MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON
JULY 8, 1974, AT 7:30 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS.
The meeting was called to order with the following present:

INVOCATION AND PLEDGE OF ALLEGIANCE:
The invocation was given by Council Chaplain Art Jones, The Pledge of Allegiance was led
by Councilman Sanders.
APPROVAL OF MINUTES:
It was moved by Councilman Frank, seconded by Councilman Reid that the m:4iutes of. the,
regular meeting held on June 24, 1974 be approved as submitted. Motion passed 4 to 0c
It was moved by Councilman Reid, seconded by Councilman Sanders.that the minutes
of a Public Hearing held on July 1, 1974, be approved as submitted, Motion passed 4 to 0,
MAYOR'S ACTIVITY REPORT:
Texas Air Control Board: Mayor McComb read a letter dated July, 2, 19:74, from Bill
Stewart, P. E., Director Control and Prevention, Texas Air Control Board, regarding
complaints received from citizens along Dixie Farm Road. These complaints concerned
heavy dust raised by vehicular traffic along Dixie Farm Road, This letter requested
that appropriate remedial action be taken as soon as possible, Mayor McComb advised
that the portion of Dixie Farm Road involved in the complaint was south of F. M. 518,
and that an investigation is underway to determine the best method to handle this,
situation. Mayor McComb outlined the various methods so far determined to correct
this problem. (1) Use of road oil at a cost of approximately $2,000.00, however,
this would be a temporary solution' --since the first rain would likely wash most of the
oil away; (2) Paving this portion of Dixie Farm Road and with a minimum base and
minimum top would cost $12,000.00 for materials. We have no money available for either
(1) or (2); (3) Participation paving program but we have had no individuals signing
up for this type of program; (4) A non -participation paving program which means that
by going through certain legal actions, the City can assess the property owners 90%
of the cost with the City paying 10%.
Mayor McComb advised that the City Attorney was out of town and when he returned
all of the variables would be checked out and a report made to the City Council. We
will answer the letter to the Air Control Board this week and advise them that we are
investigating the problem.
COUNCIL ACTIVITY REPORTS:
Cotncilman Sanders reported that he has been reviewing Ordinance No. 278 and noted several
discrepances between this ordinance and the sand Use Ordinance and other ordinances.

CouncilmanSanders reported that he had prepared his findings in a report. This
report will be sent to members of the Council in the next few days.
DEPARTMENTAL REPORTS:
City Manager Wolff requested concurrence by the City Council to continue the employment
of C. C. Davis and Carl Erwin. Both men are over 65, however, have been given a physical
by Dr. Rau, and he advised that they were physically able to continue in their present
jobs. The present Personnel Ordinance permits extension of employment for six month
increments after age 65 and a physical examination indicating sufficient good health to
permit continuation of employment.
It was moved by Councilman Reid, seconded by Councilman Sanders that the employment of
C. C. Davis and Carl Erwin be extended with the City for an addition six months tipohl.+-he
recommendation of the City Manager. Motion passed 4 to 0.
City Manager Wolff asked that Shadybend Drive and East Circle Drive be given priority
preference in the street participation paving program so that the streets could be
completed by the opening of school in August.
It was moved by Councilman Reid, seconded by Councilman Frank that Shadybend Drive and
East Circle Drive be given top priority for paving as a greater public need in order that
paving may be completed prior to the opening of school in August. Motion passed 4 to 0.
CITIZENS:
Mrs. Donald C. Shane - Mrs. Shane appeared before the Council with a request that the
name of Meath Circle in Green Tee Subdivision be changed to Price Circle since the
Prices' own all of the buildable lots in the circle.
Mr. Weldon Flanakin - Mr. Flanakin appeared before the Council with a request that
the City extend water service down Yost Road without the citizens along the road having
to give road right-of-way as previously set out by the City Council. Mayor McComb
advised Mr. Flanakin that this matter would be placed on the next agenda for further
discussion by the City Council.
Mr. Joe Koza, Jr. - Mr. Koza appeared before the Council and lodged a complaint against
the Police Chief and Police Department for lack of surveillance of his property located
on South Main Street. He reported that his building had been broken into several times
recently.

It was moved by Councilman Sanders, seconded by Councilman Reid that Councilman Farley's
r-- absence from the regular council meeting be shown as "excused absence." Motion passed
4 to 0.
RECESS: 8:45 P. M. - RECONVENED 8:50 P. M.
STREET NAME CHANGE:
The Council considered the request for a name change in Green Tee Subdvision. Meath
Circle to Price Circle.
It was moved by Councilman Reid, seconded by Councilman Griffin that the street name
Meath Circle in Green Tee Subdivision be changed to Price Circle and that the official
City records be changed accordingly. Motion passed 4 to 0.
REQUEST BY ENTEX FOR RATE INCREASE:
A discussion was held with Entex regarding a request for a rate adjustment in residential
and commercial natural gas service. The Entex was advised that if this request was
for a rate increase and not an adjustment in gate rate costs then the provisions of the
Charter calling for a Public Hearing and a Rate Ordinance would have to be complied with.
Entex was requested to furnish the City Council with a copy of Texas Railroad Commission
decisions which have been affirmed by the Texas Courts. This is information referred
to in United Gas Corporation's letter of February 7, 1973. Upon receipt of this
information and review of the matter by the City Attorney, the matter will again be
placed on the agenda.
