The following represents the actions taken by City Council in the order they occurred during the meeting. All motions are made by Council in consecutive order, as determined by the Mayor. I.CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:35 p.m. II.INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Pro-Tem Byrom gave the Invocation and Councilmember Fernandez led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III.ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. IV.CITIZEN COMMENTS There were no citizens comments. V.CONSENT AGENDA A.Consideration and Possible Action - Approval of the minutes of the Pearland City Council Special meeting held on October 13, 2025 and City Council Regular meeting held on October 13, 2025. B.Consideration and Possible Action - Second and Final Reading of Ordinance No. 528-11 - An Ordinance of the City Council of the City of Pearland, Texas amending Chapter 6, Animals, of the City of Pearland Code of Ordinances, as it may have been amended from time to time; having a savings clause; severability clause; having a repealer clause; providing for codification; and providing an effective date and for Page 1 of 8 Docusign Envelope ID: A0AAB172-A93E-423D-95AD-FDAA31EED216 Pearland City Council Minutes November 10, 2025 publication. C.Consideration and Possible Action - Resolution No. R2025-181 - A Resolution of the City Council of the City of Pearland, Texas, authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation for Pearland Parkway at Barry Rose Intersection Improvements Project. D.Pulled for discussion. E.Consideration and Possible Action - Resolution No. R2025-171 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative purchasing program for the purchase of technology equipment and hardware from CDW Government, in the estimated amount of $350,000.00. F.Consideration and Possible Action - Resolution No. R2025-172 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative purchasing program, for the purchase of computer equipment, from Dell Computer Equipment, in the estimated amount of $300,000.00. G.Consideration and Possible Action - Resolution No. R2025-191 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative purchasing program, for the purchase of access control technologies and service plan, from Convergint, in the estimated amount of $210,377.00. Councilmember Koza made the motion, seconded by Councilmember Cade to approve the Consent Agenda items A-G, except D. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VI.MATTERS REMOVED FROM CONSENT AGENDA D.Consideration and Possible Action - Resolution No. R2025-190 - A Resolution of the City Council of the City of Pearland, Texas, authorizing execution of an Advance Funding Agreement (AFA) with the Texas Department of Transportation for SH 35 Improvements Project, in the amount of $333,120.00. Councilmember Koza made the motion, seconded by Mayor Pro-Tem Byrom to approve Resolution No. R2025-190. NAYS: None. The motion carried. Councilmember Koza made the motion, seconded by Mayor Pro-Tem Byrom to approve Resolution R2025-190 as amended. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. VII.PUBLIC HEARING NO. 1 1.Public Hearing: A request by Hamad Elsaadi, applicant, on behalf of 2011 Property, Inc., owner, for approval of a Conditional Use Permit (CUP) for Food Store/Supermarket use within the Neighborhood Service (NS) District, on 0.8199 acres of land, to wit: Legal Description: Being a tract or parcel containing 0.8199 acre (35,718 square feet) of land situated in the W.D.C. Hall Leage, Abstract Number 70, Brazoria County, Texas; being all of a called 0.613 acre tract of record in the name of 2011 Property, Inc., in Brazoria County Clerk’s File (B.C.C.F.) Number 2024035106 and all of a called 0.2673 acre tract of record in the name of 2011 Property, Inc., in B.C.C.F. Number 2024045816; Saif 0.8199 acre tract also being out of and a part of Commercial Reserve in Vie Villa, a subdivision duly of record in Volume 14, Page 60, in the Plat of Records of Brazoria County (B.C.P.R.), Texas. General Location: Northwest corner of Yost Boulevard and Broadway Street, Pearland, Texas. Mayor Cole opened the Public Hearing. Presentation was provided by Martin Griggs, Deputy Director of Community Development. John Linton, Lead Architect and Partner with Altar Group LLC. and Hamad Elsaadi, applicant, gave a presentation and were present to answer questions from Council. There were no citizen comments. NEW BUSINESS NO. 1 1.Consideration and Possible Action - Resolution No. R2025-CUP2025-0432 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for a Food Store/Supermarket use within the Neighborhood Services (NS) District, on approximately 0.8199 acres of land, being a tract or parcel containing 0.8199 acre (35,718 square feet) of land situated in the W.D.C. Hall Leage, Abstract Number 70, Brazoria County, Texas; being all of a called 0.613 acre tract of record in the name of 2011 Property, Inc., in Brazoria County Clerk’s File (B.C.C.F.) Number 2024035106 and all of a called 0.2673 acre tract of record in the name of 2011 Property, Inc., in B.C.C.F. The motion carried. IX. PUBLIC HEARING NO. 2 2.Public Hearing: Regarding Tax Increment Reinvestment Zone No. 2: Amendment No. 6. Mayor Cole opened the Public Hearing. Presentation was provided by Trent Epperson, City Manager; Joel Hardy, Head of External Affairs; and Alan Mueller, Consultant with Marsh Darcy Partners LLC. There were no citizen comments. Mayor Cole closed the Public Hearing. X. NEW BUSINESS 2.Consideration and Possible Action - First Reading of Ordinance No. 1654 - An Ordinance of the City Council of the City of Pearland, Texas, amending the Project Plan and Reinvestment Zone Financing Plan for Reinvestment Zone Number Two (Amendment No. 6), City of Pearland, Texas to facilitate the construction of City facilities and infrastructure improvements (“Improvements”); authorizing the City Secretary to distribute such plans; containing findings and provisions related to the foregoing subjects; and providing for severability. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 3.Consideration and Possible Action - Resolution No. R2025-159 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a contract with Freese and Nichols, Inc., for professional services associated with the Longwood Service Area Sanitary Sewer Rehabilitation Project, in the estimated amount of $2,127,002.00. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-159. Ishita Rahman, P.E. Associate/Project Manager with Freese and Nichols, was present to answer questions from Council. Page 5 of 8 Docusign Envelope ID: A0AAB172-A93E-423D-95AD-FDAA31EED216 Pearland City Council Minutes November 10, 2025 Councilmember Koza made the motion, seconded by Councilmember Cade to amend Exhibit A, Section V - Termination - A to read, " The CITY, at its sole discretion, may terminate this CONTRACT for any reason --with or without cause -- by delivering written notice to CONSULTANT personally or by certified mail at 11200 Broadway, Suite 2320 Pearland, TX 77584. Immediately after receiving such written notice, the CONSULTANT shall discontinue providing the services under this CONTRACT." AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. Mayor Pro-Tem Byrom made the motion, seconded by Councilmember Fernandez to approve Resolution No. R2025-159 as amended. AYES: Byrom, Koza, Carbone, Chavarria, Cade, Fernandez, and Patel. NAYS: None. The motion carried. 4. Discussion - Regarding the annual National Community Survey (NCS) and National Business Survey (NBS). Presentation was provided by Trent Epperson, City Manager and Tobin McKearin, Chief Operating Officer with Polco. 5. Discussion - Regarding proposed amendments to the City Charter. Presentation was provided by Katie Leininger, Assistant City Attorney and Lawrence Provins, Deputy City Attorney. Jim Johnson, spoke on behalf of the Charter Review Committee regarding Council term limits. XI. OTHER BUSINESS There were no other business items. XII. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There were no issues to discuss. XIII. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Council adjourned into Executive Session at 8:23 p.m. Section 551.071 - Consultation with the City Attorney regarding legal advice related to development and zoning regulations.
