. Mayor McComb explained this policy to her. Dan Keller asked that consideration be given on the cost per front foot for what he felt was not minumum specifications as set out in the participation paving program, Wenzel G. French expressed his satisfaction with the street and stated that he was ready to pay his assessment. L. C. Krchnak stated that he felt the street did not meet specifications -on width, however, he stated that the street has held up well. E. G. Felty expressed concern over his driveway not being returned to original condition after being damaged by the City's contractor laying sewer lines in the area a few years ago. WN ORDINANCE NO. 288 and ORDINANCE NO. 289: It was moved by Councilman Frank, seconded by Councilman Reid that the Council not read Ordinance No. 288 and Ordinance No. 289 at this Public Hearing. Motion passed 5to0. It was moved by Councilman Sanders, seconded by Councilman Frank that the City Manager and City Engineer reinspect the streets contained in these ordinancesand report back to the Council prior to reading the ordinances in a regular Council meeting.
