CITY COUNCIL REGULAR MEETING MINUTES
NOVEMBER 17, 2025
The City Council of Pearland, Texas convened in a meeting on Monday, November 17, 2025 at
the Pearland City Hall Council Chambers, 3519 Liberty Drive, Pearland, Texas. The following
represents the actions taken by City Council in the order they occurred during the meeting. All
motions are made by Council in consecutive order, as determined by the Mayor.
I. CALL TO ORDER
Mayor J. Kevin Cole called the meeting to order at 6:34 p.m.
II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF
AMERICA FLAG AND TEXAS FLAG
Mayor Cole gave the Invocation and Councilmember Koza led the Pledge of
Allegiance to the United States of America Flag and the Texas Flag.
III. ROLL CALL AND CERTIFICATION OF QUORUM
All members were present.
IV. CITIZEN COMMENTS
Tommy Echols spoke regarding his candidacy for Pearland City Council.
Jim Johnson, President with the Pearland Chamber of Commerce, recognized the
Leadership Pearland Class of 2026.
V. CONSENT AGENDA
A. Consideration and Possible Action - Second and Final Reading of
Ordinance No. 1654 - An Ordinance of the City Council of the City of
Pearland, Texas, amending the Project Plan and Reinvestment Zone
Financing Plan for Reinvestment Zone Number Two (Amendment No. 6),
City of Pearland, Texas to facilitate the construction of City facilities and
infrastructure improvements (“Improvements”); authorizing the City

Secretary to distribute such plans; containing findings and provisions
related to the foregoing subjects; and providing for severability.
B. Consideration and Possible Action - Resolution No. R2025-193 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
a second extension of Preliminary Plat 22-109 (Massey Oaks, Basin 3) in
accordance with Section 1.2.5.4 of the Unified Development Code.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
VI. MATTERS REMOVED FROM CONSENT AGENDA
There were no items removed from Consent Agenda.
VII. PUBLIC HEARING NO. 1
1. Public Hearing: A request by Austin Britt, applicant, on behalf of Anthony
Guiliani, owner, for approval of a Conditional Use Permit (CUP) for
Restaurant (with Drive-Thru Service) use within the Neighborhood
Service zoning district, on 1.189 acres of land, to wit:
Legal Description: Being a 1.189 acres, or 51,782 square feet more or
less, being a portion out of 9.6135 acre tract, conveyed to G and G
Partners Development, LLC, as described in a deed recorded in Brazoria
County Clerk’s File No. 2017043843 of the Official Public Records of
Brazoria County, Texas, situated in the Warren DC Hall Survey, Abstract
No. 70, in the City of Pearland, Brazoria County, Texas.
General Location: 3203 Dixie Farm Road, Pearland, Texas.
Mayor Cole opened the Public Hearing.
Presentation was provided by Martin Griggs, Deputy Director of Community
Development.
Connor J. McBride, P.E., with Pape-Dawson Engineers, gave a presentation
and was present to answer questions from Council.
Chris Puente spoke in opposition to the Conditional Use Permit.
Pat Lopez spoke in opposition to the Conditional Use Permit.
Robert Newlin spoke in opposition to the Conditional Use Permit.

VIII. NEW BUSINESS NO. 1
1. Consideration and Possible Action - Resolution No. R2025-CUP2025-0449
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for Restaurant (with Drive-
Thru Service) use within the Neighborhood Service (NS) zoning district,
on 1.189 acres of land, being a 1.189 acres, or 51,782 square feet more or
less, being a portion out of 9.6135 acre tract, conveyed to G and G

applicant, on behalf of Anthony Guiliani, owner, containing a savings
clause, a severability clause, and an effective date and other provisions
related to the subject.
AYES: None.
NAYS: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
The motion failed.
IX. PUBLIC HEARING NO. 2
2. Public Hearing: A request by James Melody, applicant, on behalf of Bell
Bottom Foundation Company and Luis Perret, owners, for approval of a
zone change for 29.359 acres of land from General Commercial (GC)
District to Planned Development (PD) District for a Warehouse
Development, to wit:

General Location: South of 1021 North Main Street, Pearland, Texas.
Mayor Cole opened the Public Hearing.
Presentation was provided by Martin Griggs, Deputy Director of Community
Development.
James Melody, applicant, gave a presentation and was present to answer
questions from Council.
Ethan Harwell, Land Use Planner with Kimley-Horn and Associates, gave a
presentation and was present to answer questions from Council.
Laney Davis, P.E., Civil Engineer with Kimley-Horn and Associates, was
present to answer questions from Council.
Angie Infant expressed concern regarding the placement of the retention pond.
Elias Barrasa spoke in opposition to the zone change request.
Alejandro Barrasa spoke in opposition to the zone change request.
Brad Crain spoke in opposition to the zone change request.
Amy Bright spoke in opposition to the zone change request.
Brigette DelValle spoke in opposition to the zone change request.
Jeanie Massey spoke in opposition to the zone change request.
Stefan Spedz spoke in opposition to the zone change request.

X. NEW BUSINESS NO. 2
2. Consideration and Possible Action - First Reading of Ordinance No.
2000M-277 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain
property; being a 28.24-acre tract of land situated in the H.T. & B.R.R.
Company Survey, Abstract No. 542, Brazoria County, Texas, and 1.119
acres being all of Lot 4, Block 1 of the Ferri Subdivision Replat No. 1 as

recorded in Document No. 2025039635 in the Official Public Records of
Brazoria County, Texas (located South of 1021 North Main Street,
Pearland, Texas). Zone Change Application No. ZON2025-0457, a request
by James Melody, applicant, on behalf of Bell Bottom Foundation
Company and Luis Perret, owners, for approval of for 29.359 acres of
land from General Commercial (GC) District to Planned Development (PD)
District for a Warehouse Development; providing for an amendment of
the zoning district map; containing a savins clause, and an effective date
and other provisions related to the subject.
Councilmember Chavarria made the motion, seconded by Councilmember
Koza to approve the first reading of Ordinance No. 2000M-277.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
XI. PUBLIC HEARING NO. 3
3. Public Hearing: A request by Alan Mueller, applicant, on behalf of FM 529
Ventures, LLC., owner, for approval of a zone change for 13.303 acres of
land from General Business (GB) District to Planned Development (PD)
District, to accommodate a proposed mixed-use development consisting
of Multifamily and General Business components, to wit:
Legal Description: A 13.303-acre tract of land situated in the H.T. & B.R.R.
Co. Survey, Sec. 17, Abstract Number 242, Brazoria County, Texas; being
all of a called 13.30-acre tract of land conveyed to Raymond St. Germain,
Sr. as described by deed recorded in Volume 89641, Page 611, Brazoria
County Deed Records (B.C.D.R.).
General Location: Southeast Corner of Broadway Street and Oak Road,
Pearland, Texas.
Mayor Cole opened the Public Hearing.
Presentation was provided by Patrick Bauer, Senior Planner.
Alan Mueller, applicant, and Nick Motamedi, owner, AIMAS Properties, LTD.,
gave a presentation and were present to answer questions from Council.
Anastasia Cox spoke in opposition to the zone change request.

3. Consideration and Possible Action - First Reading of Ordinance No.
2000M-276 - An Ordinance of the City Council of the City of Pearland,
Texas, amending Ordinance No. 2000M, the zoning map of the City of
Pearland, Texas, for the purpose of changing the classification of certain
property; being a 13.303-acre tract of land situated in the H.T. & B.R.R.
Co. Survey, Sec. 17, Abstract Number 242, Brazoria County, Texas; being
all of a called 13.30-acre tract of land conveyed to Raymond St. Germain,
Sr. as described by deed recorded in Volume 89641, Page 611, Brazoria
County Deed Records (B.C.D.R.) (located at the Southeast Corner of
Broadway Street and Oak Road, Pearland, Texas). Zone Change
Application No. ZON2025-0454, a request by Alan Mueller, applicant, on

4. Public Hearing: A request by Enrique and Lisa Cruz, owners, for approval
of a Conditional Use Permit (CUP) for an expansion to an existing Auto
Repair (Minor) use within the Old Town-General Business (OT-GB)
District, on approximately 0.4224 acres of land, to wit:
Legal Description: Lots 10, 11 and 12, Block E of the Pearland Townsite,
a subdivision in Brazoria County, Texas, according to the map or plat
thereof recorded in Volume 29, Page 41 of the Plat Records of Brazoria
County, Texas.
General Location: 2121 Main Street, Pearland, Texas.

Council.

4. Consideration and Possible Action - Resolution No. R2025-CUP2025-0453
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for an expansion to an existing
Auto Repair (Minor) use within the Old Town-General Business (OT-GB)
District, on approximately 0.4224 acres of land, being Lots 10, 11 and 12,

5. Consideration and Possible Action - Resolution No. R2025-CUP2025-0343
- A Resolution of the City Council of the City of Pearland, Texas,
approving a Conditional Use Permit (CUP) for Dwelling - Two-Family use
within the Old Town-Mixed Use (OT-MU) District, to accommodate four (4)
two-family dwelling units on four separately platted lots totaling 0.424
acres of land, being all of Lots 12-16 and the northern 23 feet of Lot 17, in
Block 26 of Pearland Townsite, a subdivision in Brazoria County, Texas,
according to the map or plat thereof recorded in volume 29, Page 41 of
the Plat Records of Brazoria County, Texas (located at 2523, 2525, 2527,
2529, 2531 Grand Boulevard, Pearland, Texas). Conditional Use Permit

No. CUP2025-0343, for Dwelling - Two-Family use within the Old Town-

applicant and owner, containing a savings clause, a severability clause,
and an effective date and other provisions related to the subject.
Councilmember Fernandez made the motion, seconded by Councilmember
Cade to approve Resolution No. R2025-CUP2025-0343.
Chris Wilcox and Brian Starr, applicants, were present to answer questions
from the Council.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.

6. Consideration and Possible Action - Resolution No. R2025-192 - A
Resolution of the City Council of the City of Pearland, Texas, amending a
Construction Manager at Risk contract (Barry Rose Water Reclamation
Facility and Longwood Water Reclamation Facility Decommission Project
Project) with McCarthy Building Companies, establishing a Guaranteed
Maximum Price 3 (GMP 3) in the amount of $23,236,960.00.
AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel.
NAYS: None.
The motion carried.
